I love this fair, no nonsense judge and how respectfully she treats everyone. I’ve got to say, one of the reasons I never miss a video is to she what fabulous handbag she’s brought! Id love to see a video showing her whole collection! It’s the little things 😊.

When the prosecutor said that the statute of limitations ran out and so they had to drop the charges and then re-indict under a more serious charge...thats shady AF right there! The whole basis for our constitution is that the State can not just drop charges on you 10-15 years after the fact. Good call Judge!

The defence attorney is 100% correct. The prosecution is trying to circumvent the statute of limitations. It's not about protecting this defendant. It's about protecting everyone's right to due process.

He knew he was indicted. So not taking care of your case is being a fugitive because a warrant will be issued.

@@user-peach408However, his case was dismissed because the statute of limitations had passed the point of being able to convict. There’s no proof that the defendant knew they indicted him again under some other charge they changed it to. This was a serious waste of money for the tax payers. Surely the DA should know this was bogus and I’m violation of the defendant’s Constitutional rights. Just my opinion though.

That's why she is so well liked. I am grateful that she doesn't just make quick decisions. She actually reads all the evidence presented to her and ask questions herself to get to the bottom of things.

Good call!! If it takes them twelve years to put a case together, that all by itself questions the legitimacy of the case-in-chief from the very start.

Or if it takes 5 years and then you don’t try to locate him for 2 years. Then after two tries, you do nothing for 4 more years, it not going to work.

The truly sad thing in this case, is that the victim gets no restitution. Whatever he stole, they lost. How the state dropped the ball on this, should be looked into.

I'm SHOCKED that a judge ruled against the pros in this. Kudos to her. Statute of limitations ran out so they shadily charged him with a related charge. SMH, but not surprised.

This is very embarrassing by the prosecutor. Did he really think a witness saying they had gone to two out of date addresses years after the alleged offence and been told the defendant wasn't there would prove they had made diligent efforts to locate the defendant?

The offense happened in 2012, the statute of limitations ran out on the original charge so they dropped those and indicted on a more serious "related" charge, only 3 attempts at service MULTIPLE YEARS LATER with no further investigation into his current location, then calling him a "fugitive" because the law and prosecution didn't make even half of an effort to properly serve him????? The judge called it right! I'm not usually on the defendants side but this is shady practice at best and exactly why our laws are written as they are. This should be extremely embarrassing for the prosecution and even more embarrassing that he still tried to make a case by bringing an officer who made 2 attempts YEARS ago at 2 locations he was no longer at anyway with no further investigation. Just ridiculous so I'm glad this judge holds up the law!

Judge Boyd wouldn't dismiss a parking ticket from 100 years ago. She'd sooner give you a life sentence for it.

People being upset that the judge took this action are not listening or refuse to listen. I'm not saying the defendant is innocent, but you must look at the facts of the situation.

She almost certainly didn't have the job of investigating anything. She was just sent to serve the arrest warrant.

I'm retired, and I do watch Judge Boyd many times every day. I just came across her maybe a month ago and watch every episode that I find on RU-vid.

legally this happens more than people think. When you are a every day working citizen it becomes ironically hard to catch if you dont update license, mailing or living area every year or when you move. The law is designed to catch criminals who do crimes consistently. They did more than one indictment after the statutes of limitations ran their course, which people may not realize is quite reasonable to not get proper notification after that long of a time. It seems they kept pressing for it despite all signs said okay this may have been a 1 off situation is it worth the resources to spend for the minor crime that is alleged? It takes 10's of thousands to do the entire process the state tried for this defendant. Possible 6 figures even all for a 3rd person theft it sounds like. So he wasnt even the direct person of said crime but by some way of affiliation he was tied to the case. This is why taxes dont drop lol you will have DA's office and police units milking the OT for investigation for "allegedly" trying their best to find the person but in reality dont dont intend to find them but they do like those $15,000 bonus in the year for time invested for investigating lol.

😊real question, can the Vic pursue the defendant in civil court? Like he can still be sued right? Perhaps that should be how it proceeds forward since the state dropped the ball criminally

A deputy that doesn't know the difference between an arrest date and an indictment. She reminds me of a female deputy that used to pull females over on the West side where she always claimed she smelled weed so she could look in their bras and in their pants.

Judge Boyd made the right call here, but that's only because it wasn't even a close call. The defense would have had an awfully strong case on appeal otherwise, and she knew it.

seems every courtroom video description sensationalizes the event. "sounds off" to me equates to him behaving with aggression, he didn't, he just presented an honest defense. NBD. no emotion, no pleading, stories about the defendants kids, etc. he gave the facts and the state had no counter. no drama.

I’m actually surprised this prosecutor did what he did,slapping “new” charges bc of the statute of limitations running out 😡I like him & he’s great at working out pleas🤷‍♀️,now he should learn from this cases & the victim,if he’s guilty,should’ve hounded the prosecutor,all that & I’m so impressed with Judge Boyd per usual ,she’s ever so present with each individual & professional ,weighing everything 💯Here’s to Judge Boyd😇

dont know what he stole... dont care what he stole... but anyone saying "poor victim doesnt get compensated" apparently never heard of insurance. victim was probably reimbursed by their insurance... whether it be homeowners insurance renters insurance... or whatever.

Another prime example of prosecutors playing dirty. The original indictment was to reach statue of limitations so you dimiss the charge and have the grand jury reindict so you can continue to go after him. Waste of tax payers money. If this man was such a criminal y'all should have put more effort into finding him. That was POS move. Do better. Says something about the law enforcement agency that has the task to find him and make that arrest. I said what i said !!!

Uhm.... pretty sure the speedy trial thing doesn't start when the offense happens. First thing out of the defense atty's mouth is sus. If the rest of his argument has validity, that was a bad starting choice, to me, unless he's arguing something like abuse of process, not just speedy trial.

As the defence stated, there is no evidence that he avoided anything. They tried to serve the warrant at out of date addresses. That's not his fault.

If you serve in a fiduciary role for someone else, you must not “misapply” any funds entrusted to your care. This is a white collar crime under Texas law. Specifically, Section 32.45 of the Texas Penal Code states an individual “commits an offense if he intentionally, knowingly, or recklessly misapplies property he holds as a fiduciary or property of a financial institution in a manner that involves substantial risk of loss to the owner of the property or to a person for whose benefit the property is held.”

In order to avoid something, you must first know of that something. He was never served, so he did not know? Leo's can tell the Uncle to get into contact with him all they want, he is under no legal obligation to do so, and cannot be punished for NOT doing so. I hate theives, but there are few crimes that they can hound you forever on, and simple theft is not one of them. There were no details to this theft, hence my using "simple" theft. I hate to see thieves walk free, but I agree with the judge, Statute of Limitations ran out, you cannot try to manipulate the law to recharge him.

You must not be well acquainted with judge Boyd, she ROUTINELY disagrees with plea agreements, she's tough and never hesitates to send folks to prison, she's fantastic
