sexual assault is extremely hard to prove in a court of law. when i was 9 i was molested at summer camp and the guy who did it was never charged because of the lack of evidence, my testimony wasnt enough to have him convicted. so in order for this guy to get a plea deal, there was at least some corroberating evidence against him. and from the sounds of it he wasnt alone durring the assualt, so tin foil hat theory: the victim went to the police, the police interigated him and the other suspects, he folded and got a plea deal.

People might not also noticed the psychological manipulation Jake is engaging in by continuously saying the charges are to be "dropped" when that's not at all how it works. If the charges will be "dropped" he wouldn't have been in a position to plead guilty in the first place. What is actually going to happen is, it's been so long his charges will be EXPUNGED from his record but he keeps using the word "dropped" as it brings a connotation of Innocence

So, I was sexually abused when I was 9 and my abuser was 14. I thought I’d my share my perspective as a victim, but please note that this is my experience only. I’m not saying that this applies to everyone, or proves anything. Just wanted to share my perspective based on my experience. My abuser, who I’ll call George, molested myself and both of his younger sisters. He was discovered when I told my mom what was happening. Once all the adults found out, George’s older sister claimed he had molested her as well, but this was a lie. She said this to get him in more trouble and admitted it within a few days. George was convicted and went to juvie for two years. I have some vague awareness of what happened, but not too much. Eventually, he married and has two sons. The marriage failed and he got primary custody of the kids. George and I have encountered each other at family events and I’ve spent time with his kids. It was his kids that really convinced me he had changed. He was an amazing dad, and it was obvious both from watching him parent and spending time with his kids. I developed respect for him. (For what it’s worth, he also had a support system (foster mom?) from his time in juvie which I’m sure helped a lot.) What’s my point in all this? I can understand why Jake might describe his BIL as a great dad and a great guy. I actually hope his assessment is correct because I want anyone - no matter what they do - to be able to change for the better. I also don’t have an issue with Jake keeping BIL in his life, or even with BIL having access to his own children. I think it’s bad if society permanently shuts those people out because of those actions, even when they’re showing growth and change. But being a great dad and a great guy is not mutually exclusive from being a pedophile - especially if we’re talking about crimes when you were a child/teen yourself. The fact Jake doesn’t see an issue with BIL being around kids or Jimmy hiring him while BIL is *legally* convicted is absolute brain rot. BIL is a convicted child predator who - even if he is a great friend and dad *now* - should have never been given access to children. Gross, gross negligence from Jimmy and a complete failure to link any two brain cells by Jake. And for the sake of acknowledging it, it’s possible Jake is right and BIL is innocent and the accuser lied. It happens. Maybe it happened here, maybe not. BIL pleaded guilty though, so Jake talking about “overturned charges” is total fantasy until said conviction is actually overturned. Speaking personally though, I can imagine taking a plea deal for a murder I didn’t do; I could *never* imagine taking a plea deal that required me to register as a *sex offender* if I was innocent.

Five years is a long time for evidence to deteriorate so police must’ve had something substantial to get him to take a plea deal. While I in no way support pedos. Lots of people take plea deals. Especially teenagers. I was in trouble with the law at 16 and plead guilty when I wasn’t too. The court fees and lawyer fees are so much higher when you try to fight it in court not to mention you are just gambling bc one wrong judge and you get 10x worse than what the deal was. I think id be a little more willing to fight a case if the deal was me going on the registry tho.

A plea bargain doesn't automatically mean you're guilty. One can either have a plea of guilt or a nolo contendere. Also, even though a bunch of people are saying "Oh I would not take the deal and fight it" when your freedom and life are being taken away from you in front of you're very eyes, you have no clue how you would react. The US Criminal "Justice" System is BRUTAL and the DA's and officers will do whatever they have to in order to get the guilty charge so they can add that to their win record.

Legally, yes, you plead guilty, but in actuality there are alot of reasons someone would take a plea deal even if they’re innocent. Jake says that he was innocent, and he took the plea deal for other reasons.

The reason "Delaware" can't go back to Delaware is because that plea deal had him give up the other offenders. And if they were convicted with jail time once they get or got out they are not allowed to leave the state. Meaning "Delaware" can not go back because he fears what the other offenders would do to him.

Plea deal doesn't mean he actually did the crime. Tom don't forget, Kyle (from PKA) took a plea deal which landed him in prison. He took the plea deal because 3 months in prison was better than risking 20 years even though he was innocent on the accusation. Not saying delaware is 100% innocent but just offering another perspective. He could have taken the plea because the alternative was risking massive prison time.

Pleading guilty doesn't necessarily mean youre actually guilty. Legally yeah. But in reality A LOOOOT of people plead guilty because its easier and helps them get a deal and lesser charges. Taking a plea deal by definition means you're not convicted by a jury of your peers as it does not go to trial. So 08:57 is incorrect. You only go to court for a plea hearing with the judge and sentencing.

I hate predators as much as the next guy but even innocent people take plea deals. Considering in Delaware 16 year olds can be tried as adults which lets say he didn't take the plea and was found guilty he could be sentenced highest to 25 years or life depending on the tier he is convicted of in the state of Delaware. So lets say he didn't accept the plea and after 4-7 months of trial he was found innocent, he would still be guilty by public appearence and his life ruined. Look at Kevin Spacey. He was proved innocent in the court of law and we all still think he did it. Regardless of innocent or guilty the plea bargain is the best scenario for either option. Me personally I can't make a judgement until I have all the evidence in front of me.

Problem is he’s thinking in absolutes and not leaving any room for doubt. There because have been several cases of innocent people taking deals because public opinion is stacked against them and they face extreme consequences if they don’t. I'd argue that Delaware taking the plea deal isn't as open shut guilty as it seems. While 20 when he was convicted, it was for a crime that happened 4 years before, or one fifth of his life. 20 is not exactly an age that's known for being savvy in the legal industry, and I'd like to see more info on that trial before condemning folks by association. Not to mention he is married to Jakes sister; meaning that if Jake was to condemn him, he'd be essentially bashing his sisters judgement and likely tearing a rift within his entire family. While yes this consequence is seemingly unimportant in the grand scheme, I think that's still a lot to ask of man and expect him to be easily able to do.

This whole thing is a mess, but I don't think it's right to equate someone who took a guilty plea a decade ago with someone who was actively using the platform to groom. Also, you said he was convicted by a jury of his peers when he took a plea deal. I'm not defending an RSO, but phrasing is important here.
