Is there a formula to guarantee an approval of your Social Security disability case? Unfortunately there are no guarantees in the SSD process, but there are certain characteristics of winning cases that you should know about.
I have tried hundreds of disability cases over the past 25+ years and certain patterns do emerge. Rarely will my client be denied if his/her case contains the six characteristics of winning cases that I discuss in this video.
At its core, Social Security disability is about how your medical issues negatively impact your capacity to perform even a simple, entry-level job. If you keep this vocational focus in mind starting at the instant you file your claim, you will increase your chances of winning.
However your focus on diminished work capacity should not start at your hearing. Instead, address these work capacity issues with your doctor at every visit. Use clear language when you talk to your doctor. Just as you would avoid “not very far” or “not too long” when you testify before a judge, do not use these "wishy-washy" terms when speaking to your doctor.
Your medical record will reflect what you are telling your doctor, so report symptoms using specific measurements of time, distance and weight when talking to your doctor. Your specific observations will find their way into your medical record and will be noticed by your judge.
Disability judges will approve you if the evidence in your claims file confirms your diminished vocational capacity and you can help make sure that your file is one that a judge sees as compelling.

As always great information. I've said this before if you get sick you go to a doctor, car breaks down a mechanic, toilet won't flush you call a plumber, need to navigate this mess called Social Security get an attorney, do your research, then listen to this man if your not able to retain him, his videos make your attorneys job easier if you help him he will work harder for you. I had a phone interview with the judge in beginning of April with the judge ( was approved) and beginning of June, I got my SSDI. I listened to you, Mr Jonathan Ginsberg. You were so very helpful. Thank you ever so much

be mid 50s on up, having had same job for 15+ years in a sedentary occupation, developing medical conditions such that you cannot perform said job or similar in a full-time capacity, and have abundant medical records to back up your claim

Excellent points (as always) Jonathan. Medical treatment, compliance, and documentation is super important both in your claim... but perhaps more importantly in trying to get better! If you don't meet a listing level then a clear theory on how the symptoms of your condition limit your ability to become employed is super important. But perhaps the most important factor is.... a clear and solid work history! Judges have to sort through a lot of questionable claims. One of the FIRST factors the ALJ will see is a claimant's work history.... the more solid and lengthy that history is... the more likely the ALJ is to move forward in the steps in determining if your impairment is disabling. Work history is a big factor.

This guy is good everything he stated is a fact, having gone through the process I have first hand knowledge was a forklift operator for the same company over 30 years shipping and receiving and the numbness in hands and feet, the frequent bathroom breaks from medications and blurred vision along with limited exposure to direct or indirect sunlight made it impossible to continue working. All back up by medical records and specialist confirming conditions.

Ive all but given up on the system. I have so many confirmed problems, seen many docs, MRIs, XRAYs, bone density, blood tests, EMGs. Ive had a pain specialist over a year and a half, tried many things that have not helped or even caused more probs. I had a hearing this past Dec, and had the judge throw out all evidence just because. My attorney said they can do that when they wish to. Starting all over but realy sick of it when we all know multiple people collecting benefits who dont need them.

Thank you I have followed all those steps, I am at Recon right now I spoke to them today they have received all my records again and the new questionnaires and I was told they are working on it, I have 2HNPs with tears DDD, spondylosis, L3through S1 fused, neuropathy going down the left leg and nerve conduction tests muscle tests MRIs failed epidural injections, 3 months of physical therapy and several months of neuro notes to back it up. All caused by a tractor trailer accident last year! I’m really hoping and praying to God I can win this! I am desperate and can barely walk or stand. Thank you for always keeping us informed, it’s a great service to your community! All this info has helped me get together all the proper records and do this step by step! I just hoping to get approved without having to go to court! Thanks again

Yes i agree, he would be my first attorney of choice no doubt about that. But i would and have taken his advise on Mr.. Johnathan Ginsberg referring me to a law firm because i live in a different state and some attorney's travel and some don't. But i trust his opinion anyday of the week. Just listened to all his videos i try to do it everyday and I'm taking notes noe becsuse he has given us so many great video's and advice to listen to and go by and I'm forever thankful for what he has done. I would hire him in a heartbeat i totally agree if i could and lived in the same state.

Covid-19 has a negative impact on SSDI applicants even with multiple firm diagnosis and continued medical use. I refuse to enter a doctor's office unless its life or death. I am now curious how the SSA will view fewer medical records from specialists within the last year, less physical therapy, etc? I see those being a huge detriment to winning claims.

Johnathan, what about continued treatment for fibromyalgia. I was denied three times and then with appeals council. My physicians have fully supported me and vocational expert stated that my job was non transferable and I fall into the guidelines for being disabled according to their grid rule chart, yet I was denied. So now I’m on a new disability case and yes there is more documentation and regular specialist visits with treatment being followed. I have an attorney but want to know if I have a better chance this time. It’s so difficult when you have physician support. Thank you for your videos, very helpful.

Would seeing a pain management be considered a specialist by a judge? I see them for multiple medical issues, or should I have a different specialist for each medical issue?

After being denied twice, I finally won my case last year. I received my back pay less the attorney fee. Will I need to pay federal or state taxes on the amount before or after the attorney feet or at all as this was an award. Also, while I was employed the insurance company handled my case and determined that I was not disabled even with all the chronic illness on top of why I was filing for disabilty. They also were unable to find me a job I could do. Therefore I took early retirement and left my job. While I was trying to get disability, the insurance company had me to sigh a form saying if I got any money I would pay the overlap. When I retired, I pursued the case with an attorney directly with SSA and they denied me. We repealed the case twice and won. We are now 2 years out past my retirement. They deducted 6 months and awarded me the rest. So my question also is do I have to pay this money back to my employer or insurance? Thanks

I'm currently 19 and have IBS that greatly limits what I'm able to do. I am constantly taking bathroom breaks that can take up to an hour. I've only had one job, which I've had multiple absences from. I want to work but I can expend energy for more than 30 min to an hour before I'm doubled over in pain and unable to move. I havent been able to see a doctor due to covid since my mother and I are both high risk. My question is, Is the gap in medical records due to covid, my age, and my lack of work history to much of a hurdle to overcome in a disability case?

How about having all of those things, plus an RFC from your specialist? A walker from your specialist, two ankle braces, and a handicap parking permit? I had my hearing in early May over the phone due to Covid, and still haven't heard. I'm a nervous wreck!

I called today and the lady at SS told me it's still processing , but I thought it was odd that she ask me a question I never been ask? She said did someone explain to you that once approved you will have to wait for 2 years for insurance? .... I said no..which no one ever has. Do you think that was a hint from her? I haven't even received anything even a questionnaire in the mail yet.. i had my MRI and think I have my medical records I need

I am a 51YO 26 year Veteran with 100% P & T. My documented major issues are: - MH diagnosis - LBP with Severe L5-S1 degenerative disks + bulging disks w MRI - Moderate L4-L5 degenerative disks w MRI - R Knee Total Knee Replacement - History of Left knee surgery and severe pain with 5-7 years history of injections - Chronic Migraine w Imitrex meds - Incontinence - IBS - Dozens of daily meds and weekly med appts What are my chances with SSDI

Do you have any winning strategies for social phobia? I have PTSD Social phobia and major depressive disorder. I was denied ssdi but I have a hearing for SSI. Is SSDI harder to get than SSI?

I learned that getting an attorney helps out alot, because SS sends you alot of forms to fill out. It's time consuming.

I can relate to that trust me. I worked in the medical field most my life and i had the best insurance and it wasn't cheap for the family plan but i worked so much that i barely had time to use it and it was frowned upon missing any work so then when something happens to you and you can't work and afford insurance and they think you can just pull money out of a tree to go see a dr or a specialist i know how you feel and it stinks and it's so so unfair. People say that they're are clinics and places in you're area but nobody I've heard of gets seen for free. I mean why would anyone apply for social security if they could work right. You do have the scammers but I've heard that they've changed the social security laws back when and now it's much harder to get because of those people and they are the ones who make it hard for the people who do really need it.

Where do pain management doctors come into this? Some orthopedic doctors refer you to a pain management Doctor after surgery. So you don’t see them .

Certainly so at a hearing. I don't think you need a lawyer to apply for benefits. I think there are good reasons to hire a lawyer to help with the recon appeal as well.
