Does New York’s “rent stabilization” law violate the federal Constitution? The law, which regulates approximately 1 million apartments in New York City, was enacted more than fifty years ago and remains in effect based on an every-three-year declaration of a housing “emergency.” The law does not merely regulate rent levels; it also limits a property owner’s right to determine who uses an apartment, to convert the property to new uses or to replace the existing building with a new structure, and to occupy the property for use by the owner and his or her family.
A lawsuit filed in 2019 asserts that the New York law-including 2019 amendments that significantly increased the restrictions on property owners- violates due process and effects both physical and regulatory takings of the property that it regulates. After being dismissed at the District level, the case now moves to the United States Court of Appeals for the Second Circuit.
Rent regulation is not just a New York phenomenon. Other cities across the country have enacted, or are considering, rent regulation legislation. Andrew Pincus, lead counsel for the plaintiffs, and Dean Reuter, Federalist Society Senior Vice President and General Counsel, will discuss the constitutional challenge in the context of the Supreme Court’s evolving property rights jurisprudence-including last Term’s decision in Cedar Point Nursery v. Hassid.

NY is going down the gutter due to these laws. this Is a big reason why many buildings sit empty unrented. many people are leaving NY

@@robertowilliams7003 a lot of the wealthy New Yorkers are moving to Florida. Rents are going up a lot because thousands of units are empty due to landlords not wanting to rent them out. No one wants to rent their buildings out & then have squatters stay in them

@@Gio-ue8ps true as well. I heard the law change will come in October and those empty apartments will be back on the market with the 6% rent increase on stabilized apartments

I don't see how it can happen. I do see how the landlords can be sued out of existence. Among the renters, there are hundreds of thousands of seniors who made important decisions based on the fact that they had practically a CONTRACT in hand. Imagine an 80 year old woman who 15 years ago decided to retire after some thinking and calculations: "My rent is reasonable, I have my SS, small pension and medicare. I looks like I can retire." Now, 80, in poor health, she won't be able to afford her apartment and will end up in the street. I can see a problem.

@@mwatercress It wasn't the city. It was .. well.. federal. Why would federalists know this? Or anything else? And it might happen. AFTER the retarded are placed in the NYCHA homes for the retarded. And let me explain ... slowly. Their contracts are ... with the landlords. Surrounding hundreds of thousands of the elderly and disabled and locking them up in cages is, of course, what federalists are all about. Freedom!!!!!. Federalists might want to consult Hitler's or Stalin's instructions on how to do it efficiently. And yes,' there is no room in NYCHA properties. Did you check how many homeless are already in the streets? And sorry, if even a small group of elderly goes on a hunger strike, points finger at you and dies, you are toast. As mass murderers.
