What's funny she is trying to sue through Hague Convention too. For Hague to apply she has to prove the kids are habitual residence of the UK. They haven't even stayed in the UK for 3 months and don't have a permanent address plus the UK property said they bought is still under contingency until December. Meaning the kids never lived there and they technically don't own the home yet. If someone backs down they don't have the UK home. Joe could easily counter the kids habitual residency is the US due to him owning many residential home all over the US. The kids being born in the US, and the kids history of living in the US majority of their lives. Plus medical records and childcare records. Pretty much most likely win against her lawsuits against him. Plus she doesn't understand UK child welfares also doesn't allow her to have her kids live with her in the UK without having sole custody or his legal written custody consent. She pretty much need to learn to negotiate because she obviously don't have a case.

Well both of them are the problem. Joe was indirectly involved making the public can't prove but speculate his intentions. But Sophie was directly involved personally and she made many contradictions and publicity stunts with his ex. Pretty much toxic pair.

If the children have habitual residence in the UK then he's abducted them by not releasing their passports. He also lied about his FL residence when he filed. The federal court will decide which court has jurisdiction. It might very well be that the FL court doesn't have jurisdiction over either the divorce or the children. You will absolutely see a ruling by the federal court in NY.

They sold the house in Miami in August but has been up for sale since late Dec. and she started filming in the UK in April and he started touring with the kids. Florida is where he filed because that is where they were living at the time and the last permanent domicile. He is holding the passports per order by Florida court until custody is settled. He never told her she couldn’t visit with the children, only that she couldn’t leave the country with them until a custody arrangement is settled by courts. Once it’s settled, if it’s part time in the UK, then he will go to UK if need be. Not hard to understand 🤷🏻‍♀️

Absolutely. He had no other choice. I have personal family experience where the mother intended to take her child across the country until the father called for an emergency hearing. Thankfully, he realized her intentions. With the emergency hearing she was not allowed to even cross state lines until it was resolved in the custody case. I am a mother and feel fathers deserve rights also.

To be a habitual residence you have to live somewhere for a extensive period of time. Plus Joe has multiple residential properties in the US. Plus Hague usually deals with wrongful international adoption cases and they don't deal with custody battles. That usually causes the mother to be disconnected from their child and affecting the early stage of bonding with a child. Making it easier to decide to be away from the kids for a long period of time. Also the kids are at the age where they could eat solid foods. They don't seem to need breast milk. Those factors also affect how much the kids actually need her care.

Based on the time of the divorce filing and her Instagram post about how she and Joe mutually and amicably ended their marriage and how it was a united decision. She knew and agreed to the divorce and was obviously not blindsided and didn't found out only through the media. She wanted the divorce she just didn't know how messy a divorce actually is especially an international divorces which is far more complicated. I don't even think she did any research. Also now looking at all the legalities in both US and UK she isn't going to get what she want even if the public favors her.
