Jerry Ray is a senior citizen who was prescribed oxygen tanks from AdaptHealth during the COVID-19 pandemic. (Answer ¶¶ 22, 24, 27.) After he returned the tanks, AdaptHealth continued billing him for using those tanks, despite his repeated phone calls and letters contesting the bills. (Answer ¶ 35.) AdaptHealth admits that it referred him to a third-party debt collector and billed his Medicare Advantage Plan. (Answer ¶¶ 70, 101.) In total, AdaptHealth sent Mr. Ray 48 deceptive bills requesting payment for debts he did not owe. (Class Action Complaint ¶ 31.)
This lawsuit alleges that AdaptHealth Corp., acting through its “Family of Companies,” engaged in improper billing and debt collection activities by attempting to collect debts from North Carolina consumers that were not in fact owed by those consumers. (Class Action Complaint ¶¶ 1-5.) AdaptHealth has admitted to repeated erroneous billing practices related to one of its North Carolina-based customers. (Answer ¶ 35.) Has stated above, AdaptHealth has also admitted that it referred this customer, who owed no debt to AdaptHealth, to a third-party debt collector. (Answer ¶ 70.) Further, AdaptHealth has stated that there is no objective way of determining from its records how many additional customers (if any) were billed for debts they did not owe. (Answer at p. 21-22.) This lawsuit seeks to determine whether other North Carolina customers may have been improperly billed by AdaptHealth.
Under North Carolina law, debt collectors can be fined up to $4,000 per violation of deceptively attempting to collect a debt that is not owed. See N.C. Gen. Stat. §§ 75-54, 75-56(b).
