Good day folks. Blessed day to ya'll. Is there any case law pertaining to recordings without consent beind admitted into court?

I was dismissed due to recording a meeting without obtaining permission to where I was a party. I did this to gather evidence as the employer had harassed me in previous meetings to gather evidence to raise a case at the ccma. My employer claimed that the trust relationship is broken and as such that a summary of sanction dismissal will be the effect. Can this argument be challenged at ccma arbitration?

Can any part of a recorded Disciplinary Hearing be used at Arbitration if consent to that recording was not obtained

Thank you for your comment, Denise. The answer to your question is yes. According to RICA s4(1), you are permitted to record conversations that you were a party to without consent being obtained. I hope this was informative.
