My favourite from this video is EDB saying " I have a question, have you ever seen a judge dismiss a case with prejudice and then just undo it, cause I an mistified". I actually spit out my coffee!!! Thanks for the coverage EDB. You rock as usual!
IMO Morrissey, in both trials, aimed for the final results/ guilty and the heck with the rest in her strategy, attitude and behaviour. I found her attitude rude rather than as a ruthless prosecutors with the truth as her guide. I find Morrissey is full of herself.
I found her style fun at first, in large part because I was so upset about how this tragedy occurred. As the Gutierrez trial went on, tho, I realized both she and Bowles were just acting juvenile
Man, I took one of those long showers, you know the type, got fully dressed, started a load of laundry, and folded & put away my child's clothes all during Kari's response... jeesh, is it just me or did time just drone on and on with her? 😂
Mr. Bowles never seems prepared. I don't understand why he didn't submit the exhibit of Johnson's testimony for his argument.🙄 He might need reminding he isn't part of the Baldwin trial.
The Erlinda affidavit is not relevant to the Gutierrez case anyway unless Bowles has proof that things weren't disclosed to HIM. Whether or not they were disclosed to Baldwin's counsel is irrelevant to the Gutierrez case. And Erlinda neve worked on the Gutierrez case. As the affidavit says, she was only hired in the Baldwin case in April long after the Gutierrez trial ended. She also said this in her media interview.
Kari inspires me to say so, so many cursey words!! 😡🤬 Just when im at the 💥 level, you insert "The FBI!" or the screaming sound effect. Awesome! 👌 Thanks, I NEED that listening to her!
Replay crew.I had to pause during the live, to go to work. I left at point 4 of kerries rant. She gave me anxiety all afternoon and now I'm back in it and I just...I look forward to hearing from the judge
@@SandyKnauerMorgani assume would be totally inappropriate of the judge to do that 😂 but I’m surprised she never interrupts her. She shut Kari down pretty hard when she quadrupled the page limit in her written motions…
Hannah was offered the same deal as Halls. She didn't take it. And unlike Baldwin she didn't have an army of top tier lawyers. She further screwed up by saying terrible and insensitive things, proving that she had no remorse. She obviously needs that prison time to become a smarter and better person. I think the judge will see it that way, too. The unfairness here is only that Baldwin goes free. But that's Kari's fault. The proper reaction by the court to the unfairness is not to release Hannah, it's to punish Kari Morrisey.
@@Wrightway93 In the zoom meeting about Baldwin's first motion to dismiss where his lawyers argued malice on Kari's part she said that all 3 (Halls, Baldwin, Gutierrez) were offered the same deal.
@@Wrightway93 Please do, if you can find it. I just tried to find it on Emily's channel but failed. RU-vid's search features are just too bad. It was a pre-trial hearing via Zoom that featured both Kari and Erlinda.
@@Wrightway93 I wonder if the video has been removed for some reason. I just found the report by the Santa Fe reporter about what I think was this hearing (May 17). It has a link to a live stream of that hearing but the video is not available anymore.
She really hits that condescending shriek that does not work at all unless you have the moral highground. And sadly, while before she could feign she had it, she openly lost it and is refusing to admit it. So now it just grates and frustrates.
Honestly, Morrissey accusing Erlinda Johnson of backing out of the case out of self=preservation is such a silly argument. Of course she did - she needed to protect her reputation and integrity. Why is that such a bad thing?? As if protecting your hard-earned reputation by not taking part in shady practices is SOOO terrible. Just ridiculous. Morrissey is so disgraceful. Thanks for the great coverage as always, EDB!!
Agree…Miss Johnson knew that Morrisey had messed up! The right, ethical, lawful thing to do was dismiss the case…the judge even made her position clear…we all knew it was gonna be dismissed…yet Zombie prosecutor Morrisey kept on coming…🤦🏻♀️
IMO Morrissey is now doing the same thing she did while testifying in Bakdwin’s case and that is arguing details instead of the bigger issue of her NOT giving all the evidence to the other side either intentionally or with her deciding that she is THE expert of the content of the evidence and expert on how the defence would or would not use it. She is doing the same pattern of arguing what SHE thinks is right or wrong, useful or useless and what to give or not give to the defence and that the court should just rely on her words. The court needs to step up and acknowledge that she is a prosecutor that decides what evidence to give and that she should be stopped.
if I were the court and leaning toward keeping Hannah locked up, after about two minutes of enduring Ms Morrissey’s argument, I’d immediately release her just to make Morressy stop talking .
I wish I was joking when I say I had to actually turn this off because Morrissey's increasingly higher pitched louder volume'd snark was literally making my anxious cat aggressive.
Thank you for covering cases with integrity and tact. You educate and entertain at the same time. You are the best RU-vidr out there, in my own opinion, of course.
As a prosecutor, there aren't any! She is a defense attorney hired specifically to prosecute these cases and discovery obligations apply to prosecutors.
@EMILY: In response to your question at 38:44, and how Kari is so calm? It's because she doesn't have a conscience! You have to have a soul and compassion to care about someone else to feel bad when your mistakes impact the lives of others. At least at my job when I make a mistake, someone doesn't go to prison.
I always liked Kari and her photographic memory. I have to LOL at the pack mentality here -- and watching everyone fall in line with one person's opinion. Funny - it happens all the time! :)
Judge Sommer’s demeanor is a complete 180 from the smoke she always had for Bowles (and Baldwin’s defense team) in other zoom hearings. I don’t want to read into it too much because it could just be that she’s so dismayed with Kari and this case overall, but I wouldn’t be surprised at all if she at least grants Hannah’s release pending appeal, possibly even new trial.
what does happen to a lawyer who lies and manipulates information? Are there any repercussions??? Early next week? Does that mean within the next year???
Great question! I mean she lied and manipulated on live tv. It’s sad bc it makes you wonder how many times this has happened behind closed doors. There has to be repercussions.
I'd love to see Kate McKinnon (formerly Saturday Night Live) do an impression and satire of a rabid Morrisey once. With a faux Alec Baldwin in the scene too, of course 😂
Morrissey has several super powers perhaps including unwavering hubris, pervasive lack of self awareness, maybe a xan scrip, total poker face and a gentle touch of sociopathy… it’s interesting, entertaining even!
I was just thinking, so many people are saying Hannah didn't do her job, but what if she HAD done her job perfectly, put the guns away at lunch so nobody could tamper with them etc., and then Alec Baldwin comes along, points the gun directly at Halyna (against SAG rules), cocks the hammer and pulls the trigger, if nothing came out of the gun it would still seem like a hostile act, if blanks came out they would still have injured Halyna since he was pointing the gun directly at her. What would be the point of him doing that ? Kari reportedly has a witness who saw Baldwin pull the trigger. If he had injured Halyna by shooting her with blanks and Hannah had done her job perfectly, would he be the only one in trouble ??
I personally find Morrissey's argument hard to follow. Bowles' argument i found easier to follow- even with him not giving all the exhibits. I also am just shocked Morrissey was laughing... that's not appropriate.
The judge in the rust case pays attention to everything and is smart. She's going to fo what she believes to be the right thing and her rulings will be supported by precedent and case law.
I took my kids to Metallica day 2 in Seattle. Absolutely amazing. The stage setup is awesome, and their audience interaction turned out great. They are absolute gems 😊
Kari Morrissey’s ability to stay calm and compartmentalize is actually a pretty impressive strength. It definitely serves her well as an attorney, helping her stay focused and on top of things, even when she’s being challenged. I couldn’t do it, but it’s a great skill for her line of work!
My hubby went to Metallica in München Germany ,couple months back, he said , it was awesome, they played songs they never played live before, and with the thunderstorm it made it even better.
Given the continual and consistent late, or non, disclosure by Morrissey (and how the judge kept letting her get away with it prior to both trials), Bowles should have been given a couple of days to file exhibits rather than just striking those parts of the motion relying on the missing exhibits.
It has always appeared to me that the live rounds came from PDQ, Seth Kenney's prop house. But I don't know if he was involved other than improperly storing them in the same facility with prop dummies. I think he instructed Sarah and Nicole to discard as many dummies as possible so that the Rust production would have to order more from him. But Hannah was under pressure to control costs and complained about missing dummy rounds. Sarah and Nicole attempted to get out of trouble with Hannah by taking what they thought were dummies from PDQ to replace the dummies they had improperly discarded. That was what was in the box that appeared in the prop truck that morning. That is why Sarah and Nicole were giggling and Hannah did not understand why. Sarah and Nicole thought they stole replacement dummies from Seth. But that new box that they put in the prop truck that morning included live rounds. The reason that all the live rounds police found looked the same is that Sarah had already discarded any that looked conspicuously different prior to police arriving. Sarah testified that she did not know why she discarded rounds. But we know why. It's obvious why. If you want to prevent this from happening again, you need to keep untrained people from handling firearms on set. The ATF loophole should be closed.
I live in metro atlanta so a little distracted with the storm. So I'm watching this at 9pm im so glad I have a glass of wine but this women is making me drink the whole bottle😂😂😂😂😂😂😂😂😂
I'm still pissed that Halls got basically nothing for his responsibility for his role. Many of us dislike Baldwin, but he had the least amount of responsibility. I wanted him to at least get just a misdemeanor negligence charge that would be probation because he really should know better, but he never takes personal responsibility for his own actions. His own words and actions prove negligence - they had this in the bag. Both Halls and Hannah should have taken the brunt of the charges, and both should have gotten the same sentence. But the prosecution was starry-eyed and went after the wrong suspect. Their investigation and scene securing were egregious. They should be heavily sanction for their presecretory violations. BTW, NM is one of the most dangerous states, which is surprising because of its population and ruralness - is there any wonder why this is, after all the failures of law enforcement and prosecutors?
Replay crew...Um, 41:00 like you did with your motions to reconsider the DISMISSAL WITH PREJUDICE of Baldwin's car?! I don't recall seeing any legal analysis in that motion, KARI. Also 52:50 Kari saying they can't argue for a new trial due to strategic error is rich considering the Court found Keri committed the biggest strategic error OF A BRADY VIOLATION.
To be fair, it's not particularly relevant. The Erlinda affidavit is not relevant to the Gutierrez case unless Bowles has proof that things weren't disclosed to HIM.
Replay Crew!! It was my hubby's birthday so I missed the live but you're awesome. Thank you!Cases on a delay are the best way, live hanging around at lulls and breaks distract me lol. Code Bruh!!
This whole trial has me conflicted and I’m not entirely sold on the fact that Hannah saying she should have checked the gun more is an admission of guilt. She was in shock and it’s very possible she would have said the same thing had she checked the guns/ammo 5 times and totally adhered to safety protocol. I’m not saying the rest of the evidence make her great, all I’m saying is that I can’t bring myself to put much (if any) weight on the video in comparison to all the other evidence as to what was happening on the set due to the state of mind she was in.
@@inxine On the surface, yes, it is an admission of guilt. But let’s just pretend for a minute that she did do her job perfectly. Being the armorer, she could reasonably feel she hadn’t checked it enough even if she’d checked it 50 times and it was a 110% certainty that she did everything she could possibly have done given all of the other factors at play on that set because she’s in shock. It’s not uncommon for people to blame themselves for things outside of their control, especially in stressful situations. Since, in the context where she made the statements, she could have reasonably made the same admission of guilt regardless of it being her fault, how are we to know if it was an actual admission of guilt or if she was oblivious to what she’d done (or failed to do) and was just trying to process what had happened? I’m not saying I don’t think she’s responsible, what I’m saying is that, when put into context, I can’t put much weight on her admission of guilt as evidence that she was actually admitting to doing something wrong.
@@NerdDogMom I agree it’s supposed to be her job, but I don’t agree she was the last resort. Safe gun handling was the last resort…the last thing (chronologically) that could have made this tragedy have a different ending. Part of my conflicting feelings in this case is that she was put in a position where enforcing safety practices was putting her career at risk, and she wouldn’t have been put in that position if safety had been a priority on that set. What she should have done seems obvious to us since we know that it ended in tragedy, but she couldn’t see the future and I understand why she wouldn’t have wanted to risk her career. That being said, her actions had terrible consequences and while I understand why she made the decisions that she did, it doesn’t change the fact that had she checked that gun the way she should have this wouldn’t have happened.
IMO Karrie Morrissey's actions which have already had one trial dismissed and I imagine this one will be too, is the person to blame for Helana not getting justice. She wanted these cases to be her shining achievement it seems, so she kept back what may have lost her the case. Helenas family should get justice but they won't with this prosecutor
If I were the judge she would piss me off telling me what doesn't allow for retrial . After what she did on the Baldwin case. How can she say I didn't make it up or I'm being honest. Yuck
"AZ to TX to NM". That is irrelevant. No one is saying that. The point is that the same batch of Thell Reed's ammo was split in Texas, and some went to Tesky in AZ, and Seth Kenney took some in a green ammo can to NM.
Emily!!! Did you know Spiro (Baldwin defense) is representing Eric Adams???? Mind. Blown. just seeing Spiro casually walking behind Eric Adam’s in an MSNBC clip
It is pretty amazing how everyone keeps deflecting blame instead of owning up to their part in the situation. Baldwin’s lawyer didn’t seem to bring much to the table either; it feels like they got lucky with the judge’s decision. If the judge had decided differently, things could have turned out much worse for Baldwin. It’s frustrating to watch these players shift blame while failing to recognize their own shortcomings.
I saw them in Edmonton for this tour last month, it was an amazing show! Was also my first Metallica show, too. I hope you have as much fun as I did! and less travel 😅
What's the probability that Kari and Seth have played "holster the long Colt". She LEAPs to his defense any time he's mentioned and her voice goes up an octave.
Maybe they answered this question and I just don't understand the timeline, but did the state know that the defense knew about the Teske rounds when she decided not to disclose them? Because the fact that Bowles knew they existed is irrelevant if Kari decided to hide them before she found that out.
Speaking of seeings bands. The BEST band I’ve ever seen live was ABBA at the Sidney Myer Music Bowl in 1977. I was 7 years old and I don’t remember the entire concert, but I do remember MOST of it. It was the FIRST concert I ever went to and it was INCREDIBLE! Seeing them live, those vocals were truly incredible. ☺️
The fuck up with the exhibit is enormous. The fact that he forgot to file a motion to remove Kari is less important considering it is ONLY relevant if he get a new trial. If he get the case dismissed with prejudice, then there is no need for that.
To me, the biggest problem here is that live rounds were permitted on set for SOME reason that only the producers, crew, and actors know. If not for thosebeing on set, they never would have goten into the prop gun. Also, Alec is responsible for not allowing Hannah to be in the church where the gun was at that time bc it was her job to always be in close proximity to the props wherever they were when not locked up.
God I wish we could EDB in a court room during trial and just let EDB be EDB doing all the EDB reactions lol How funny and entertaining would it would be 😂
