Many people miss the point of the joke: That an offer to pay Justice Thomas to retire is NO DIFFERENT than Harlan Crowe or others taking Thomas on expensive trips or giving him expensive gifts when they have conflicts of interest with the court. I mean John basically offers Clarence to free himself from the job where he seems to not care that much as he said it himself. Plus, he gets 1mil every year until he die. That is the same deal with supreme court job when you're appointed for life on that seat. Supreme Court Justice is a very serious position where that individual should get away from outside influences but Clarence seems distracted and uncaring of the responsibility he has on this country. Clarence can also keep contact with his "rich best friends" even after he quits the court, and I doubt if his rich, best friends would keep him around anymore if he quits. For the "This is bribery!" CHUDs: one of Thomas's "friends" started grooming him with lavish gifts and expensive trips and Thomas ruled in 10 cases for said "friend" since he started receiving gifts. Oliver's point was highlighting how absurd of a conflict of interest the existing situation is and, like the "gifts" from "friends", this is perfectly legal, albeit ethically and morally corrupt.

His piece on this explains it pretty well. There is no ethics oversight of the highest court, one with lifetime appointments. Since he has no matter in the court it isn’t really a bribe. It’s a legal agreement separate from court business.

Lawyer here... It's a crime to bribe a judge for a specific ruling, especially if you are an interested party in the case. But offering the judge money to step down when you have no cases before them, because you just don't like them, is probably fine.

As Oliver stated in his segment, it is not against the law. He found that laughable, but it is a fact. On the other hand, taking money/vacations from people that do have cases before the court is bribery, and Thomas should recuse himself in all such instances. The Supreme Court has no standing enforceable ethics code, and since previous policy has made it so that they are the only ones who can enforce things on themselves, they have made themselves exempt from all laws relating to bribery and impropriety

What Oliver is doing is not a bribe. People need to talk to a lawyer on what a bribe is before they spout out misinformation. One example of a bribe is for a border patrol customs agent to take 500$ if he lets a certain car through without inspection. Another example is when a government official is given 1 million dollars by a company so they can skirt environmental regulations. Another example is when a company gives 5 million dollars to a government official to secure a construction bid even though they aren't the lowest bidder. Asking someone to quit their job for money is not a bribe. No legislation is being passed by Clarence Thomas as a result of being paid 1 million dollars a year by John Oliver.
