If you tow a car that's legally parked even in a place of business that has a time limit and if towed before it then is an illegal tow and the company can be fine for illegal practices. Tow companies cannot tow a car without permission from the owner or property owner or police. Look at the title the people paid for parking how is this not illegal tow when someone has paid for it. That's like going to a store buying stuff and then get arrest for buying after leaving. Everywhere has different rules and laws you just have to know then. On private property is well known the owner need permission if cars where towed even after already having a some sort agreement with owner. But again laws are different in every state but private property or public parking every where might all same.

The landlord has a contract with the tow company to toe unwanted cars on said property. I already explained and is in the title. These people paid for parking both the landlord and tow companies. Also the landlord might not be responsible (depending on where you live) on paying for your car. There is a reason why there are signs where it say "at owners expense". The only times the tow company would be charged for illegally towing is when they are not acting in good faith or towing from somewhere they were not permitted to do so. Just like in this case it's on the landlord, not the tow company. The tow company is acting in good faith and not breaking the law as the landlord contacted them to remove the car they removed the call legally. The tow company is acting in good faith that the owner of the apartment complex had a good reason to have the vehicle towed. The landlord is the one responsible and is the person you would have to take to court to get reimbursed. I had a similar situation over a thanksgiving holiday once. My apartment was going to repave our parking lot. It was to happen a week before thanksgiving but things came up and they were unable to do it. They let everyone know it would be done after the holiday at the start of the week after thanksgiving but apparently, bad weather was coming and the only time they could get it done was the day after thanksgiving. Some people like me who were with family and not home got our cars towed. We still had to pay the towing fees and storage fees but the complex had to reimburse us. Just like here, it would fall onto the shoulders of the landlord, not the towing company.
I would have loved to see this on Judge Judy! She would have torn the landlord apart! He did this out of spite because he knew the car was still legally allowed there until the end of the month.
The owner of the car should just be able to obtain a court order for the towing company to release the car free of charge due to the illegal tow. The tow company should have the responsibility to collect from the apartment owner, who ordered the illegal tow in the first place.
Even though this is a six year old story, did the guy get his vehicle back and got some funds from the owner of the apartment complex? I would have called the cops and stated that my car was stolen from my paid for parking space at my apartment, that would have spurred some action from the owner of the complex and the towing company, since the owner illegally had the car towed.
Charge the landlord with Grand Theft Auto since your rent is paid up till the end of the month at that point you legally have the right to charge the landlord with Grand Theft Auto
Just be clear, it's prosecutors, not private citizens, who file charges in court and decide which cases to file. That being said, I _would_ go to the police to get the ball rolling on possible criminal charges, because I do believe the apartment complex owner _did_ break the law.

If the police and prosecutors can't be bothered to investigate and file appropriate criminal charges, well, that's a scandal for another day. But there's no doubt in my mind that a crime was committed here. You can't go around towing other people's lawfully parked cars. Especially to settle a personal grudge. That shows bad faith -- i.e., criminal intent.

Actually the best way to do it is pay it and then take the property manager to court for reimbursement and the fees. The courts don't like it when people refuse to pay. Like when you rent a place and something breaks so you quit paying rent. You still pay rent and you sue for the reimbursement. Otherwise it could be a defense that you are just trying not to pay. The tow truck company did nothing wrong. They were called to pick up a car. Instead of waiting months for court and having the tow truck company in the middle of something and risk of having ur car auctioned off by the time court comes. They need to go ahead and get it out and keep the receipts of everything and take him to civil court. This way they can use the tow truck company as a witness.

No it wasnt. Tow truck company did nothing wrong. They were called and did exactly what they were told. Now the landlord can be taken to civil court. What he did was not theft. He can not be arrested for it. What he did was breach of contract. They paid for rent that month. That's all they have to prove is being current rent paying tenants. Which they are.

Put a lien on the project than foreclose on it but send notices to company’s attorney of record no the owner so if they are cocky and go to court or think they can win without showing up he might end up owning the whole complex if no one shows up in court this has happened on tv years ago over $300 he ended up with about a million dollar project so get the right real estate lawyer sir

The real crime here is the ridiculous impound fees they let tow companies get away with. It literally costs them zero to have a car sit in their lot. They shouldn't get any more than what a parking spot costs at a storage facility, around here that's about $50 a month.
You can leave a small mobile home in 'secure storage' for a year for less than the tow companies charge to store a tiny car for a week. That's the American way.
I don't work for nor do I own a tow co. Yes, Some companys charge high rates and others don't. What needs to be considered is space. If a car is impounded and not retrieved that is lost space a-k-a revenue for the tow company. They cant park wrecks on the street so if their lot is full we pay the price
A lot of these tow companies know when it's is or isn't justified to have a vehicle towed What they don't care because no matter what they're gonna get their money.

there's more than one way to handle it. I would tow the owners car in the middle of the night and not let him know where it is. tell him when I get my car back, I tell you where yours is.
The outcome of this is like they said at the end. The guy is going to have to float the bill himself then basically sue the landlord for reimbursement. They will have to pay for their car and take the landlord to small claims and prove that they were up to date current renters at the time and that they were in parking space and not blocking the driveway, or up on the sidewalk, etc. Because they said they were moving and assumed the landlord did it because of their son. But I can see these people having their car illegally parked blocking stuff to move and left there car while they were inside too long and it got towed. Technically and functionally, the vehicle was stolen. Immediately, he should have reported it as such. THEN, he should have reported the tow company for having illegally taken it, the tow company's lot for having received stolen property, and to having previously conspiring with the apartment owner to steal his car. Legally you can't. Once the car is impounded it basically their towing people's property until the car owner pays up or is released by whoever requested the tow. If you break into the car lot, You can be easily arrested.

as someone who drives a tow truck you have to have a legal reason why you had a vehicle towed when you are the owner of a property. because you had an argument over where some kids stored their bikes and you didn't like it is NOT a legal reason. so the owner of this property has no legal choice but to pay to have his car returned to him.
@@MYOB990 at the time of this news story and video, the towing company was trying to work with the owner to return his car to him with all fees reemburst.and we are legally responsible, its one reason why any legal operator will make sure the car is illegally parked before towing it. some places say and lets just say 2 hour parking. the tow truck driver will drive by an area and make a mental note of what cars where there at the time he drove thru the lot. he will come back sometime later like 3-4+ hours and if the car is still there, it gets towed. there are several videos on here of tow companies illegally taking cars like bexar towing in texas, cyclone city towing in NYC and several others but these two named ones have been shut down due to illegal tows. most of which they had spotters in the parking lots just looking for people who parked illegal and when they did, they called the tow truck that was waiting right around the corner for them. one tip I can give you to help you out so you don't think we are all bad is that if you get out to your car being towed before the tow truck leaves, the driver has to legally offer you a drop fee for you to get you car back right there. the fee is usually no more than half of what it would cost to tow to their lot.

If you are ever about to get towed by scumbag company jack your vehicle up and remove one wheel. They will be unable to tow it and if they try will damage it and then you can sue.
