How far do they want to move the trial? We live in Spokane, WA & we know about it. My parents & several friends live in & around Seattle & they all know about it. Safe to say most if not all of our country knows what happened & we want justice for these kids & their families.
It’s really crazy for them to do this stunt. I live in King County, near Seattle. My niece was in a sorority apartment on the WSU campus when this happened. Anyone within the neighboring states at least will have heard about it. I met a gal from Georgia a year ago on a cruise on the Rhine, and she knew all about it too. You can’t find a truly unexposed potential juror in the age of social media and 24 hour news. The best that can be done is extensive voir dire, and calling more potential jurors than usual.
I believe she did this intentionally to force the trial to a new location. If there’s no bias, then create some. She should be disciplined. Of course she knew better. This was by design.
Ann proved bias in court Judge and Thompson are best buds Go along to get along The state wouldn’t have control if the trial had a a change of venue And their secrets would be out!
I wonder how many people started answering the survey but didn’t finish. I also wonder if the survey included cellphones, landlines, or both. I bet there were lots of other questions in there, but guess it might be awhile before we find out. Thanks Lauren for your coverage! You always do a great job! ❤
@@AlwaysStormy88 Yes, understood. However, I imagine there were people that started the phone survey who didn’t finish. Survey completion rates are usually low.
Agree!! She’s smart and she did this on purpose to do what she’s been “concerned about”…taint the jury so she can have it moved. I’m sure the judge realizes this and if he has the authority to do so, I also think she should be removed
She proved her point, I will be a dog if this case trial happen in Moscow. There is no way that will be a fair trial. The fact people call the prosecutor, that says a lot about the place.
The fact she is still under a gag order and didn't ask the court prior to the jury survey! She did it on purpose and now has gone up against Judge Judge.
The people carrying out the survey could possibly verbally inject information at the same time. In addition, we need to know as much about the survey method as about the questions. It is very difficult to write good questions and ethics comes into it too. There are a lot of grey areas here. I used to teach this topic, and I did surveys for years. NO-ONE but an established, respected, separate, completely objective research company should be doing this survey
Then probably the prosecutor as well. Are you following this case from the beginning? Do you remember all the hearings and the defenses complaints about the prosecution shenanigans? Well, they started playing duty first. I guess they are even now. She is no dumb and the court is already showing sides. The judge must not be in any side, but impartial.
I'm from Moscow but live further north right now. Many people up here have never heard of the case. Look at the Chad Daybell trial... how many potential jurors knew about that case? It appears the jury pool in Boise is just as tainted as what they claim is going on in Moscow and Latah County. If they do move the trial, it would probably be to Coeur d'Alene. That's my best guess.
This is incorrect info chopped & pieced together parts, it was made very clear that both the prosecution & judge knew the defence was going to undertake a survey which by the way was Les than 1% (400 people) of the population in that area & the defence does not have to get permission or provide the questions to the judge or prosecution that would be a violation of the defendants rights. Surveys are not a novelty they often done in high profile cases. Furthermore the judge did violate the defendants rights by putting in place a stop order without having it heard by both parties. If AT wanted to take that further, they could. Every single Lawyer is saying the above on RU-vid.
Likewise. I just commented similarly before seeing yours here. I wouldn't want to HTC being seen as of a similar poor caliber to News Nation. The two channels are completely different, and thankfully so.
Nancy Grace is levels above Banfield, one has tonnes of experience in criminal justice as a lawyer, the other is doing it solely for the News. Nancy Grace behind the scenes actively helps families out but not many would know that.
I don't know whether or not this guy is guilty, but if he is, I hope he pays dearly. Being said, the media has done its level best at poisoning the jury pool with all of the coverage of this terrible tragedy. There are hosts and guests on these court/trial shows that have already convicted this guy without actually saying the words. The people of that small community also watch those shows. So how can they not be biased? A change of venue is definitely required. But with the extensive media coverage of this case, I don't know if there is anywhere in this country that hasn't already heard about this case.
I'm thinking the defense was planting seeds to taint the jury pool, like shitting in the punch bowl, they messed it up for Brian "bloody-knife" Kohberger. Perhaps Brian will be treated better by his co-inmates or better yet; worse. 😅 Regardless, he's facing the DP 😂😂😂😂😂
A lawyer does not need the judge's permission to engage an expert to carry out a survey (Now she does due to this fallout). As well the gag order only applies to information NOT already in the public record which means what was asked is not covered by the gag order-not sure why Anne didn't bring that up.
Brian K has a real advocate in the whole of his defense team. He is very fortunate. Even if this tactic does not work, she is right to consider everything in a death penalty case, and that certainly would include where the trial takes place.
That kind of defense usually costs a lot of money. From what I've heard reported about his family they don't have that kind of financial security. I hope they haven't mortgaged their home to support him in this.
@@Paula-FunnyFarm So public defender money is paying for this top level lawyer and defense then? I"m not American so don't know how your system works, but I've heard of so many cases there where people barely got a defense due to the lack of skill and effort from public defenders. Although I do know dp cases have to use lawyers that have some additional qualification which may lift the standards, I suppose?
@@Paula-FunnyFarm This defense already is much better quality than the usual, isn't it? Is it because of it being a dp case so his lawyer has extra qualifications? I'm not American, so don't understand how it works there very well.
Yes, she should be referring to him in court as “Mr. Kohberger”. By using his first name, it denotes an over-familiarity between attorney and client. And it’s quite unprofessional of her.
I agree! I imagine she sees it as a was of personalizing him, BUT I also think it is very unprofessional. If she wants to call him Bryan in personal meetings, fine, but not in court. Mr. Thompson & Judge Judge always say Mr. Kohberger. I also noticed she says Bill & Ashley verses Mr. Thompson & Miss Jennings. I have also never heard her say, 'Your Honor'. Instead, it is just 'JUDGE'!
@@ErinAbou. Aloha! Professional or not, it is a way to humanize Brian Kohberger, a man yet to go to trial. Please folks, remember: this man is innocent until proven guilty. You may think it all looks open and shut, but until the trial comes we just do not know. I don’t know if he is innocent or guilty.
This has Kohberger’s game-playing alllll over it. Didn’t his dissertation include that creepy survey he was gonna send out to offenders? Because he believes he’s smarter than everyone else I’ll bet he’s had a strategy from day one & treats his attorneys like they’re his clerks.
If a court case is moved to a different venue, does the same judge rule over the proceedings? Or does the judge who presides over the court in the new venue get the case?
I’m unbiased in this case but follow pretty frequently. Why is this reporter so worked up? Apparently these surveys are common in cases. And if anything the Prosecution has dragged its feet getting all the information to the defense in a death penalty case. The gag order and not bringing in the surviving roommates is just weird. Tearing down the house is weird. Anyone with half a brain knows something is off with this case. May all the victims and the families get the peace and justice they deserve.
Did everyone catch Brian’s hand gestures when the judge started talking as if he can control anything I bet it was his idea to put out the survey to throw a wrench into it!
Completely reckless for the defence to just source out this survey and contaminate the public in this way. She’s a piece of work, stomping her foot like a spoiled brat.
I'm confused. Why am I watching a News Nation piece on HTC's channel? I never watch NN at all because, imho, it's everything HTC isn't. Disappointing, though I suppose HTC has to take opportunities to grow their channel when they arise.
Yep, the defence is going to continue with these antics - ps, this survey did not need to be done so early, so they had plenty of time to run the questions by the judge. Purposeful sabotage of the local community IMO.
Bullshit. Anne has to bring all her evidence to court proving the venue needs changing on May 3rd! So when tf was she supposed to conduct the survey so she could be prepared for May 3rd?
I think BK attorney is riding on the coattails of his alleged crimes, trying to make a name for herself, showing how slippery she can be. I think she loves all the attention she’s getting, just like BK. Hell, even if he was to get the death penalty, we won’t see it carried out in our lifetime… not if you’re over the age of 50.
In general the defense side is known for ‘lying’ and making things up but as a lay person even I can tell there might be a reason why. You’d be kiddn yourself if you think its 100% fair- people are more willing to believe LE and prosecution without question bc its what they’re supposed to do. Not only that but: judges seem to favor prosecution, prosecution has the upper hand with what evidence comes in, and control over the narrative. If these procedures are obvious as a layman imagine how it really is as an attorney.
I bet Bryan thought this survey up & is directing Ann Taylor! She should be taken off this case. I don’t care where you get a defense lawyer from! Something definitely wrong here!
Chris is a hack, the things he has done to others in his pursuit for RU-vid “fame” has been vile. Lauren is a much more measured, calm and factual guest.
@@samantham4351 I'm curious about your comment. I've come across occasional comments like it before, but being fairly new to the 'TC community' I don't know anyone's backstory. Chris strikes me as very genuine, so if you can point me to something that goes into what you're saying here I"d be grateful to see it.
There's no firing squad in Idaho. They are currently using lethal injection. There is no facility or provision for firing squad. If they try this case in Moscow it will be a fail!! There will be a good basis for appeal for Kohberger should he actually be found guilty. The survey is quite revealing and anticipated. He cannot receive a fair trial in Moscow.
Defense attorney knows its a chess move, I'm sure she has to keep pushing forward because if she admits it wasn't totally in line it sets a precedent before the trial has even started. And yes the craziest part is not clearing it with the judge-she is dotting her T's and crossing her I's on a death penalty case--no way that wasn't an oversight that she--if anything-- had an argument ready for in case it did go sideways.
