Is this new in the Kitl TOS? Last time they sent out it is not allowed to use Kitl elements for Amazon KDP because it is asking author to have licenses copyrights over design element used and Kitl licence doesn't extend to having copyright licence usage rights. And any photo used must be covered with something, text or another element user imported. Can not be used as is. Did they change TOS?

Permitted use is physical products and/or rasterized use in digital products (Kittl specifically mentions ebooks are ok). I would say that creating a book cover is transformative artwork (since it involves additional words and/or images placed very specifically). However, everyone needs to make their own determination on whether or not the guidelines are being followed. Things definitely get complex when creating artwork!
