Alternatively the "server" is an extra who has gone through make-up and costume, given a prop called "tar toast". He gets lost and spots his handler. He walks up to his handler asking where he needs to be and someone interrupts, asking what he has. He answers honestly and turns back to his handler to see where he needs to go. In that time the gentleman takes and bites into a tar toast.

I mean I would probably assume tar toast was a play on tartare which is raw minced or ground meat. I would not think street tar in that situation.

Honestly that's what I thought he said the first time! I didn't have captions on and I was busy doing something else. So take that, added with perhaps a crowded room, the din of all the talking, chairs moving, laughing, glasses and silverware clinking---perhaps even music playing. I could see where a miscommunication could totally take place.

A person seeing food on a tray may or may not ask what it is before eating it because context would suggest it is edible. If they do ask, there's a good chance that the person doesn't listen to the response; they were asking purely as a setup to eating whatever is on the tray. They may not have heard what Trevor said and they may not have connected what he said to what "tar toast" is until it was too late. I would probably put fault at 95-5.

What if the waiter was presenting poison labeled poison on a silver plater as performance art at a event and someone drank it. Can the victim sue? Can the artist sue for “destroying” the art?

You can’t destroy performance art of that nature considering that the reaction of observers and participants and the act of serving the poison is what constitutes the art, moreso than the poison itself. However unless the “participant”/victim signed a waiver and was warned of the events beforehand The artist is still liable, art or not.

Trevor is, in my opinion, at least 70% at fault due to the nature of his uniform, the serving platter, and environment. It is reasonable to assume a dish is safe to consume, regardless of what it looks like and its name. Especially since there are dishes that are designed to look like things in edible, and are named after things that may not be edible. Also there is a dish called steak tartare. Which would add to the believability that a dish could be called tar on toast. Never mind I changed my mind he's at least 85% at fault.

was it a uniform? If you look at the ending scene, he's still dressed like that. I looks to me like that's just how he dresses. I also think it's a person's job to ask if they don't know what is in something they are about to ingest, as well as seeing/smelling literal tar... at a certain point, I think the onus is on you to take care of yourself and not eat literal tar.

in defense of Trevor, He always wears that suit as shown in the second part of the video, head did not wear it with the intention of tricking anybody. The party seems to be a gathering of movie industry types, and in movies they often have non-edible prop food in order to film a scene (eg. fake ice so it doesn't melt halfway through the scene). the people at the party, being in that industry, would most likely be aware of that possibility as demonstrated by Sam who said yuck when told what it was. edit: this is not legal advice, I am not a lawyer

Based on the end of that sketch, It seems like Trevor wears that same suit regularly. Does that change the situation? Is he less liable if his normal attire is similar to waitstaff, and being dressed the same as the actual servers was a coincidence?

If the fancy event had security wouldn’t it also be partially their fault for letting someone who isn’t staff dressed as staff into the party? Also just the mechanics of it he probably walked into the party holding the tar toast unless he made it at the party. Ultimately I’d say 70% Trevor, 15% security if they let him in with the tar toast/outfit, 5% other staff who should have alerted security that someone was carrying around inedible substances dressed as a waiter, and 10% the victim

Honestly, I wouldn't assign any blame to the victim. Its quite reasonable that one would think "Tar Toast" is just a name and not actually Tar on Toast. That said, I hadn't thought about Security. They definitely deserve some blame.

I like how they made sure an extra distracted Trevor so that he didn't actually see him take the toast. Leaves open the possibility that if he had seen him take the toast, then he indeed would have stopped him. There's no reason to assume Trevor was ever going to let someone take the tar toast.

I would think that since "Pigs in a Blanket" isn't a whole hog wrapped up in a quilt, it's reasonable to think that "Tar Toast" is also a euphemism.

Here’s a legal question: At my job, we’re allowed to listen to music while working. However, we can only have one earbud in at a time. The reason given is so that we can, “hear the fire alarm in case it goes off”. My question is.. if a worker suffered catastrophic injury due to a fire, and claimed they couldn’t hear the fire alarm go off due to music playing in their ears, would they have any basis for a lawsuit against the company?

Firecode for building over a certain size require lights when sprinklers and alarm go off. So it probably wouldn't hold up even in a civil case as those lights are super bright when they go off.

@@obi_wanshinobi you may work in position where you don't see any of alarm lights, and have high tech noise canceling headphones, or hearing problems, so you're using highly insulating earbuds with unusually high max volume. So it is foreseeable that there will be someone, who could not react to fire alarm if working with two earbuds.

Considering he doesn't work the the catering company. Is there a written etiquette where a certain suit has to be worn by certain individuals? The suit Trevor worn is perfectly acceptable to wear. As for the tar toast, it's his personal collection that's he's proud of. What if it's his art? Do you go eat the paintings of fruit in art museums because there's fruit on it?

I think Trevor is at least 66% (2/3rds) at fault. Also it makes me glad to know I always smell food before I eat it to tell if I'd like the taste, so I should be immune such circumstances.

Cold tar may not have a strong smell like hot tar does. Depending on how dry it is, I could see mistaking it for dried meat, dried fruit, or dark pâté that's been sitting out too long. Given the low light, I think you are more likely to misidentify what's on the toast.

@@Lynwood_Jackson Maybe, I wouldn't at least, I can smell the difference between flat soda and non, so I don't think hot vs cold matters. Like maybe if you didn't go out of your way, but bringing it up to your nose with a well working sense of smell, I don't think I would at least.

Personally, I can reasonably see someone blindly reaching for anything on a tray at those events. After seeing the entire sketch I would almost say that it is reasonable that the guy was intentionally dressed as wait staff to give out tar toast. I'd give the vp guy 75% of the responsibility, 15% responsibility to the guy who actually took the piece of tar toast for not paying attention, and 10% to the venue for allowing something like this to happen.

Objection, Tom the follow up scene is further evidence that the Tar-Toast man chooses the outfit closely resembling or matching the catering company’s staff as his regular formal business attire. The fact you would ignore the value of this evidence is baffling, and I only hope that the RU-vid comments jury also understands that this was simply an unfortunate event caused by the negligence of a single man who did not only ate tar but did so without question… and this man is not the one carrying a platter of actual street tar on toast.

I'm from Texas, so in a setting like that I would assume "tar toast" was me mishearing some kind of fancy French dish. BUT. I'd also go after the venue for not having proper lighting, preventing me from visually inspecting the food.

Trevor is 100% at fault. No reasonable person would think that street tar on toast would be in that circumstance (on a serving plate, at a fancy function, held by a man dressed at a waiter) without being explicitly told "this is not edible, do not eat this", which Trevor did not do.

@@Rudofaux it was touched on in the video, but "Tar Toast" could be taken as something similar to "Mud Pie", because there are foods that aren't literally made out of their name; the name doesn't disqualify it being edible.

The two weeks later bit does add an important detail. It shows that Trevor regularly wears a server like outfit as his daily attire. I think a good lawyer could get that percentage fault down below 51%, as Trevor volunteered the information when asked and at no point expressly acted in such a way as to offer the tray to someone. Specifically, he didn’t extend the plate to anyone that we saw, and the tar was taken off his person while he was distracted. Presumably, if he had watch someone take his tar toast, he would have intervened.

I'm going 100% Trevor. The context leaves me to conclude it's food. If I ask "What is that?" I may not even understand the answer even if it's edible. So if it's presented like every other edible thing there, it's on the guy with the tray to make sure I know it's not edible.

I feel like the other guy is obligated to ask about what tar toast is exactly. Because as he said mud cookies has mud in the name but there is no mud, or ants on a log dont have real ants or logs. So while he may be justified in thinking tar toast is a funny name for a real food, he should have still asked whats in it instead of shoveling it in his mouth. If tar toast was a real food and had something in it like peanut butter or gluten or something hes allergic to, would it be reasonable to say that trevor was at fault?

So, I saw this sketch for the first time a few years ago. The next day I was approached by my manager who was very angry that I accidentally left some bleach water out on the bar. You see, he was drunk and decided to drink a random glass of liquid w/o so much as smelling it. I couldn't stop thinking about this sketch and was trying so hard not to laugh in his face. *implying

I would argue the fact Trevor was wearing the same suit at work, with no knowledge that the guy who ate tar worked in the same office, would contribute something. It's certainly evidence that he wasn't dressed as a waiter, just that it's his regular suit.

100% on trevor. Even if someone told me it was "tar on toast", I'd just go, "huh, odd name for food but okay", and eat it. Especially since the conversation with the actual waiter at the beginning of the video was identical. Same outfit, same tray, "what is it?" "ANSWER", and then the individual takes the food.

I think he's 100% at fault. He not only dressed similar to a waiter and carried around a serving platter with the toast with tar on it, his body language also indicated he was handing it out to people. He did not hold it in front of him to keep it to himself, he held it out in other people's reach. He did not pay any attention to it or otherwise show any ownership of it or desire to do anything with it or keep it. He even answered what it was when asked without pulling the platter away and keeping it with him when he turned away from the party guests. He fully presented himself as a server and it is simply unreasonable to expect someone who sees someone else who 100% appears to be serving something to ask that person if they are a server before assuming they are and taking the food that appears to be being served to them, especially when it was presented with a conceivably reasonable name for a food that's meant to be eaten. It was called tartoast, not tar on toast, and nobody would ever assume you would put actual tar on toast in the first place. By all indications he appeared to be a waiter serving a reasonable food with reasonable food standards, yet he was a guest poisoning another guest. Even if it was unintentional, he is so unreasonable in 3 separate categories in which you would expect a party guest to act, that you could not at all expect another guest to think for 1 second that he might be a guest instead of a waiter after all.

One way of looking at the events here: Many automotive fluids come in cans much like the aluminum cans used for beverages - same tab-open system, the whole nine yards. If somebody's car is having trouble, maybe I ask to borrow a tray and use it to carry a variety of fluids to that car. Let's say someone approaches me and asks "What is that?" I say, "it's power steering fluid in the red cans, synthetic motor oil in the yellow cans, and antifreeze in the blue cans." He then takes, opens, and begins to consume one of the cans in the span of two (2) seconds. Have I acted wrongly? Does this case deserve a similar ruling? If so, why are the similarities between the case shown and the case I described more important than their differences? If not, then what distinction(s) lead to a dissimilar ruling?

“Waiter” 50% at fault. No explanation of why he was carrying Tar Toast on a silver platter while dressed like a waiter and didn’t call for medical aid for the victim. Victim 20% at fault. Didn’t question more about what Tar Toast is and didn’t seem to even look or examine it before eating a bite and swallowing. Catering company 10% fault. Didn’t police their staff or the guests and allowed person to masquerade as waitstaff resulting in accidental poisoning. Host of party 20% fault. Permitted a guest to enter the establishment dressed as a waiter, and carrying non edible items on tray as if they were edible. They should have not permitted the guest to pose as a waiter and bring his own “food” into the establishment.

I’d say it’s like 85-95% on the waiter guy, depending on whether the venue or the real catering company are also named in a suit. Finger food like that is generally made to be stuffed into your mouth without even looking at it, and bothering to ask what it is would generally be a formality or a way to keep track of what you like so you can get more later. In addition, the body language of the fake waiter, the visible matching of his clothes with the uniform of the catering staff, the fact that the tar was literally spread onto a food product, and the fact that this was an influential and powerful person attending a social function for the same company/social circles where he has so much power and influence all put the fault in this case very, very much on that fake waiter. The defense that “he said it was tar toast” really doesn’t hold up to scrutiny when he literally said the word “tar” a single time while impersonating catering staff, carrying tainted food around, and making that food accessible to anybody willing to grab it and bite down unwittingly.

IANAL, but I would think that if it could be proven he intended to impersonate wait staff, that could change it from mere negligence to criminal as that implies intent. Might make a difference in the amount of money the victim gets and even whether or not the VP could be criminally prosecuted.

If someone was walking around serving oysters, you don't eat the shell. Tar toast could be similar where the bread is toasted with hot tar, and you're supposed to remove the tar before eating the toast. I know, sounds weird, but people put leather in wine so you never know what could be considered fine dining.

This is definitely interesting. My thoughts is that Trevor does not have the greater fault here. First, with his suit, its possible its the only one he had or didnt know thats what the wait staffed looked like Secons, why was he carrying the tray? You could say that he got himself food, or he was cleaning, maybe. My real question is why would someone just eat food they don't know, especially with the name "tar toast". You wouldnt eat ants on a log if you didnt know what it was. Youd ask what it was. True, Trevor did not try to stop him, but it could be argued that he shouldn't have taken anything off of anyones tray without asking. . Definitly an interesting case, id like to hesr your guy's opinions on this

I mean...Trevor presented a good argument. The consumer is at much greater fault. I'd suggest "edible" is subjective. Dirt is "edible". What kid never ate dirt? Edible doesnt mean "good for you". Theres people eating rocks and mattress foam and drinking bleach and laundry detergent. Ive seen a guy eat a bicycle. The consumer should be aware of the ingredients before consuming them. It wasnt implied at any time that tar toast should be eaten. Trevor wins 100%. RIP Trevor
