I agree! Love hearing words said that I haven’t heard or used in years! Given the times we currently live, witnessing a ( albeit ridiculous in the lawyer’s motion ) critical analysis of court and municipal ethics was refreshing. Also reinforced my decision to stay way out of local politics!

Defence attorney should be played by Martin Short, and prosecution should be played by David Boreanz. Judge Simpson will have to be played by J. Cedric Simpson as he’s inimitable!
Dave Thomas would've been a better fit as the defense attorney as he'd be recreating a character he played on SCTV as an overbooked attorney (FWIW, Martin Short also was an SCTV cast member).
I always thought they had to present evidence to make that kind of motion. Like an affidavit from one party who took part in the communication stating under oath the communication exists. Otherwise it’s just gossip.

The Attorney is relying on stories from his client. He has to keep asking his client the answers to Judge Simpsons questions. The lady in black jacket behind accused looks like she is related. i think it does fall under hearsay. now if he brought in the witness to testify on the emails.. im sure this would have went a little differently but i think the defense is fishing and the judge isnt gonna allow that.

This whole thing is ridiculous. All the judge had to do is ask the prosecutor did you ask the sheriff deputy if there was email communications. If yes and there isn’t any fine, if not ask him to go ask and send them if there are.
Judge Simpson has the patience of Job. Presenting conspiracy theories in court is tantamount to lying. Using hearsay from the defendant to attempt to accuse the prosecutor of withholding evidence is not based on legal practice. Mr. Wavy Hands should find another line of work.
As annoying as the defense attorney is, asking for either a positive or negative response on those emails, whether they exist is proper. Since any record created by the government is the people’s. Obviously some restrictions to that. But damn, the defense attorney didn’t approach it all like he should have.
For some context, this is a different attorney who ran sideways with Judge Simpson over allegedly baseless allegations against the prosecutor's office. If I recall correctly, the first attorney ran afoul of Judge Simpson during a domestic violence case and that attorney was as disrespectful, if not more so, than this attorney.

If anyone believes that no written (email, text, notes, etc) communications exist concerning a criminal offense involving an IT matter...?? Comments seem really wrong on this, I mean what he is asking for, which is something he has good reason to believe exists, not the conspiracy part just communication between witnesses and detectives, because it was forwarded to somebody else, like that's pretty specific, people don't like the guy and everybody loves Judge Simpson but whether there is anything in those communications or not, he's going to be vindicated when the communications are turned over. People aren't understanding that if you know something exists that you are entitled to and the prosecution fails to turn it over when specifically asked for it, that's a huge deal.

Give the man the emails or call the county employee to testify. Why is the judge trying to protect somebody. Of course he's gonna start accusing the guy's wife works at the DA.

“What is the purpose of that?!? After we get done with all of that” the judge flat out defended the prosecutor and not letting the prosecutor speak for himself is really questionable. I get what the judge is saying but damn I do not like it when a judge is openly on the prosecutions team. I like Simpson as a person but he is very questionable professionally. Just my opinion.
Judge Simpson went too far. He answered for the prosecution, he said his personal feelings towards people involved prevented him from believing anything wrong took place and he ignored answers the defense attorney gave when asked. Judge Simpson asked how they know an email exits. The answer was an employee has a forwarded copy. Then Judge Simpson blows up and repeatedly says there is no evidence there are emails, listing off everything said, but leaving that part out about the forwarded copy. Judge Simpson is defending people he knows, showing it, saying it and even spelling it out. He should be removed from the case. The defense gave the prosecution something that has to be confirmed , but that something references the prosecutions own server data - that the prosecution can’t validate. The prosecution can’t validate their own information. So the prosecution had enough data verification to prosecute but they can’t access the data to defend the charges? And that’s okay because someone is out and the other person is dealing with the election. The burden of proof is on the prosecution and shouldn’t they have had all of this in the first place, shouldn’t they have been familiar with their own server data, before charging? I don’t think Judge Simpson realizes if the core issue is server data, everyone is taking someone else's word for it and if the first person is wrong, then this has gone too far. Judge Simpson answering for the prosecution when the defense attorney asked if it would be appropriate to find out if the prosecution looked for the emails was a HUGE overstep. This is the first time I’ve seen Judge Simpson make a mistake and he made too many in this case. This is the behavior that got him in trouble before - inserting himself personally when he feels people close to him need defending. All the Judge had to do was ask the prosecutor if he looked for the emails. Judge Simpson never forgets and hears everything so why did he keep forgetting an employee has a forwarded copy of an email? A broken clock is right two times a day. The defense may be right. When Judge Simpson wasn’t talking for the prosecution, the prosecution gave some weak answers and never actually answered the question if he looked for the emails or not - Judge Simpson answered that question. Not good.
You’re absolutely correct and the prosecutor jumped on the bandwagon once he realized judge Simpson was pissed. It was cringe what the prosecutor said.
The defense has to prove without hearsay that those emails exist. You need to call that employee as a witness because right now the defense is saying, "trust me bro."
I think what the defense is saying is that, shouldn't the prosecutor be trying to give all the evidence good or bad to the defense and not try to hide it like 90% of them do? Also, shouldn't everyone be looking for justice, the defense, law Enforcment, prosecutor instead of just a conviction for their friend so he can hold on to power. Just because the prosecution says he does not have the info doesn't mean he does not know what it is or where it is. All the prosecution has to do is say "don't say anything about any of this in my presence" and he can deny ever knowing anything about it, and they will do it in a heartbeat if it means getting that win. The prosecution is working with law enforcement to keep evidence out. Same thing they always do. The defense attorney knows how this goes because he was a federal prosecutor. He has more experience in violating people's rights than most. 'If you come to my court saying the prosecution and the sheriff are dirty and they are hiding evidence, you better be ready to defend yourself against not only both of them but me and the full power of my office as well". What a joke and a sham. Justice??? where is it? Oh, it's on ground under the feet or 90% of law enforcement and judges. Thats where it is.
i know this is a confusing case ... in a nut shell.. the defense motioned the court saying the prosecution is refusing to hand over evidence that doesnt exist. the defense is claiming there are email conversations that the proseution is holding onto. basically, the defense wants judge Simpson to approve his fishing expedition and is now throwing a temper tantrum cause the judge wont give him authority to poke and proad through the prosecutors emails.
