This video discusses the realistic outcomes an individual should expect from the CCMA.
Many employees believe that once they go to the CCMA, they will obtain maximum compensation from their employer. Employees need to remember that compensation is a remedy for your unfair dismissal - and the CCMA Commissioner links a variety of factors to this.
Factors the Commissioner will consider:
1. How long has the employee been working at the company
2. What is the financial state of the employer?
3. What was the accusation made against employee?
4. Period of retirement
5. Participation of employee in the process and a fair defense
6. Unfairness of the situation

Would the maximum still be 2 months even though you have been out of employment for longer e.g. 4 years? And if reinstated is there also a maximum to back pay?
