An introduction to South African Copyright law
In this video, Gretchen Jansen, a visiting scholar at the ITM from Stellenbosch University in South Africa, gives an overview of South African copyright law.
At the beginning, the rationale and sources of South African copyright law are discussed, as well as a future reform of the system to include a new copyright law.
Afterwards, the requirements for the existence of copyright protection are discussed (Sect. 2-4 of the Copyright Act), in particular which works are eligible for copyright protection (Sect. 2). These include literary works, artistic works, cinematographic films and computer programs.
It ia also discussed who is considered to be the owner of the copyright and what rights they have through an existing copyright protection and what actions others are prohibited from doing as a result. Gretchen Jansen addresses royalty rights and moral rights as rights of the copyright holder.
The duration of copyright is also discussed, and a distinction is made between different types of works.
This is followed by a description of possible primary and secondary infringements of copyright and which of those are punishable, as well as the remedies available to the author for infringement of copyright.
Exceptions to liability for infringement are also addressed. Finally, the transfer and licensing of copyright is discussed.
