Judge dismisses Alec Baldwin's 'Rust' case after defense claims evidence was withheld 

The second prosecutor bailing on the first prosecutor the morning of the dismissal, sure looks like someone knew the wheels were falling off.

They didn’t just claim evidence was withheld - they proved evidence was withheld. The judge found the claim to be true.

Brandon Lee died in a freak accident too he was shot but no case was ever pushed forward because it was an accident. I was wondering why Alec Baldwin was accused, the husband forgave him, the director and staff all knew it was a terrible accident. It's a movie set. Was there neglect? Yes most likely but he didn't deserve to be guilty of manslaughter it was accidental.

Don't forget, that the assistant prosecutor who gave the state's opening statement quit mid trial when it was revealed that the evidence had been buried and hidden from the defense. The DA should be disbarred and charged with malfeasance of office.

I've lived in Santa Fe for a long, long time. Absolutely NO one in town believes this case should have been brought. This prosecutor should be relieved -- she would have NEVER gotten a conviction.

Prosecutors can’t pick and choose what evidence is disclosed to the defense. That’s not their choice to make.

There should be much more attention to prosecutors withholding evidence. And it should mean being disbarred and imprisoned.

I was on the fence about this case. I wanted to see the case play out and what the outcome would be. But when prosecutors start playing shenanigans then I'm out.

I don't understand it: why would the Police tell lies?

I compare this case against an actor to a charge of involuntary manslaughter being brought against a baseball batter who gets a good hit, throws the bat, and runs--but the bat hits someone and kills them. The act of throwing the bat is inherently part of the behavior and cannot be condemned as such. If the batter was not in the live act of baseball--and just throwing the bat around for fun--then it could be manslaughter.

For prosecutor’s to bring this case before a judge is the real crime.

The fact that Jensen had a live round in the gun handed to him as well is unbelievable! The armorer is exactly where she should be. Implying there was an issue with the manufacturer seems unrealistic. Can a professional armorer not tell the difference? Why were the guns not locked up? Why did the entire crew have access? Is it true that the crew had taken the guns to a shooting range with live ammo? This is 100% the armorer's responsibility.

The problem is that Mr. Baldwin, just like anyone who is wrongfully accused and subjected to trial for a crime they didn't commit, cannot be restored to his life prior to this case. He has been damaged in a way that he can never be compensated for, the loss of time. This is why prosecutors need to be held accountable when they pervert or attempt to pervert the course of justice because their actions directly damage the lives of those they accuse, creating victims of their own. Not only did her representations on her own behalf demonstrate a complete lack of ethics, she was continuing her efforts to pervert justice by trying to entangle the defense in her misconduct by grandstanding, by making false statements under cross-examination and by phishing for information from the stand. Such disgusting conduct from a public official. She needs to be put on trial herself, learn what it means to be the accused.

It is NOT up to the prosecutor to determine what potential defense evidence is relevant otherwise they can just dismiss any evidence that a defense tries to bring up. She colluded with the Sheriff to hide the potential evidence under a made up case number.

I was following this on the periphery, but I never fully understood why he was charged. I assumed that there was more to it. Even though I don’t have all the facts, I always felt like the prosecutors and investigators were trying to get a career case. You prosecute crimes for public safety and justice. But Alec Baldwin is not likely to ever be in that situation again, and if I was a family member of the victim, I think I would just want to move past all of this. In other words, I don’t think the victim’s family was the top concern in this case.

Wrongful arrests and prosecutiosn happen all the time. Alec Baldwin is fortunate he had the money to hire the best lawyers who did their jobs to a T, but in most cases of innocent people being arrested that is not the case. The prosecutor thought she had a layup in a high publicity case and assumed nobody would figure out the truth nor reallly do their jobs because a) that is the norm and b) Alec Baldwin is not sympathetic. She should be prosecuted to the fullest extent of the law.

I knew about the Rust accident, but why was Baldwin tried in the first place? Isn't it the responsibility of somebody from the staff (some armorer / gun expert) to ensure that the guns are not loaded with live ammo? But then again, why was Baldwin shooting it at the producer? If he shot it at some other actor during a scene, that would have made more sense. It's weird that he shot a gun (even if he presumed it loaded with blanks) at a producer; and that the gun was actually loaded with live ammo...

The fact this even went to trial is a joke. Movie sets have professionals onset who's role is to ensure and enforce gun safety. As an actor, Baldwin would have reasonable assumption that those professionals had done their job and there was no danger in handling the gun. This is like me picking up my car from a garage and being charged with manslaughter because the mechanic disabled my brakes without my knowledge and I hit a pedestrian in the parking lot on the way out because the brakes don't work. The responsibility lies with the armourer who allowed live rounds on to a set.

It is not the actor's job to verify firearms....also if anything, SOMEONE was more than likely going to be shot, if it were not the camera woman, taking it that the next scene of the filming was not that the character was going to fire a warning-shot and or was directly to shoot the firearm with a visual disabled position with respect to whichever actor was supposed to be fired at.

I don’t like that actor but he should have been charged to begin with! But my worry is, what if this happens to an individual with connections to the prosecutors and they would conspire to deliberately withhold the evidence from the defense, so will the defendant get off the hook that easily?

I really hope Alec sues the prosecutor and Sheriff's office for violating his right to a fair trial, costing him thousands of dollars in legal fees, and the reputational and emotional damage they inflicted. Brady violations happen a lot, but unlike most defendants, Alec has the money and resources to fight back.
