The Juvenile Justice (Care and Protection of Children) Amendment Bill, 2021, which seeks to amend the Juvenile Justice Act, 2015, has been passed in the Rajya Sabha on 28.07.2021. The bill was introduced in the Parliament by the Government in the Budget session this year. It was passed in Lok Sabha on 24.03.2021

Madam, whether a case of relative adoption completed by CWC, through CARA, can be reviewed, when it is based on false home study report, nd false affairmation in d court of D.M.by natural mother & PAP. Pl. advise.

CWC can only issue NOC/ permission certificate in relative adoption and this is required only when child is being given away by legal guardian, in absence of natural parent.

Madam please tell me .If any person can practice as an advocate after appointment of cwc member.

Advocacy is a full time job and will not let A CWC member do committee work with full dedication and without conflict of interest. So in my view a CWC member can not practice.

Mam, after adoption procedure completed, child hand over to the Paps, after sometimes child wants to return NGO. What is the procedure

First, the child and parents will be given counselling. If the problem persists, then dissolution /annulment of adoption can be done by the same DM who had issued the adoption order. Application for dissolution needs to be filed after necessary counselling and approvals.

CARA's NOC on the basis of concerned DM's verification report is required. Ministry of WCD has recently notified regulations in this regard; in pursuance of an order issued by Hon'ble Delhi High Court.

When will this change take effect for adoption?

It will be notified after the President's assent. It may take few months to get effective on ground. Can't say. there is no fix time limit given for this.

This amendment Act got the President’s assent on 7th August... has been notified
