You're absolutely correct. However the fact that he has the RIGHT to do this but his victims (the community of Waukesha) have none under the constitution is infuriating.

OMG, when he started crying during opening statements I started crying as well! I just couldn't help feeling just as badly for him as he feels for himself! I mean, when the man murdered & maimed innocent people for fun, then created a cruel circus in order to prolong their suffering, but was expected to be held accountable for his actions... of COURSE he broke down in tears! It's just not fair! Look! He's SAD, guys! HE might have to go to prison & junk! I don't think anyone truly understands his suffering. Poor, poor him. You know what? I know! I think I might start a GoFundMe in order to buy him the world's tiniest violin for him to be able to play while behind bars. It's the least I can do for the little lamb.
I know this is not the usual type of case you would cover, and I’m glad that you’ve decided to do live commentary. This trial has been compelling since the first day, but you picked a great day to jump in. The care the judge has been taking with the accused makes me proud of our justice system.
I agree she has been awesome. She gives leeway when she can but not where the prosecutor argues about it!!! Prosecutor seems to understand the need to be a little more flexible with this guy!!!!

The judge has given him an ocean of leeway as has the prosecution as to make this unfair Against the prosecution. They never want to deal with this person again.
Personal opinion; I think the smirk after his witness was because he thought his examination was so good the prosecution was too scared to cross not realising he had actually done their job for them 😂
He probably did think that! lol the truth of it is nick lied to many times and the prosecution didn’t want to touch it at all. I don’t think the jury caught in to his lies at the time though

His tears seemed genuine…genuinely selfish. He really seems to only consider himself and either can’t or won’t acknowledge the other lives impacted. It’s angering and heart wrenching (for the families of the victims).
Ooh did y'all hear his interview(s) with detectives? He shows in there that he only cares about himself and says something about not wanting to go to jail for life blah blah 😒 and never asks about the people.

I was working a Children’s Hospital in Milwaukee that night, and it was one of the most traumatic nights I’ve ever worked (and I was only in the pharmacy, not dealing directly with the kiddos). Thank you for covering the trial, as you said, it brings a lot of comfort to the community having lawtube’s support getting through the trial.
Probably an unpopular opinion, but I feel like she should not have engaged in/entertained his "screaming matches", and should have just put her foot down and revoked his right to represent himself, like Emily was saying she would do. His trial would have been more fair without him sabotaging himself.
I live in Waukesha county and just wow. Those poor jury people having to deal with him everyday. As someone local to this thank you so much for covering it.

I think her reasoning for going into so much explanation of her decisions is so he can’t legitimately say he was kept in the dark regarding what he could or couldn’t do, or be part of. It’s painful but he’ll never be able to say he didn’t know what was going on.
I don't think it matters if he doesn't know what's going on. If he elects to represent himself, it's his responsibility to understand court proceedings.
Either that or the judge has rarely dealt with sovereign citizens, and isnt entirely sure how to deal with them. And given theres cameras, maybe shes being doubly clear for them as well

@@sunflower9481 Considering that she ran for a public office position after this trial, I think this was more a case of her trying to look good to the camera's and especially to the people of Waukesha. While this community has had a lot of cameras pointed to the court house, it's always good to explain herself for the people watching. More for us than for him. Actually I really appreciated her explanations when watching this on my own, which I bet most citizens of Waukesha did as well before looking to Lawtube for commentary.
I feel for all of them working in there. This has been a wild mess. Like how he barks orders at the clerk with no please or thank you unless the Judge has to prompt him to 😕 (which no grown man should ever have another grown adult have to hint around to have them say such to someone else, should be second nature to do). Today was the first time he ever did it during this whole trial, but went straight back into do this, do that, etc. soon after.
He reminds me of the kid in class who would always argue with the teacher and when the teacher would say "stop interrupting class" he'd say "I'm not I just have a question!" And then ask a question totally unrelated to the lesson therefore interrupting class. Lol. I'd be just internally screaming JUST CALL THE OFFICE

I give this judge a ton of credit for not saying “you chose to represent yourself!” every time he says he doesn’t understand something or argues about something!
He literally has NOTHING to lose.. The closer it gets to the end of the trial his out bursts will get worse.. The 2 witness he called just verified the states case..
Agree totally. I fear he will attack someone. There have been a few times I have really felt the Sheriff needed to be paying closer attention, especially when he pounded his fist and was staring at the Judge with the same look he had in the photo of him clearly in the drivers seat while killing people. The Judge immediately stopped proceedings, stated she felt scared, and left. I have no doubt he has the potential to do more than stare.
Just to clarify what the court was laughing about was what the DA actually said was…. The judge asked how long do you think the cross will take… the DA said 0 minutes….. 😂 he didn’t realize it was not a positive of the things 😂

I want the witness to be MY friend. He seems like a very brave, loyal person with tremendous self control considering how well he did remaining composed on the stand. I think I would have totally lost my temper in that situation.
"Involved in the process" YES😁 Brooks in my belief likes the degree of control he has over witnesses, the Judge, the jury coming in or being removed and I just believe he likes that.
I think he truly doesn't like the woman of the court, or even any women. He doesn't disrespect the man lawyer and any of the men that testified . Btw the Oscar goes to The human as he calls himself. Totally fake to me . Boo it's not remorse only for what he is losing.

I had a patient like this once. This literally gives me PTSD from having him. Seriously trying to treat this patient and they got stuck in the hospital because they were in general homeless and nobody wanted to be around them. I described them as the worst human being I had ever met and to this day have never encountered anyone like this. Until this video

2:21:50 This is correct, SovCits pretend "I understand" actually is code for "I stand under." But, they also use the normal definition of "understand" when they argue that no charges can be brought against a person until they understand them. Which DB actually mentions at one point...that he has a right to "understand" the charges brought against him and nothing can continue until that happens... However, this just means that "I don't understand" is a Get Out of Jail Free Card.
I've been watching " the lawyer you know" for follow up. So glad you jumped in. Kept thinking , " I'd love to hear what Emily has to say about all this."
His being "emotional" and crying during his opening would make my blood boil as a juror. He's not sad for the victims, he's crying because he knows he's going to jail for the rest of his life and there is nothing he can do.
Judge Dorow carefully, ( but essentially), said that he declined representation and so into the fire we go. Brooks-i-do-not-consent-to-being-Called-that, complained that he could not get through all the boxes of discovery in 4 days. J. Dorow holding him in contempt would be exactly what he wants bc he would then have time. The non-lawyer, non-citizen Brooks is trying to get held in contempt. And that is one of the reasons why she won't give it to him, because, to wit; he's saying "oh please don't put me in the Briar Patch." Another reason is to preserve the record so as to limit appeal options. And 3rd, but more voiced, is that the jury would have to wait and put their lives on hold even longer for this man who after arrest was as excited by the FBI being there as a couch jumping Tomcruise.
But as Emily said, she could have revoked his right to represent himself when he said he doesn't understand, and therefore giving him probably a more fair trial by having a knowledgeable lawyer defend him and sparing the families and victims of having to watch this mockery and be questioned by the very person who killed your loved ones
@@IzzyMariel Exactly. She doesn't want to give fuel to the inevitable appeal when he's found guilty. By helping him understand things, he can't claim she is biased against him. He will try but the facts will show she was incredibly kind and patient with him.
I defended myself in a eviction case. While I lived in the complex the management company disappeared and stopped paying the bills (utilities were included in rent). The eviction was dismissed after we all proved that we had to switch utilities and had moved out at the end of our lease months prior to the case. It was still terrifying

I was almost evicted last month after the new girl they hired didn't know how to do whatever to get the automatic payments. The kicker is they set up a company just to handle those payments. Unreal.
It is very different no way should anyone defend themselves in a murder trial facing 6 life sentences. I would defend myself as well in an eviction, but my life oh hell no.
His questioning is giving “you hopped in the shower, where you washed you hair?!” Except there is no amazing follow up of…”someone who’s had, say 30 perms in her life know not to wash her hair the same day of the perm”. The patience of this court with this man 😮
I think the reason the judge didn’t stop was because they were trying to wrap it up before the anniversary of November 21, not to mention there would be a length of time it would take to appoint one and gif him to go through all the discovery.

While this trial is very painful to sit and listen through, I really appreciate that you are taking time to watch it and discuss it. It is so much easier to listen to someone make a mockery of themselves when you have somebody talking through it and validating that it is cringey to sit through. And I think it's super valuable for people to see how self representation pans out in court, because it's a big deal, and a big disaster for people who choose that option.

Came late to the live. Love your show and thankful for everything you do to keep us informed. My husband actually represented himself in court for a workman’s comp. Case and WON!!! I’m so proud of him, especially now after watching all these court cases.
He is acting all the different roles and emotions when he feels like it. I got away from my husband who was like this and so abusive and worse during covid with a breast cancer diagnosis. It is draining in every way when they want to do this.
This is one of the most frustrating things I’ve seen. This is a mockery and people were murdered. There is no justice in this situation. I pray the families aren’t watching this.
There is a channel that keeps laughing at clips from this case. If this were 1995 in my city after we lost 168 friends and neighbors and had to see some soulless jerks laugh? So many of us in Oklahoma City do have PTSD still. I think there is better help now, and hope so much that there is healing in the community. But I also am aware that there can't really be justice, because our loved ones don't come back.

The injuries we've learned of were horrendous.. Kids with open leg fractures, facial scarring from road rash, etc. Over seventy of them on top the 6 dead.
There was actually a lot more victims. For example people getting hurt running away or running over each other. They actually said they completely missed a student from the band. Only the people directly hit by the car where charged.
