Doesn’t apply at all actually. That’s why the cop didn’t even react when he said that. He isn’t within city limits and he isn’t intoxicated. Also if it wasn’t fired into a domicile, road way, or across a body of water no crime is committed. You can unintentionally discharge a firearm all day as long as it is in a safe direction no law states you have to intentionally discharge a firearm only that it isn’t done in a reckless or endangering manner.

not city limit, middle of desert wasn't domestic dispute was a simple normal argument no one hit each other he didn't mean to discharge but it was n' a safe direction he fully admitted no reason to really charge him that is why the officer didn't react but yeah.

It was probably a negligent discharge of the firearm. (Accidental) Which probably taught him a lesson in firearm safety, we can hope. But nothing illegal as far as I can tell as long as nobody was hit except him on the head for being a jackass with his firearm.
