A person was removed from the US for simple assault, and with false travel document that was never issued by his consulate, he also does not have removable offense, the criminal court magistrate did not convict him, rather, his court appointed lawyer forced him to sign probation to get out of jail because he told the lawyer that he has to return back to class because he was in nursing school, the court appointed lawyer took advantage of him and had him sign a two years probation over misdemeanor assault whose maximum sentence does not exceed one year. He is a lawful permanent resident since2007 and he was forcefully removed in 2018, he has a US citizen son and he is a US school graduate nurse, what is your advice to enable him get back to US and fight to clean his record because, for one, the simple assault charge was false accusation from his ex girlfriend because he dumped her, and he never fail to file his taxes, and many good moral characters to mention.

I would disagree with you on aggravated felony not be able to receive waiver. If person came to us and then adjusted stutus to green card he is eligible to apply

Hi,i would like to ask you what is the process in someone removed for 5 years

It depends on what the person was deported for and how they are eligible for a visa or adjustment of status afterward. There are many different processes a person could take after being deported. I would suggest reviewing some of the different processes I go over in my other videos or calling my office to schedule a consultation ta 917-885-2261 to book a consultation.

You need to consult with an attorney, It depends on the grounds for deportation/removal, how many times you were ordered removed... Generally speaking, after the period of 10 years after an ordinary order of deportation not for an aggravated felony, a person does not need I 212 but may still need a waiver depending on the grounds of the removability/inadmissibility.
