Over 20 years ago. Back when I was still with my ex. The police received a call that I was beating my ex and the caller had concern that I may kill her. The police came knocked on the door. My ex answered the door and the officer immediately asked if there was a man in the house. She asked what this was about and was getting ready to close the door when the officer forced the door open. They handcuffed her and proceeded to throw me to the ground hard breaking my nose and giving me a cut on my face that became a permanent reminder of what the police are. 48hrs without being allowed a lawyer. 48hrs with no medical care because, “he’s a woman beater who cares”. When we finally got a lawyer they charged my ex with ‘interfering with a police investigation’. They charged me with felony assault 1 and domestic violence. After a week of hell we finally got the charges dropped. It took both of us 2 years to get a judgement and 3 to get our records expunged. In all honesty we didn’t care about the money. We wanted it in writing that all officers who were there would be terminated. That never happened and one was promoted a few years later. My ex and I believed for years that you don’t trust police but if you were polite to them everything would be ok.

@@gregkasza1925 I am no longer with my ex. My wife and I have taught outer kids to not talk to police without us being present. Which led to a different incident with police. The police here are terrible and it doesn’t seem to matter how much they are sued or how much the general public hate them. The police here have an unwritten policy of “arrest them and let the courts figure it out”. If the police here get a call there is an 80% chance of them taking someone away in handcuffs. Whether that person is involved or not.

@@Dans_Garage_Media the police blacked out the name of the caller for “privacy and protection” reasons. We knew who it was. We ended up moving because the caller was an absolute nightmare to live on the same block as. She tried to act like we were in an HOA and she was the President of it. Shorty after we moved in she knocked on my door to tell me that I need to clean up my yard or she will be calling code enforcement. I told her to get the hell of my property and to mind her own damn business. The revenge took a while to set up and we knew it pissed off because she told us it was a violation and called the police. We had a chain link fence on the front of our property. We tied ribbons to the entire length of it and made it a rainbow pattern. We then repainted our house with rainbow stripes. When we sold the house the family who moved in loved it. It stayed like that for a while afterwards. I haven’t been past that house in a decade but I hope it’s still rainbowed.

It's another reason to never keep them outside the home but from the inside out. What can be easily accessed can also be tampered with, vandalized or stolen intentionally to prevent you from having the footage.

Cops broke in my house in 2015. No warrant. They said they had a 911 call that I had my wife held at gunpoint in the house. That was a lie. I told them I hadn't seen her in 2 weeks, and she was trying to get me out of my house. I told him no warrant that you're not coming in. They broke the door once they crossed the threshold. The first one had my two dogs on him. I had to save him from my dogs. When the dust settled and my lawyer got involved, they had to fix my door threshold and door. Cop number one got many stitches. Both cops were disciplined. One is no longer on the force. My now ex-wife was picked up earlier the next morning. I now have a solid metal door and threshold, a 6 ft fence and gate with locks and cameras.

Sounds like this uses VAWA. That whole thing needs abolished. My cheating wife & her destitute sweetalking HIV positive boyfriend, used this crap also. I'm now False Accused and have had 2 runends based on nothings. Arrested and jailed. It should be her for false accusing. Yet no penalties for doing it.

I've known so many cops absolutely will NOT allow police into their home without a warrant. If I didn't call them, I won't answer the door - period. If they need to use the bathroom, my bathroom is broken. Letting them in for any reason is giving them permission to look wherever they want.

OK if you want to go there the 4th Amendment itself does not require a Valid Search Warrant at all it was judges in the Supreme Court that created that requirement to begin with. 4A requires A. That Searches must be REASONABLE B. Tells Police how to obtain a search warrant and C. What must be in said warrant but never in any words does it say a warrant is even required in the first place. It says searches must be REASONABLE that's it. So when the right case came to SCOTUS they( Judges) decided as the 4A does not by itself establish an Objective Standard for what is and is not REASONABLE than they would and they(aganin the Judges not the law itself) decided the primary and preferred method for establishing REASONABLENESS was a Valid Search Warrant. That's the primary and preferred method but NOT by a long shot the only method as there are in fact 13 Warrantless Search Exceptions that make a Search and Siezure every bit as REASONABLE so both you and this turd of a "Defense Attorney" are both incorrect.

Two cops showed up at my home and claimed a 911 came from my home, and wanted to enter to see if anyone needed help. I refused. There is no land-line at my home. We have cell phones, but they didn't offer what number said emergency call came from. Total BS.

In my jurisdiction, Oakland County, MI, protocol is for the ambulance to stage until police clear the scene. We don't go in first. Ever.

To the extent medical emergencies is a valid exception, only EMT's or firefighters should be allowed to use the exception, not cops. And nothing found should be admissible in court.

My thoughts exactly. Since anything can be seen as an exigent circumstance and police hide behind qualified immunity, it begs the question: do we really have any protected rights? Even if we are proved to be right, it can take years and cost a terrible expense.

In many cases all justification for exigent circumstances is that (1) "we've got a call about domestic" and (2) "the state is looking very seriously on domestic". Nothing else is required, and if you refuse to open the door, not only they break in, but you will be charged with obstruction. Check out the case of James Wood from Cotati CA, back in 2013. A neighbor called the police about loud argument - that was all. Homeowner refused to open the door. Police broke the door, shocked the homeowner, arrested and charged him, he was put on jury trial, and jury deadlocked 50/50. "In a press release, Cotati police said the officers' actions were justified because it was a call for domestic violence, and as such, the officers could not leave without making sure everyone inside the apartment was safe. "To do so would be a neglect of duty," said the statement. "Due to the exigent circumstances, the officers were forced to kick the door open in order to enter the apartment. Constitutional law allows for officers to make entries under these types of circumstances without a warrant." Paul Henderson, a former prosecutor and KPIX 5 legal analyst, agreed the officers had the right to force entry into the home. "In the case where you have a third party calling from outside of the house, the cops have to investigate," said Henderson. "They're not necessarily going to take or believe someone telling them from behind a locked door that everything is okay without doing an investigation." Remarkably, once the cops made their way inside and arrested the man, no questions pertaining to "making sure everyone inside the apartment was safe" were asked.

It was because he DARED to refuse them entry upon demand. The "DV" call was pure BULLSHIT, and the cops KNEW it all along. Likely they had a tip that the occupant(s) of the home were dealing drugs, but didn't have enough evidence to get a warrant from a judge. "DV" became simply an EXCUSE for a warrantless entry.

@@John_Buck They don't believe anything, and in fact they would happily arrest the caller if only they had an opportunity. They are trained to hate, despise, and be afraid of everybody who is not in blue uniform, and everything that is taking place is only an opportunity to put someone in jail. That's why once they arrested the homeowner, it did not even cross their mind to actually "investigate" about the alleged "domestic" and alleged "victim" - the mission was accomplished. Too bad defendant's lawyer did not figure out to ask them about the outcome of the "investigation" that was so rudely "obstructed".

As a lawyer, you should know that both cops and judges regularly break the law! For example, in O.J. Simpson's case, the cops wait outside the estate for an extended amount of time. Finally, tired of waiting, the jump the gate and illegally start their investigation, only later, to receive permission from someone not living in the main house to search the main house! Clearly, the cops broke the law. Later in court, the judge permits the use of the "evidence" that was unlawfully obtained. Cops lie all the time, like claiming to smell something that can't be proven! Now, the judge take the word of a known liar and accepts it as creditable. However, when it comes to other people, a known liar is considered as not creditable! On the other hand, I consider it a really bad joke that the supreme court will make new "laws" while they totally lack the authority to make any laws!

further i woud like to know how exigent circumstance gives police warrantless entry when the supreme court has stated that a LEO has NO duty to put him/herself in danger to protect anyone. seems to me SCOTUS has some 'splainin to do.

Easy. He has no duty, but he still can choose to do it. You can look at creating the possibility to break the door and arrest the homeowner who asked for a warrant as an additional incentive to actually help someone.

no. SCOTUS has no explaining to do. You need to actually pull the case and READ it yourself because you are misinformed of what SCOTUS actually ruled. This is one of the biggest internet misconceptions out there because people like you just repeat internet hyperbole instead of actually researching and reading the decision for yourself. They do have a duty to act and can be prosecuted for not acting. The Coward of Broward is a prime example of that.

Police have the duty to protect _only_ when there's special relationship between them and the subject, and the pivotal point of Warren v District of Columbia was whether that special relationship existed. One can argue that such relationship does exist between the officer assigned to protect the school and the students in that school, but it certainly does not exist between the cops responding to a call about domestic disturbance and the residents.

I've literally seen so many videos where a civilian scares off cops rattling off of case laws and codes. And even if it doesn't stop the cop from breaking the law, it'll give you a stronger case if you have to take the cop to court

PRECISE-O!!! In "Lang", the cop has the perp in custody at the hive. If they want to keep him, and the hive can find another, "serious", crime complaint in a broad area in the same time frame (within that cop's shift) they can retroactively say 2 wrongs equal a felony and the arrest was valid based on later evidence. QI is retained, and the judge is protected in letting the case go to conviction. For that matter, the judge can also protect their career by instructing the jury to find for guilt unless one of them wants to prove the defendant must be innocent, all on their own novel observations.

All Cops should be expected to 'Know The Law' at least as well as the rest of us, since 'ignorance of the Law is No excuse', which has been the Rule since before the revolution to the present, Supreme Court has ruled on it . 😮 No excuses for Cops not knowing the Law. Especially since they have radio, cell phone, & computer! No Excuse!

Yeah, so long as you're a nobody. If you're a bourgeois local, no cop will mess with you since you're part of the social class that rules over them. Basically if you're a nobody, your friends and family might not be treated as credible witnesses of your character. However, if you are a member of the bourgeoisie, the whole town will come together to punish the cop and the trial will be filled with people claiming you'd never hurt a fly even if you ran a human trafficking operation.

You have to defend your rights, they are not given to you. That means stepping up and cops coming to your house without a search warrant you have to be willing to treat the criminal as the criminal as you would any other home invasion.

Exigent Circumstances is unconstitutional in my opinion. The police should be required to get a warrant to enter your home without your permission. The police can lie and say there is an emergency in your home when there isn't one.

IMO, entering your home or property using any of the exceptions to permission or a warrant should make any unrelated evidence non-admissible. Someone is dying in my yard, ok, come in and give them aid, but anything you might see is now excluded from evidence or probably cause. Fleeing felon, same deal -- hop the fence after him and grab him. See my kids playing Jarts, too bad. Also any damage done, they should pay for.

Exigent circumstances has a valid reason to exist. But I suppose that if you were in an emergency, medical or otherwise, but couldn't communicate you'd be ok waiting for the police to get a warrant before coming in to try and save you? I doubt it. Is it abused, hell yes, but it has a valid reason to exist.

Qualified Immunity for LE, means they don’t care. Yes, you can sue the jurisdiction, and after years of litigation, you may win, but it makes no difference to the officers, they are not held accountable. “Just doing my job”

It depends who they abuse. If they're trying to get someone thrown in jail who's family has lived in that town for over 200 years, then the cop will be out of a job. If its a nobody who moved in or who's parents moved there before they were born, the police system won't mind throwing the book at them especially if they're seen as a threat to the established families. There's a reason why some members of your town or city are obsessed with running nonprofit organizations and knowing everyone. Those are people who have deep roots in the community and they're thus the only people the police actually care about.

Some State Constitutions provide more protection when it comes down to warrantless searches & the actual issuance of search warrants ( e.g.... Florida) Ao one should not overlook this factor as well

I was renting an apt in Tucson and was out of town for a week, during that absence at food order was dropped off at my door. On the second day my neighbor called the police for a welfare check. The police did not enter, just left a card with a number wanting a call back. When I did call back they wanted last 4 digits of my social, I said no and goodbye. case closed.

Another sneaky way they abuse the exigent circumstances exception is they will respond to a call for an ambulance and get to a home before EMS and enter under the guise of being emergency first responders until the ambulance gets there. They can get there faster because they can exceed all speed limits where ambulances are not allowed. I live in a rural area, and without fail, the sheriff's department always shows up first even though they are at least 10 miles further away from our firestation where the EMS is also stationed. Be aware that a legitimate call for help in medical emergencies can also lead to lead to law enforcement entering your home without any reasonable suspicion or a warrant and get to do a little looking around in the process.

Yeah, when a cop works as an emergency medical person, he should be barred from acting as a police officer, and should be Required to uphold medical confidentiality like any other medical professional. If they cannot do this, then they should not be working as emergency medical persons at all... ever. I doubt there was ever a time in early American history where cops acted as medical emergency staff and/or were allowed to enter people's homes like they do today. Even an old man in the throws of a heart attack should shoot at a cop that has entered his home without a warrant or without prior permission of the homeowner. (and if a cop ever does enter a home under the guise of being a medical person, he should be banned from acting as a cop. He should be held to the same standard of medical privacy (medical confidentiality) that all other medical people/doctors are held to. They cannot ever report anything unless it imminently puts people's lives in danger... and even then, that is a crime (because once they are working under the orders of government, they become Agents of Government and therefore would/do need a warrant to be able to examine any person or his medical information or any kind of medical records at all). The law is Very Clear on this, so it's just insanity that they've ever been allowed to get away with it for so long.

Too often cops misbehave and they get away with it. I tell clients that they should have cameras on their home entries, and if the police are at your door, ask them what they want. If they say "can you open the door and come out and talk to us", I tell them to say no and don't open the door. If they say they have a search warrant, I tell them to show it to the camera (and if they show a warrant, open the door, get a copy and call immediately). I have an attorney friend that received a call from a client and the police were searching his home. My friend went to his client's home and told the police to give him a copy of the warrant (the police had not given his client a copy). The police told him that they did not have to give him a copy because they SHOWED the home owner the warrant. My friend started videoing the officers with his phone, and they removed him from the home. Later in the day (after the police found nothing chargeable in their search). My friend got an emergency hearing with a judge, who contacted the chief of police and ordered the chief to come IMMEDIATELY with the warrant. When my friend got the warrant, he noticed that the time it had been signed by the judge was more than an hour AFTER the search began (evidence by the door camera, an recorded radio traffic). The chief called to police who said that they were TOLD that the warrant had been signed, and they showed a copy of the warrant application, not the actual warrant. My friend said that the judge lost his mind, and told the chief that his officers began a search prior to a warrant being approved, that they illegally entered a home and began searching after displaying a fraudulent warrant. LONG story shortened, Three officers lost their jobs, and two were charged with crimes.

When I was young, cops in my city were fit, uniforms starched and pressed, had to have one year of college to qualify. Maybe Mr Hampton would answer the following question. Police is at the door, and they claim they have exigent circumstances - and they actually have them - and demand to open the door. The homeowner refuses and demands a warrant; police break the door and make the entry. They charge the homeowner with obstructing because he did not obey their lawful order (lawful because they had the right to enter because of the exigent circumstances) and thus slowed down their entry. How would you defend him?

There were numerous studies showing that witnesses often grossly misrepresent the most visible and obvious facts they saw the say before. Add police training that teaches them to perceive pretty much everything as a threat, and they are 100% sincere when they file the most outrageous lies. They see what they have been trained to see.

had a cop looking for my knuckleheaded stepson,(he used my address even though he Doesn't live with me). tried to say that he could come in if he "wanted" to..... that's when he heard the bolt on my AR go forward and i replied "you can try". never opened my door, And without POSITIVE ID of my stepson actually being in the house he COULDN'T enter.... i simply reminded him of that.

These days, typically in a homeowners or auto policy, damage cause by police action, even if you're innocent of any wrongdoing, like police chasing a suspect, fleeing in a stolen car, and he crashes into YOURS, or your vehicle receives damage when a "PIT maneuver" goes wrong and a cop's cruiser smashes into your ride, said loss is EXCLUDED. Then you have to sue that department on your own, and, typically, the courts dismiss such suits out of hand.

The police rely on your failure to protect yourself against their unlawful actions, i.e., no cameras present, and no audio recording equipment. This allows them to negate your testimony in court, with their testimony (lies); which, under the law, is looked upon as weighted testimony. Their words are actually viewed and treated as evidence. Cameras / audio recorders are among the very few things that can override their lies; but, most people take no action to implement this equipment. Video and audio recording equipment, ideally, hidden, is the best way to ensure you have legal recourse against the police, when they ignore, and run over top of your rights.

There's a reason I live on 30+ acres with 10 foot fences w/ automatic gate, and my house cannot be seen from the road. I'd like to take credit for how my property is setup, however the only thing I did was increase the height of the fences. Also speakeasy doors are great for communication without opening the door. I have an expansive security camera system and know when anyone is on my property.

Once had a cop bang on the door and when I opened it, he asked if another party was in the house. I replied "no" and he said he needed to come inside as they had received a 911 call stating that an assault on female was occuring at my address. Having nothing to hide, I let him in... He simply called out his presence, and asked to peek inside a couple of rooms that had the door closed. He was very polite, and his inspection of the interior of the house was extremely quick and unobtrusive... I think he was essentially looking to see/hear if someone was in distress or worse ... laid out on the floor. He apologized and stated that 911 (or the caller) had provided the wrong house address number. As I don't have anything to hide (drugs, illegal firearms, etc.) it made sense to let the guy do his immediate job. Rather than create a problem for the officer or myself (I suspect the 911 dispatch indicating "assault in progress" would have given him legal grounds to enter anyway) he left knowing he was at the wrong house, and could then radio 911 to review the call tape to see if a correct address could be ascertained. In this situation... I'm more concerned with someone that's potentially hurt or in danger getting assistance than trying to prove a point at my doorway. Arguing or trying to deny entrance would only tend to confirm for the officer something really WAS amiss...and at the very least, he would certainly "remember" me should we ever have future interaction...probably NOT to my benefit!!! Worse still... the caller could possibly be killed or severely injured because of a further delay in response time because of actions on my part. Thinking of my female family members... If one of them puts out a call for help to law enforcement, I would hope that no one slows down the response "just to make a point". That said... Why place yourself on a cops "radar"anyway??? Human nature dictates they will from then on, "be on the lookout" for you ... and don't expect ANY breaks, be it traffic tickets or other mess ups! Yeah...if the cop is rude/disrespectful or overly officious, I've got a problem with that... but it will be addressed through a "sit down" with their boss at the station in the form of an official, written complaint.

a few yrs ago I was sitting in my home..heard my name and address come over the scanner... dispatch called to squads to my address.... because 'i had a gun and was a danger to my self' ...i was 'swatted'.... I got in the car and left (i live in country)...drove in to town... listening to dispatch /squads the entire time.... squads called in and stated I wasnt home... and hadnt been due to fresh snowfall... did and opens records request... got the radio traffic...the would NOT give me audio of the ANONYMOUS call to dispatch making the accusation.... I was PISSED... LEOS can attempt to make contact based on ANONYMITY? I have a problem with that...

One thing no one ever seems to thing about is fortifying your doors so they can’t physically force it open. It’s easier to do that you might think.

There are several ways to strengthen a door, but you also have windows. If you fortify your windows, they will just come in through a wall. Think, "bigger tools". That's what cops have.

The most used excuse I think is "we got a call that someone was screaming for help in this house". Just let them in saying you don't acconsent to their entrance nor to any personal or property search. Arguing with them will just give you bigger headaches later on. Then file a complaint or lawsuit.

9:33 Even if this is a misdemeanor, I don't suggest anyone being pursued do this. You may still wind up needing a new door and frame. And that may be the least of your problems.

Even with a warrent this trick stops them from coming threw any door. Tape the instructions to a claymore to the outside. If they cant figure it out that wont be there problem for long. Hahaaa.

My wife came home to find our front door was wide open. She called the cops and they asked if she wanted them to go in to make sure no one was in there. She said yes, they looked, no one was inside and they left. Seems reasonable to let police in.

I had the same question and I looked up my state's law. It seems to say if you just run away on foot it's a misdemeanor but if you use a vehicle of some sort it's a felony.

Thank you for making this loophole widely available. Now all Cops know they can enter any home any time (no risk, they have qualified immunity) and get any cash or valuables using CAF.

This "loophole" has been well know for ages, there's nothing secret about it. Every cop in the US knows this. The only people who don't know about it are some citizens.

@@jd9119 But they don't know where my safe is. (Hint: It's not anywhere you can see it and not in any place they are likely to look.) A serious search would find it, but a half hearted search wouldn't. And remember, cops are tested and selected for low intelligence.
