FOR CONTEXT:
On October 21, 2021, the indie western film "Rust" was being produced on location in Santa Fe County, New Mexico. Actor/producer Alec Baldwin was rehearsing a cross-draw of a prop revolver. When he pulled the hammer back and released it, a live round left the revolver and passed through cinematographer Halyna Hutchins before landing in director Joel Souza. Souza was injured, but later recovered. Hutchins, on the other hand, died that day. Criminal charges were filed against Baldwin as well as against assistant director David Hall and armorer Hannah Gutierrez-Reed. Hall took a plea deal, and Gutierrez-Reed was convicted of involuntary manslaughter on March 7, 2024.

It all boils down to whether Baldwin had an affirmative legal duty to check the weapon for live ammunition.

with a live firearm, it's kind of cut and dry. Every person who has ever handled a firearm knows the basic rule, treat every firearm as if it were loaded until you personally confirm otherwise. Doesn't matter if jesus himself handed you one and said it was safe. You make sure yourself, because the consequences are so high. I think it's going to come down to the jury instructions and if they include that sort of thing, like if any reasonable person would check a firearm. Will be interesting to see what kind of, if any, actor expert witnesses they bring to show what's reasonable for an actor.

If basic gun safety that all mere mortals have to follow holds true for rich celebrities then absolutely yes. Safety rules exist for all guns and all people. The circumstances of if you’re in the home if you’re on the range if you’re out in public or on the movie set are irrelevant.

Different rules apply to matters of recklessness and negligence. • It all comes down to whether Baldwin has an affirmative duty by law to safety check the firearm. Conversely, is it legally sufficient for him to rely on the assurances of the armorer and the head of safety, both of whom (according to the opening statement of the defense) safety checked the firearm before handing to him and describing it as "cold" (ie, safe).

@@danstewart2770 from the initial report my basic understanding has not changed. Everyone in the chain of gun handling is responsible for the manslaughter. The armorer and the DA have been correctly held responsible, now it is the actor who pulled the trigger’s turn.

@@rashick11 just watched the recap, the part that talked about how to tell the dummy rounds from live ammo, and I think I see it better now. He could easily have checked, they are clearly distinct. It would have taken him 5 minutes to check the rounds (beyond just don’t point at people).

30mins into this video - I already like the Prosecutor doing the opening statement. She's so clear, states it so simply in easily understandable terms. She is setting the stage for the case well, giving a good narrative with facts without getting too caught up in minute details. She's obviously already preempting for certain things like explaining now that the prop guns are real guns. I love her framework about how a movie set shooting a fictional story is a real workplace and she uses this basis to frame every context and action from the get go.... Good stuff.

feels like this could have been avoided with the use of Replica Immitation Firearms, you get to keep the weight and looks of a real weapon while the most damage you can do is potentially take someone's eye out with a bb pellet

Anyone familiar with guns knows that a single action weapon with the hammer pulled back has effectively a hair trigger. It's conceivable, Baldwin didn't even realize he pulled the trigger when he actually did. • Everyday at shooting ranges, people misfire their weapons by inadvertently pulling the trigger when they didn't realize that they were pulling the trigger at all. • If a person who's unfamiliar with guns were to pull the trigger of a revolver in the single action cocked position, they would undoubtedly be surprised by how light the trigger pull is. Custom guns typically have even lighter trigger pulls.

Mr. Baldwin has a very long history of handling guns. His father was a gun safety instructor, it goes back to his youth and all throughout his career.

The two ideas that keep coming up in my thoughts during the defense opening statement are: 1) Swiss cheese model. 2) Normalization of deviance.

The juxtaposition of both openings is fascinating. Really showcases a difference of style. Kinda fitting that the lawyer representing Alec is more poetic and expressive in his choice of words and articulation. The Prosecutor was clean, clear, straight to the point, more utilitarian in her presentation which I liked. But I gotta say, the defence's style is also good. A bit long but very human, articulate, connecting, almost beautiful. He is clear in his own way, I got so many of the defence's points from that opening. He makes some very good points. Unlike the Karen Reed trial that just concluded, I'm looking forward to watching this trial in full. (Will also watch Alyte's recaps of course)

I watched the entire Hannah Reed's case so I know a lot of the facts coming into this case. After the prosecutor's fantastic opening, I didn't expect the defence to be this persuasive. Putting aside his more flowery and human style of speaking, he made some very good points as to the differences between stuff an actor does while playing a character and how that's different than real life. He got in front of a lot of bad footage, got in front of the general safety concerns on that set, put into context some of the upcoming witnesses and evidences that could be used against Alec. Idk whether putting his points out like this is gonna be like showing the prosecution their hand as to the angle they are gonna take but I like the defence's style of putting it all out there and not holding stuff back for a twist or reveal later. Alec may have been an active hands-on producer for this movie. He may have had a lot of power as the star actor and producer. However, it is undisputed that he shot the gun in his role as an actor playing the character he was hired to play. He didn't shoot the gun as he was doing producer stuff. So this makes sense to me. In one opening, he overcome some of the thoughts I had about this case already. Strong start from both sides. This feels like it's gonna be a delight to watch.

Before the openings, I was thinking there's a higher chance Alec's guilty because he's the one who pulled the trigger. After listening to the openings however, while I agree with everything the prosecution said, I now realise that the setting and circumstances that Alec as an actor could usually have pulled the trigger and no one should have been hurt, that Alec like every actor relied on the safety framework to be in place, that Alec had no reason to believe live ammo was loaded into the prop gun he was handed, I think Im now leaning the other way, now leaning to not guilty.

1:47:20 The bucket of confetti analogy is pretty good. It is even more accurate if the actor was told the bucket was full of confetti, he pulls it and it turns out it's full of hot oil and someone died because of the hot oil. Is it the actor's fault or the fault of the person who put the hot oil there and told him it was safe to pull the bucket? Alyte's analogy with a dangerous animal is ok in terms of the idea that a gun is more inherently dangerous than a bucket but introduces the variable of an animal having a mind of it's own so I think the animal analogy is not so accurate. An unloaded gun, even a real gun, would generally be harmless without anything to discharge in it. We'll see what the experts say about blanks and dummy rounds again but from the HGR case, blanks are flashy with no propellant and dummies look like real bullets but don't even have gunpowder in them. So, we'll see.

To answer Alyte, I like this defence attorney's style much more than Jackson's from the Karen Reed trial. That one shot about the prosecution not asking a specific question is something I'm on the fence about but other than that, I get him and his style. He's expressive in an everyday manner, less legal and straight cut. He might be a bit spicy in content but his form is good for me. As for Carrie, I think in general she's a damn good attorney. This witness is a hard one to deal with. He's kinda withdrawn, not charismatic, a bit hard to draw out, especially on direct when she's not allowed to ask him leading questions. I think both lawyers are doing a good job so far.

Food for thought regarding your live animal, the actual equivalent would what if the actor was told the animal was stuffed, when it was actually not ? Is he responsible? During the previous trial I got the idea that he was definitely guilty, but now looking at the facts presented I am not so sure anymore.

It's kinda weird because what Alyte is perceiving as aggressive, idk I don't see it yet. Did the defence ask a longer statement as a question? Yes. Should he have given the context to the witness by at least telling him where he said that cuz he obviously doesn't remember exactly? Yes. But I don't see the aggression. Idk, difference in life experience or exposure leads us to perceive things differently I suppose.

Maybe the live bullet is not what should be considered, but if I were a juror, I wouldn’t be able to get past that. The realist in me believes it was an oversight by the expert/s on set, and the conspiracist in me thinks, hmmm maybe it was a setup. Either way, it is a shiny object and I can’t take my eyes off it

Even if it is a set up, he still pointed the gun at a person and his actions resulted in someone’s death. You treat every gun as if it has live ammunition in it no matter what

All I can think of when I look at him is boss baby in his little suit lol. Btw- my opinion is that he shouldn’t have ever been charged (and Hannah + the other assistant guy should have gotten way WAY more time). Alec was told the gun was cold. Period. Live ammunition is not allowed on movie sets- period! He was under the assumption that people were doing their damn jobs and not snorting cocaine throughout the day, and fucking off because they’re a nepo baby. He shouldn’t have had to check, in essence when someone called out cold gun that’s the same as telling him that TWO OTHER PEOPLE HAD CHECKED IT. Not his job, not his fault. If you want to compare it to something, that’s like telling an actor that the wild, potentially lethal tiger they are acting with is actually a taxidermy tiger and is completely harmless in the state it’s in. This trial is ridiculous.

If she is called testify, and she's actually in prison, she'll appear in her prison attire. Only a defendant , held in jail pending trial, can appear in street clothes due to potential prejudice.

Why were there live rounds on set? Who brought it in?? How do you mix inert rounds with a live one??! Why, in todays ability to add sounds etc to a movie are they using real weapons? So many questions
