After reversing course and re-opening the hearing on the defense's fourth and fifth motions to compel evidence including the FBI's final CAST report on the cell site location analysis performed on Bryan Kohberger's phone, Judge Judge has scheduled a hearing to take the testimony of a defense witness. The witness is anticipated to be Sy Ray, the defense expert on cell site location analysis. Although Judge Judge has not ruled out closing part of the hearing to the public depending on the information that needs to be elicited, we can expect to learn more about the status of the digital forensic investigation and what, exactly, the FBI does not want to turn over to the defense in this case.

Thanks for this coverage. Honestly the more I learn about this case the more I am concerned that an innocent man has spent years in prison on extremely flimsy evidence. Can't wait for next week to hopefully find out more about what is going on.

My niece lived four hundred yards from this massacre. She toughed it out, finished classes, and gave notice to her good job. We were so happy when she moved back home. I haven’t had the chance to talk to her about it. It is just so sickening. I’m praying for Justice.

I believe 'the point' of the hearing's focus was to prove that yes, the prosecution has been withholding evidence, and the only way she could get her discovery was to call someone into court. Where 'miraculously', the day before the hearing, the requested discovery appears.

Imagine how long he’s been allowed to make decisions about people’s lives, local events, who gets fundings and how much (he sits on a board of an agency that decides/signs funding for the public defenders office)….this bunch has been left to their own devices to such an extent that they forget what the real law is about and how it’s supposed to be applied. The size of this town and the neighbouring counties is very important and the fact that the university is the main employer in the region. Idaho and WSU are Land Grant twin towns and universities……how much money is wasted…. I’m starting to think that they are all in some kind of cahoots with each other…..

This is by far one the biggest cases that I can remember.. it’s crazy to think that LE wasn’t crossing their Ts and dotting their I’s .. this is a death penalty case and AT can’t get evidence they used to arrest BK.. that blows my mind . Let’s be honest, there’s reasonable doubt all through this case even without BK as the suspect

A couple of things…if the settings were not saved then a defense expert can’t look at it and say that what he did was not correct. Secondly, after all the publicity and hype {like the KR case} the prosecution has a lot on the line. They don’t want to get to the point of having to dismiss. That guy looked very uncomfortable as he was testifying.

@@willbeard4835she has the raw data!! There was no work to show. All Mowery did was upload the raw data into the CASTViz software that autogenerates the visual maps. That’s what you people aren’t getting. She is making it seem like he did some kind of data analysis or calculations then deleted it. He uploaded the raw data into the program. After the program autogenerated the maps he simply removed the file from the software when he was done using it. It’s very much like putting a CD-rom or floppy disk into a hard drive, viewing the files, then ejecting the disk from the drive when you are finished. She is trying to make it out to be some conspiracy. All I have to say about this is that if THIS is the data or expert testimony Anne Taylor wasted her time on calling for this hearing-she’s FOS! The session logs do nothing to prove or disprove Bryan’s alibi. The session logs are click trackers for the user of the software. The raw data remains completely unchanged. That’s also probably a huge part of the reason why he was having a difficult time understanding her when she kept asking him “what he relied on” to show the CAST maps to the grand jury. It’s a stupid question because the raw data is uploaded directly into the system and the software plots all the data sets that were obtained directly from AT&T. He relied on nothing more than the raw data that remains unchanged after uploading it into CASTViz. Once the data is removed from the software nothing happens to the data. It stays on the original drive it was saved on when it was downloaded from the AT&T LERS portal. She could upload the same exact data into CASTViz and the software would produce the exact same data extraction and plot that data to generate the same maps and visual aides. And as for her questioning whether she would need the same version of the software to reproduce or recreate the same thing he did, no, she would not, but if she REALLY wanted to, every single version of CASTViz is available for download so she could do it if she really wanted to. She has the same exact raw data from AT&T. If she uploaded it into CASTViz and got a different result, then all she would need to do is show how her maps are different-but WHY actually PROVE something you know you won’t be able to when you can instead try to raise reasonable doubt by talking in circles using manipulative and suggestive questions while interviewing the detective who was NOT even in charge of the CAST analysis, instead of subpoenaing the lead detective or FBI Agent that was?! 🙄

And yet, once again, Anne Taylor proves she’s FOS because the CASTViz session logs aren’t exculpatory to Bryan Kohberger nor do they do a single thing to prove or disprove his alibi. The session logs are essentially click trackers for the user of the software.

Two trials I had zero interest in were Karen Read and Bryan Kohberger. I figured both were guilty as hell, who cares. Now? Read's trial is clearly pointless. Kohberger, it's still too early but everything the prosecution has brought to the table at this point is weak AF.

@@brandonman1315She very definitely is innocent as is proved by the intact tail light at John’s house after Karen hit John’s car when leaving to search for John. John at this point was already on the lawn . The photo from the police holding shed has a giant piece missing . Pieces of tail light in the snow cannot be from Karen’s car . I am not sure about BK but at the moment I think that he is innocent .

Thank you for going over this latest court hearing I didn't think would be open, or covered in detail. But it was, and much appreciated! What a totally different presentation of a courtroom scene we haven't had before in this case. Some of the technical stuff was confusing, but other than the witnesses'abashed/uncomfortable testimony, in the awkward position of having to admit he lost crucial material making it impossible for AT/BCK or anyone else to figure out how he arrived at his conclusions, it seems even more strange to note that WT seems to have actually just shrunk! Could he get any more less intrusive, hunkered down and barely speaking a word the entire time? What a turn about! If he set out framing BCK, based on what BCK said in that "lost" interview when he was brought back to Moscow, giving his more detailed alibi, and exactly where he remembered he had been that early a.m., it could have provided a different sort of 'road map" for that prosecutor with the means to finding and conveniently "losing" the exonerating proof, then well, fixing up a different scenario making BCK look guilty. (And a good reason to not want 'false" facts to be revealed in any survey, and that whole business shut down.) The videos, the cellphone pings, and even taking a pc.of evidence from the crime scene and doctoring it to fit their case doesn't seem so farfetched. If the FBI figured out they were used that way, I could envision a WT/Frey/MPD shrinking even further. I hope if BCK isn't guilty AT will find the evidence to prove that, and actually bury him and what is beginning to appear as an entirely contrived case against BCK. (WT may have been under enormous pressure to do it coming from who knows where, but would be so reprehensible the FBI would just have to stand back, and out.) One could almost understand it to be actually possible watching his head down/silence today, as if he is beginning to realize at least AT/her team and her future witnesses are getting close to figuring something out, and that his first team member to be interviewed in making disturbing revelations in his very poor showing for himself, doesn't reflect well on him. Is it me or are they over their heads or just inept? Or both and already looking for a way to extract themselves from the fiasco they may have been forced to create? I think AT's attitude and courtroom demeanor and simple delivery/polite questioning has become something to watch. It's: Inquiring Minds just would like to know what the witness did, and how to understand that! Right, the guy hid his methods and deleted the data! But zero emotions, zero judgemental comments and zero, WTF??? A skill WT needs to learn I would have to surmise. (Would an application for a job, w/an envelope be a source of touch DNA - both the PPD and MPD have his applications I believe?) Thanks again for all your efforts and a great rehashing and legal commentary. Looking forward to what happens next week. Happy Memorial Day festivities!

He was not qualified to give testimony to the Grand Jury which the DA knew . They committed perjury and fraud on the Grand Jury .

I’m still stuck on the failure of LE not identifying/investigating the other unidentified DNA 🧬 profiles found (potentially greater DNA deposits than the touch DNA they are relying on with BK). In my opinion, that’s a strong source for reasonable doubt.

What has always niggled at me is that the students at the house when first responders were called have never been considered suspects. The first press conference they were shielded and the scene described as chaotic but no real verbiage that suggested the police were suspicious of them. This makes me wonder if the girls there (DM, BF and any other girls) were even asked for their DnA 🧬. I wonder further to that if the sheath was tested for how much of Maddie or Kaylee’s DNA was on it (my assumption that the knife that killed then could have been their own IF of course it wasn’t planted).

They are described as unknown “male” DNA 🧬 which means they were tested but I assume didn’t match any DNA in CODIS & obviously aren’t a match for the alleged and disputed sheath DNA. Which brings me back to the question… Did LE treat all at the scene that morning as potential perpetrators or accomplices? Did they get the DNA of those males that were last with Maddie and Kaylee? Did they get DNA from the door dash driver (if male)? What about confirming the whereabouts of Dylan’s and Maddie’s boyfriends? Any of those people should be happy to offer up their DNA as I would if I were there at the bloody scene?

Maybe we can ask the officer whose body cam started recording a minute after KG's last call to JD's phone at 02:52 AM.

This was an investigation into a quadruple homicide. The investigation should have been conducted with painstaking attention to detail and cross checking, evidencing every step of the way to Kohberger and every step to arrest and every step after arrest to date and to trial. Does due process of law legislation not include a subsection about the transparent sharing of the investigative process? Shouldn’t the state be meeting the highest standards and ethics of conduct? They are prosecuting a person that is pleading not guilty. Just trust us, we are LE doesn’t cut it For contrast, look at the work done by the team involved in Madeline Soto’s case. If I were a criminal I wouldn’t drive right up to the scene of a planned homicide in my car. I would leave my cell phone at home on auto play RU-vid. Further to that I would abort mission if I turned up and saw an unfamiliar car out the front. Oh AND I would be surveilling a party house for hours prior from a discrete location to ensure no extra guests were at the residence I planned to risk my freedom to enter and kill in

It’s called “tunnel vision” or the “us vs them” mentality. Early on in every criminal investigation, when the first suspect comes into view, LE becomes laser focused, sometimes to the exclusion of everything else. The us vs them refers to the phenomenon that if you are not in LE, than you are a potential suspect. Long time LE looks at everyone not in their immediate circle through that lens. Even if LE realizes they are wrong, farther down the line, there is no need to close the barn doors after the horses have run off…

👍 Thanks for putting it straight. I'm guessing WT/etal(UID-MPD-State cops, FBI?) didn't realize at 1st how they would have to spin this because they were hoping to find more evidence against him. They couldn't so they let innuendo and false "true" facts leak out, and encourage the worst sort of character assassination possible, from his looks, past, personality quirks, to his area of professional interests, in and on. However, if they knew from the very beginning, at that crime scene, it was UID students and did everything after discovering that, to find a substitute perp because UID/Board of Overseers, alumni and potential investors in acquiring U of Phoenix (and getting their hands on that $200million cash on the books asap), and knowing the terrible p.r.and the discovery of the drug situation in that university town, the entire area, and it was actually"unaliving" students from UID, it all could very likely fall apart. An incredibly lucrative deal for the UID state-wide as well as Moscow, and esp for those required initial investors assuming a huge payoff down a very short road once acquired and underway w/UID the owner. The state legislature didn't like that deal, but it passed I believe; they definitely should take another look now. Framing someone for this crime and that directly leading to the people in charge of that school, heads should roll, and no more massive investments funded by unaware/uninformed $donors until people are removed, and the drug scene cleared out! You just know that's not gonna happen, but it should (even if all of the above as a guess turns out to be inaccurate).

OMG! Is this guy for real?? Does he ever do his job? This is probably one of his most important cases of his life and am I correctly understanding that cell data was sent to him over the past 18 months and not only did he fail to open them but can’t remember if he opened a file less than 24 hours prior? I can’t imagine he’ll still have a job by the end of the month. But more troubling, are his bosses telling him not to work on these files? Because otherwise, the incompetence shown here is truly stunning.

Andrea, Per the white car: Notice how the state is trying to keep the videos sealed and also not provide them. This guy had a facelift model year of that generation of Elantra. 2 version look distantly different during the day and at night. Remember how the search was specifically 11-13 model? Then they suddenly expanded it to include 14-16 model years? There is a good chance KB was suddenly a suspect when the car years changed to cover themselves.

Thanks for your insights, Andrea! I'm hoping for a new venue and a new judge. The judge in a quad homicide case shouldn't be asking attorneys if he should sign an order or not, followed by joking, "I don't want to get in trouble." It doesn't bode well for either side when a judge seems not up to speed and too concerned about being nice. Also, I predict that if this case actually gets to trial, Taylor may have to remind witnesses that thsy are under oath. All of the 'I don't know, I don't recall, but someone might cars' type responses are not a good look. I feel like Taylor wants to get to the truth, but apparently could be up against the possibility of intentional delays, obfuscation, incompetence, and possibly a flawed investigation. Blaming the FBI for inadequacies will only carry the prosecution so far, in my opinion. The case needs traction and progress. Perhaps a new venue with a new judge could help move things along.

What you mentioned about the trace DNA is just the start of the issues with that evidence. How low was the cell count of trace? Could they get a full profile to even compare it to the defendant or anyone else for that matter? If the H Blum comments about it being 12 cells or less then this is not enough to get anything more than a couple markers that might help you eliminate some suspects at best. Anything less than 80 cells is considered an unreliable sample size. So when they cheek swabbed the defendant what did they even have to compare it too? An unreliable sample with massive chain of custody issues. 23 and me online IGG they can't even show their work on? This is reasonable doubt low hanging fruit. Not smoking gun evidence

Then you get into Othram Labs talking about proprietary methods. They might as well say not repeatable crime lab science by anyone that isn't us and if the sample size was as low as 12 cells.. probably not enough sample left for even them to even repeat it.

Further analysis of the phone data may show that the same pattern of Kohberger's movements on November 13 is repeated on other occasions. If the photos show that on those other occasions, Kohberger was at Wawawai Park, why would it be any different this time? I think that's why the defense needs the full CAST report.

I am not certain that this 'professional police detective' knows how to make the software work. It is not difficult to read the dates printed on email. I agree, Andrea. The police and DA's office failed to make any attempt to solve the crime. Instead, they hoped (like wishing for ice cream), that cellphone data and DNA would supbstitue for their doing their jobs, earning their paychecks. As a result, we watch as incomplete and horribly unreliable DNA testing and cellphone fishing have produced nothing to impress any of us. The six Elantras ( of different years), a Chevrolet, a BMW, a Toyota, a Chrysler, five unidentified cars, a Jeep and Two pickup trucks have all magically transformed into Kohberger's car.

I've seen cases where investigators ask all men in an area to voluntarily submit to a cheek swab or blood draw, and even though voluntary, the ones who refuse go to the top of their suspect list. That seems like a wide net is being cast, bringing many uninvolved men under suspicion and under pressure to give up personal data. Has that ever been questioned for being unconstitutional? If so, has that been used to let a suspect go free, stopping the investigation into the suspect? I've seen videos where someone is handcuffed and held just for being in the area of a crime, but then let go. It sounds like police are looking at people without prior knowledge that the person could be a suspect. Is that unconstitutional? If so, have suspects been dropped because that was being done to random people in the area?

I've always believed that people who mumble (as a primary way of speaking) are liars -- an instinctual attempt to hide the truth, not say things, withhold information. When a judge has to tell a police detective to "speak up", that to me is very, very bad -- for the detective. If the detective was confident he had followed proper procedure (even if it turns out he was mistaken), he would speak up loud and clear. I know its not evidence, but it is an indication of either perjury or a tendency to such.

If Kohberger is innocent, there’s a few significant coincidences in this case, if we assume the dna is his. He was driving around, not just in Moscow, but presumably on campus in a timeframe consistent with the murders, and his dna is on a knife sheath in the house. Is it possible the knife sheath is a red herring, and belonged to someone in the house? I haven’t heard if there’s no other dna on it. If any victim’s dna is on it, is it possible it’s their sheath? Kohberger could have incidental contact with something like that if he’d been shopping around the same time it was purchased, or there could be a secondary transfer. Another possibility for how his dna got on the sheath (again, presuming he’s innocent) is that he had contact with the murderer prior to the killing. What if it’s not Kohberger, but another student from Washington State who committed this? Someone who didn’t take a cell phone with them because they know better? Kohberger could have incidental contact with a fellow student, especially if they had classes with him. There’s still a possibility more cell phone data will come out that’s much more damning for Kohberger than what we’ve seen, though.

Love your commentary Andrea.. You often tell it in a way that we can actually understand!!! Well if you learn one thing from smaller or bigger town crime documentaries it is that local police often doesn't have the expertise/training needed... But I sometimes wonder if local law enforcement should ever be involved in investigating these small town crimes... Wonder how many people get off free who have committed horrible crimes. I so hoped that the families of these students will have as speedy as a trial they could get and they put away the murderer... Must be so agonizing...

I order door dash quite a bit. Sometimes the person who delivers the food does not match picture on app. Would that not be the perfect cover ?

As a dasher….please report ANYONE who does not match their name/gender/photo on any of these apps. It is fraud and there are so many of us who can barely work bc so many people are finessing the system. If someone isn’t using their own name and info it means they wouldn’t/couldn’t pass a background check ❤️

​@Interestingname I'm in New Zealand and we don't have door dash but Uber eats and deliver easy, over here when we order our food sometimes it can take 40 minutes or more for it to be delivered , is that the same over where ypu are. I'm asking because just because Xana had food delivered at that time doesn't give a time range of when she actually ordered it. I wonder when they say " received" in the pca that she actually took the food or it was left at rhe door ?

@@johannawigg6921 yes. It’s the same. It depends on how many drivers and how far the distance is. As well as if it’s a “stacked order” which means multiple pickups/drop offs. She ordered very late in the night/early morning so I doubt many people are delivering at that time. I also believe it’s been said there’s only a few restaurants open that late as well. Lord only knows what they mean by both “4am” as well as “received”. We’ve seen they give estimates before. Doordash has “hand it to me” or “leave it at my door”. You can also add instructions with both 90 percent of time for what door and to knock or ring bell or drop the food and leave etc 😂 These apps track the drivers(phone)every move.To the point that I can be at the correct house but maybe had to park a bit away from where it thinks I should be and it will basically act like I’m not at the right house.

@@johannawigg6921 It was taken inside by someone because the early photos of the house showed that bag sitting on the kitchen counter. Not that we know whether Xana actually took delivery herself and placed it there. So many questions we must wait for answers to.
