Bryan Kohberger Not Guilty? Defense Drops Key New Information in Court Document - Attorney analysis

In the midst of the disagreement over whether the State has to turn over genetic genealogy evidence it used to target Bryan Kohberger as a suspect, the defense revealed the first official new information we've received about the case since the gag order was issued and the search warrants from Pennsylvania and Washington were released ... and it's a stunner. In a publicly filed document, the defense states, "There is no connection between Mr. Kohberger and the victims. There is no explanation for the total lack of DNA evidence from the victims in Mr. Kohberger's apartment, office, home, or vehicle."
This revelation paints an incredibly different picture of the State's case against Bryan Kohberger than the news coverage of it would have us believe. When he was first arrested, many of us commented on the scantness of the evidence in the probable cause affidavit, but we all expected that the search warrants issued for his car, as well as his cell phone and computers, would rule him either in or out. This brief statement from the defense tells us that those searches did not produce corroborating evidence for the State. Thus, the State's case apparently no stronger than it was the day Bryan Kohberger was arrested, despite the fact that if these killings occurred the way the State claims, we would very much expect evidence of it to be in those places.

I hardly doubt those two girls posses thw experience ,knowledge, or resources to clean up a bloody crime scene so well that it was overlooked by numerous crime scene investigators and homicide detectives.

Bryan Kohberger (BK) thought he was so smart that he could fool everybody. BK hated all the attractive, popular girls that rejected him and focused upon one. BK imagined himself committing the ‘perfect crime’ and then taking great pleasure and delight in the aftermath as he analyzed it with his criminology expertise. BK focused on a victim somehow, surveyed the house and at one or more of the many open parties hosted there and meticulously planned his crime. He intended to slip in, kill one, slip out, drive away unobserved, dispose of evidence, clean his car, and go home. BK did not account for the plethora of video surveillance in the modern world. The food delivery at 4AM was a hitch in his plans. The lights in the house caused him to drive around the area, making his vehicle very noticeable. Finding two girls together was a slight hitch. Encountering the other two victims was another hitch. Imagine how empowered he must have felt after his improvisation. Imagine his ecstasy as he drove from the murder scene and ditched clothes and knife. Imagine his discomfort turning to panic as he realized he did not have the knife sheath. Imagine his discomfort as he thoroughly and meticulously cleaned his white Elantra. Imagine his discomfort during the two traffic stops on his drive back to Pennsylvania. Imagine his discomfort while watching, reading, and hearing talk about his crime. Kohberger’s sister feared that her brother was involved in the Idaho murders before his arrest. She grew increasingly suspicious of his behavior when the family gathered for the holidays. Kohberger constantly wore latex gloves. Her suspicions were so great that she spoke to other family members, and several searched his white Elantra for possible evidence of the crime. Imagine his discomfort during the arrest, when they took his mug shot, fingerprinted him, swabbed for DNA, his first night in the slammer, his first jail meal, 16 months…. Imagine how many times he has awakened in his solitary, dark cell from the recurring nightmare: HOW DID I LEAVE THE KNIFE SHEATH AT THE MURDER SCENE?

Particularly after all the reports that the locals could have passed this off to the ISP, but they chose to keep it themselves, and their amazing investigative prowess is what cracked the case - they were so much smarter than all their critics. 🙄

I share ur concerns. Emotions r running high in this high profile case and i fear its really possible an innocent man will be the only held accountable and found guilty. However Anne Taylor seems on top of this and she has something 5:01 to gain here. If she gets him off, she will be catapulted into the upper echelon of defense attorneys in the usa

From my understanding the other male DNA was in the house generally, not on the sheath. "By December l7, 2022, lab analysts were aware of two additional males’ DNA within the house where the deceased were located, and another unknown male DNA on glove found outside the residence on November 20, 2022." The glove is possibly the one found by the ex LE RU-vidr, and if so it was all the way out the front, by the bins, just inside the police tape. He didn't touch it but pointed it out to LE, but the location means that it likely was completely unrelated. If this is the glove, and LE explain the circumstances...I wouldn't think it's relevant. Especially if it turned up after a sweep of the area.

@@sara_387 If it’s just unknown dna from about the house, I wouldn’t be worried about it either. A house with that many young college kids would probably have a ton of mixed DNA from all kinds of people there for unrelated reasons.

I’d want to know too. That many people in that short time frame, was there more than one person? Did they look into the regular people to visit the house enough to clear them fully to be able to prove there is no reasonable doubt

The question I have is how will this information ultimately impact the jury if there's no DNA tying him directly to the murder. My Mom served on a jury years ago over a he said/she said rape case. The jury was 50/50 male/female and initially half of them thought he wasn't guilty. My Mom's own sense was that this was a baseless accusation and there wasn't any evidence of the alleged rape. The self-appointed head juror attempted to convince everyone that the defendant was guilty, and kept revoting until it finally came down to my Mom and one other lady that didn't think the defendnat was guilty. Eventually the other juror gave in and voted to convict. She told my Mom I voted yes because I knew you wouldn't. That guy has no idea that he owes his freedom to one woman who thought he was innocent and refused to cave to pressure to say otherwise. It scares me to think that's the state of the justice system.

Read the case about Touch Dna and how unreliable it is. Lukis anderson San jose California. Touch dna was transfered by medic that attended to Lukis, and then Medic went to a new crime scene and transfered Lukis Touch dna.

@@jimskeuh Yes you do. Only half the jury thought he was guilty, but under pressure from the head juror, he got everyone else except my Mom to vote that he was guilty. If she had given in like the other nearly 50% of the jury, that man would have gone to jail even though they didn't really think the defendnat was guilty. There was no evidence presented against him.

I remember seeing on the news the DAY he was arrested (conveniently right before the new year), that they were rushing to clear the house and destroy the crime scene. I told my boyfriend, "Oh my god. He's not the one who did it. His lawyers need to stop the cleanup ASAP, they're trying to get rid of anything that could possibly exonerate him." From the start, every aspect of this case sets off all my suspicion instincts.

I agree, this is beyond terrifying. I'm learning that regardless of if you are guilty or not, if LE wants you to be guilty they will manipulate public perception and alter evidence and reports to justify whatever dumb ass idea they decide is the truth and make you into a monster if needed. I've heard all kinds of things about him with ZERO evidence. Oh he was a drug addict, he's an incel, this was just an experiment for him. He's a creep. He video tapes women and stalks them. No evidence of anything other than he is an intelligent, dedicated to his studies and being a good instructor. He doesn't seem to have any hatred towards females or any issues getting laid. He seems pretty normal, if not a bit above average and doesn't come close to fitting the profile of someone capable of doing something like this. He's also hardcore vegan. Can't eat a burger but zero issues shredding a live person brutally? 4 people? I don't see it at all. The roommates raise a million red flags. Him? None to me.

@@aliciapeck7869 I know the actual demolition was a year later, but they attempted to start the process almost immediately after BK's arrest. I remember seeing the split screen of BK's mugshot and live footage of the clearing out of the house by police, etc. If I remember correctly, they only stopped and delayed after they were ordered to because the defense rushed to request an order from the court.

One thing that has always bothered me is that he supposedly spent months conducting surveillance on the house, which would suggest a lot of caution and planning. But on the night of the murders, all six of the residents/victims are in the house by 2 AM, and he doesn’t even leave his apartment until nearly an hour later. He got there too late to see anyone arrive - for all he knew, half of the Sigma Chi house could’ve been hanging out there.

This thought process for me implies there were cameras located inside the residence. Just who had remote access to these becomes relevant. Perhaps this is considered "adjacent evidence" and, as yet, not disclosed.

Multiple people were involved or he was set up. The roommates not calling the cops for like 8 hours is weird to me as well. If there really is nothing else but the sheath and touch DNA on it then idk.

Initially, the experts I listened to were certain it would be impossible for no trace dna from the victims would be found in his car or apartment. They went on at length about this being a certainty. So, the absence is fairly compelling.

Im not convinced, at all, that BK is guilty. I have ao many questions about no tracking of blood, all the college kids at the house long before LE was called, no real evidence, etc. Lots of questions.

there is a lot of evicende that he was around the house in the period of the murders. he even turned his phone off. He is connected, but he's probably more of a puppet in an organisation who carried out the murders; we're not sure yet what his role was, but i dont think he did the act of killing. I think that was someone else. (who also planted the sheath)

Ditto. We have only heard and seen the evidence from one side, we still need to see and hear from the other side. Everyone is groupthinking based on the narrative that the media has made and already have him as guilty. People gang up on anyone else that have ask questions, like, why did it take too long for the someone else to call the police? Why did law enforcement started cleaning the murder site as soon as they caught BK? Why did many students know that someone had died from an overdose in that house before law enforcement did? That is very odd? The timeline doesnt add up either. I want to hear from both sides before passing judgement. If this might lead to the death penalty, then we need to hear both sides, personal opinions aside.

I'm someone who sat in jail for 2 1/2 yrs hoping to see a judge as I didn't have $$$ or notoriety to attract a good lawyer & actual help & my family couldn't make my bond (so if you ever read the law about the bond HAS TO BE AFFORDABLE TO THE PARTY ARRESED, ask yourself how they arrive at that amt.) as I certainly was unable to find anyone who could aid to post bond for me & I was absolutely treated as guilty until proven innocent. Not fun. But ANY inmate puts $ in the state's coffers so they say they're operating under the law & without decent protection via a good defense attorney who gives a crap, you'll sit in jail & likely, ultimately, get screwed into a plea if not an actual hearing no one is there to fight. The name of the game in my case was to avoid that initial preliminary hearing which they most likely would not have gotten thru, but if you're willing to wait a bit, you can take your case to the grand jury and bypass that hearing earring. And the grand jury is appointed by the state so who do you think they side with? Have you ever heard it said that the grand jury will indict a bologna sandwich if asked to do so? I know public defenders who could've beaten their case with 1/2 their brains tied behind their backs! That's just 1 off the many ways people wind up in prison for crimes they didn't commit & I've heard little to indicate this guy's guilty of anything, let alone the heinous murders of 4 people. When he was arrested I think we all sat back and thought, "okay well they're going to show us what they had to file for an arrest warrant without uncovering all their evidence", but at this point that's the reason for the motion to compel. They have NO EVIDENCE they've shown to date, so if you know something they don't, you should really call them and tell them or better yet make the trip and show them. If you're making an assumption then what you're saying is wrong because that's not the way our judicial system is supposed to work and it often sadly does so please don't add to it! One woman came into the jail and wanted to know who I was and another woman asked why. She said because she knew I was guilty of the crimes I had been charged with so the other person asked her how, and she said because it was on the front page of the local newspaper! Well, I mean by all means!!! If it was in the news then we all must be guilty of exactly what the press says, which most of us are still berating MSM for doing just that with regard to JD & AH, but yet here we're going to take the press's word for the fact this guy is guilty? Or better yet yours? This is but one reason for the voire dire of a jury... to weed out those who've already made up their minds based on what they saw or read in the news. And that is getting harder and harder to do considering the saturation of media in and around cases like this. They convict with nothing, as do you, evidently. 🤷‍♀️

Attorney, the other very interesting point made by the Defense in their recent proclamation, is that the knife sheath was "placed" partially under Maddie's body and comforter. "PLACED" is a very important word here. The implications are enormous! Yes??

I agree. I've read so many cases, and watched so many crime shows, and read many crime books. This case sticks out as one of the most botched cases I've ever ran into. But the media will sell it to the public, and somehow, BK will go down. I'm not saying he's innocent, I'm just saying this case stinks. He should be exonerated.

@@aburkhartlaw And I should add, that the police may well be absolutely convinced 'they have their man', because we humans decide things based on how we 'feel' not how we think. The emotional desire or even 'need' to get a result can lead police to see evidence that simply isn't there or apply weight to the available evidence that is not justified. There is a great book by Carol Tavris on 'cognitive dissonance' that goes into how we all allow our emotional desires to decide things for us - we are not rational creatures. ... And one of the reasons people often do not like lawyers (sorry Andrea) is that they are required to force the jury to look past the emotional desires for justice and the disgust at whatever crime, to the the 'cold, hard facts' - and we humans really do not like that!

Zachariah Anderson is another case where there was no DNA and fitted evidence has seen that young man found guilty of murder, with no evidence….and the person he’s supposed to have murdered is missing, not even declared dead! There needs to be better work done to connect suspects with the victims otherwise there is still a murderer out there doing what?

Google the case of Lukis Anderson of San jose California, put in jail bc of touch dna.. but it was the Medic that attended to him while he went to a hospital that transfered Lukis's Touch dna to a crime scene that medic went to after.

I would have wholeheartedly agreed based on the PCA. Maybe they do have the right guy but bushy eyebrows isn’t convincing if that’s all they have. I imagine we don’t know a lot of the states’ case, so I remain open minded but there are questions on the Elantra, the sheath and now DNA. If he does have a provable alibi, it’s over.

​@@joann5075 Time for the "get the rope" crowd to step out of their echo chambers and listen to actual lawyers, rather then retired detectives who will always side with the State and LE. The whole "everyone lies but LE" narrative being propagated by ex law enforcement, who swore to uphold and defend the Constitutional Rights of the citizenry, is going to be put to bed with this case for sure imo. 👍 I'm interested in hearing the States response as to why the other 3 unknown male profiles found at the scene near victims were never tested in the same methods and manner as the touch dna on the sheath. Where's the IGG trees for the 3 unknowns? 🤷‍♀️

Was arrested in Idaho last year for "resisting/obstructing" for asking to talk to an officer's supervisor after being told that as an Uber/Lyft with passengers in my car picking them up that I was "blocking the road." Done it thousands of times in that location without any issue over the last few years. Asked for his name and badge number. Got pulled out of my car without any warning. It took the state 9 months, which was almost 3 months after the charges were dismissed in court. The prosecutor knew they had no case and it was total bs, but pushed it out and also refused to give my attorney discovery documents for the whole 7 months while my lawyers had to ask for more time to get enough documents to be able to provide a defense. 2 prosecutors left and took new jobs in that time. The 3rd had no idea what was going on. Court hearings I had to show up for every 3-4 weeks with no change and no progress, and I had to keep paying my attorney to show up for me in case they gave something. Police chief asked for 7 more police training personnel a month ago to train officers on professionalism. They hate accountability. Office of police accountability took a look at it and said their was a police policy handbook code that was not followed on professionalism. I now have a gut feeling that a police officer in the Moscow area was accountable for this attack on these 4 people who are now dead.

If he is innocent, his life has still been ruined by all of this attention and horrible inferences about his life. People are supposed to be innocent until proven guilty. But what really happens is their lives are destroyed before their found guilty.

I'll give it to the defense, they are good! We don't have all the evidence and we need to remember that Kohberger was in the area many times. Why? His phone was off at the time of the murders then turned back on after. Why? We also know Kohberger purchased an identical sheath. They never found it in their search. Where is it? There is a lot of circumstantial evidence but I wouldn't say he is exactly innocent.

In response to both the above replies, is not always possible to retrieve deleted data. The reason why deleted data can be recovered in the first place is because the physical memory it was on isn't deleted; it remains for future use. All that happens when you delete a file is that the operating system removes all references to that file, and stops caring about what occupies the space it used to occupy on physical memory. If that memory is overwritten, its past contents are lost forever. One can deliberately choose to overwrite that memory if one knows how.

I’m just at the beginning but wondering why it was stated that the sheath was “placed” snap/button down, etc. It would be more accurate and appropriate to say that it was “located” in this manner. It may have “fallen” out of a pocket or been “dropped.” These words actually have different meanings and the science of forensics is, if nothing else, precise.

I am suggesting that In this particular instance, using the wrong word demonstrates a lack of effort, poor attention to detail, or a misunderstanding of basic vocabulary. I suspect that statement is based on Andrea's experience in the field. This is the third time defense has asked for disclosure, with (to my maybe flawed understanding) no meaningful response either of those times, and the defense has started using strong language (paraphrasing, "if xyz evidence exists, the prosecution is hiding their entire case / based on what has been disclosed, the prosecution has no case"). She may have encountered situations like this before, and from that experience, may know that this is generally a bad sign for the prosecution.

I studied in constitutional law and this case fascinates me. Seeing you explain it through criminal law makes it even more intriguing. If this goes to trial I think this could be one of those cases that future generations study. I see a lot of issues creating the genealogy tree with constitutional rights. It’s hard to imagine there being no dna on the perpetrator/or his items, and none on the victims. I’m just so interested to see how this goes.

I am not surprised there is no connection found between him and the victims. This is surely a very unusual case. How often does someone go on a murderous stabbing rampage inside a house, or even outside a house. Could all these students have annoyed someone. Obviously, they were often disturbing neighbours. Could it have been someone that lives in one of the surrounding homes. Someone that had complained to police.

They are seeking to compel the genetic genealogy which is different than the forensic analysis of the car. The State's discovery responses indicate they've already produced reports detailing the analysis of the car and given the defense access to it for their own investigation.

A little confused as to why you’re saying there’s zero evidence to connect Kohberger to the victims on his devices -since it’s my understanding-yes rumors only- that there’s been quite a bit of connection between Kohberger & a victim or 2. We just don’t know what that is yet. Or if it’s true due to the gag order. My only point is I don’t think we can assume it’s a fact there’s no connection As to his cell pings -while I do agree it’s circumstantial-the early morning hours of Kohberger’s cell pinging near the victims house and the repeated times it was found near victims house -is pretty darn strong circumstantial evidence to me. In the end it will always be the evidence put forth at trial and the totality of the evidence. I’m just not convinced by the arguments I’ve been hearing that the states case is in a dire state

I only have a vague idea where the house was located - if I were in Moscow today I would have to look at a map to figure out how to get to it. But I would bet my cell phone has probably pinged off those same towers because I've been to the college campus, I have been by the botanical gardens (great walking/jogging paths) and I have driven through town on Hwy 95. I think anyone who has been any of those places also probably pinged off those same towers. Maybe there's GPS from his phone that places him at the house - but it doesn't sound like there is.

A point on this "ping data"; I work in an area which has very poor coverage and a couple of times it has located me so far away from my actual location that it has automatically changed time zones. Only reason I know is my alarm went off, I stopped work and shut down machinery, and my coworkers start looking at me like, "WTF? Where are you going?" i am hundreds and hundreds of miles from any time zone transition area.

Because they quickly as in between 1-3 days certainly cleared all the "usual suspects" any other competent LE agency in the country would have looked at hard and long and possibly named POIs - namely the ex-boyfriend who 2 of the victims tried 10x's to reach shortly before the crimes and all those known to have been the last to see the victims alive. I believe what happened here is BK somehow came on their radar, this guy very different than your ususal guy running around Moscow/Pullman with 0 ties to the community, that's who became their primary focus - if they ever kept an open mind that it could have been anyone from within their community. Which of course would not look good for parents looking for a safe community to send their 17 year old incoming freshmen to school at.

Not necessarily. They were relying on info from police and as such, media has a good defense and pretty solid protection. When it is defamation is when they knowingly publish fake or factually inaccurate info with malice. You can only blame folks for publishing stuff they knew about and not what they were relying on law enforcement to tell them.

Wow! Scary! I know they are desperate to nail the person who did this, but…you would think, that they would want to get it right! Because if they are wrong, not only are the persecuting and prosecuting an innocent person, the actual killer is still out there! Just My thoughts!

The PCA was good enough for a warrant, and I'm glad they did the deep dive into his car, apartment, etc. It was a necessary step to take. But it's looking like they got the wrong guy. Or at least not all the guys -- and I'd wager that Kohberger never held a knife (if he's involved or not). The cell phone pings are worthless. It just means he was in the area -- like everyone else. The car stuff is just flat out bollocks. The one car everyone shows a photo of, isn't an Elantra and has tinted windows. Some of the snaps referenced aren't the same car. This was lazy work done to add "something" "anything" beyond just the sheath DNA to PCA. But if it ever goes to trial, the car shenanigans can only serve to make a joke of the Prosecution and discredit themselves to the jury. And to add fuel to the fire, the "Kia Challenge" hijinks -- the mass nationwide thefts of Kias and Hyundais of BK' exact car model -- started in October 2022. So they're left with just the sheath DNA. No weapon. No motive. No DNA in his car/apartment. No location. Just a single sheath that has a single spec of Touch DNA on it. That's not enough to get 1st degree imo.

If I was a juror in this case, with only the evidence we have seen now - I would have to find him not guilty, just based on the fact that they cannot prove he did it, and to make matters worse they can't disprove others didnt - as they have more DNA from males they refused to look at. If they persue the death penalty I'd have to vote not guilty, just because the evidence isn't there to send someone to their death.

Defense can’t have it both ways, How can you argue, No DNA, when they found DNA at the scene. It may not be where you’d like it, but it was there, on a knife sheath left in a bedroom, on the bed of one victim, who coincidentally, was obliterated with a large knife. With the amount of blood at the scene, the perpetrator made it much easier to uncover DNA, because he left the sheath behind to a large knife, that could do this mass murder. You start a puzzle, One piece at a time. One way to get around a gag order, is to file a motion with information you deem favorable to your client and want to get out there. Atty. Pryor has done this for 3yrs for his client Daybell.

The state is yet to hand over everything they have on BK and the defence is already making bold statements about DNA. For all we know the evidence the prosecution has is compelling.

BUT, he wasn't even on their radar until almost a month later. He wasn't arrested until almost 5 wks later. He had soooo much time to get rid of the clothes he wore, any evidence and clean his car throughly multiple times. He was even cleaning it in the middle of the night w gloves on at his parents house while LE was watching him. Over a month later and dna not being found isn't surprising just disappointing. He was seen by law enforcement and his own family walking around wearing latex gloves. If he wore those, the black ones like the one found in his apartment, those are on amazon listed as being "slip proof". If he wore a mask (which we know the person did) and gloves and had a long sleeve shirt on it's possible to not leave any of his dna at the scene. What about the recent news info that came out with people saying their sources in LE told them that there was evidence of a connection between BK and one of the victims on his phone? Right after he was arrested I checked his IG and he was following everyone except Ethan. I have a screenshot of it and thousands of others saw it. LE should be able to find out what date he followed each one of their accounts, not that it would be a smoking gun. Just mentioning it because in this report it says there's no link between him and them. Who wrote this report? I don't understand what they kept close to the vest then and the need for gag orders if there's nothing there.

The connection to the victim on his socials we're on unsubstantiated rumours. If you saw a connection between him and the victim's on Instagram, it might have been from a fake account. Fake accounts claiming to be his have popped up since beginning of this case. He may have had a month to clean his car, but there would be evidence that he clean his car and apartment with industrial cleaners. There would be evidence that he tore out the carpets in his car to clean thoroughly. Furthermore, it would be almost impossible to get rid of every speck of DNA evidence unless you bleach bombed the car and the apartment. Even then you might miss something. The more mental cartwheels you have to make to explain this lack of evidence (he tarps the car, he had a change of clothes, we cleaned the car and the apartment without leaving a trace of that cleaning, she's a criminal mastermind excetera excetera) the more likely it is that the lack of evidence means that it was never there in the first place.

You explained this better than the news or other true crime podcasts I tuned into. It is big. I’ve commented on those shows that it would be a key thing if they found any physical evidence connecting the victims to his car, apartment, office, etc etc. Considering the brutality of the attacks per what was generally alluded to and the number of victims it seems pretty unlikely no physical evidence was found in the car, apartment, his clothes, office, etc.

@@lddcavalry True. But it makes it pretty hard to get a conviction. For a jury to find a defendant guilty beyond reasonable doubt. They have to go on circumstantial evidence and a narrative. Harder to get a conviction. Without a conviction, the presumption of innocence afforded to an accused remains in place.

The gag order prohibits extrajudicial statements - saying things outside of the judicial process. This filing *is* the judicial process. They are litigating the case in court, exactly as the gag order requires and the judge expects.

Firstly: I want to make something 100% clear: I went to Catholic Elementary & Catholic High School here in Omaha, Nebraska. I was baptized as a Baby in The Catholic Church, and both my parents went to Catholic Elementary & Catholic High School. I am not a Scientologist, and only really found out about Scientology during The Danny Masterson Trial. No one is DEFENDING Danny Masterson, and I truly believe it’s because of The Overwhelming NEGATIVE OPINION people have about Scientology. I’m asking you to set aside SCIENTOLOGY completely for a moment:::::::::::: ::::::::::::: I think you could work on A Supreme Court Case. During The Danny Masterson Trial, The Defense filed a motion TO STOP the Accusers from being referred to as VICTIMS during The Trial. Why? Because it’s HIGHLY PREJUDICIAL. There was NO PROOF that a Crime even took place. Yet THE JURORS heard OVER AND OVER: “VICTIM VICTIM VICTIM VICTIM.” Of course, hearing these ACCUSERS being called VICTIMS over and over and over is going to sink into their subconscious. In The Rittenhouse Trial, The Judge FORBID The Prosecutor from calling the men who attacked Rittenhouse VICTIMS. I truly believe THIS IS A SUPREME COURT CASE waiting to happen. I think you should contact Masterson’s Attorneys and tell them you can help them TAKE THIS TO THE SUPREME COURT. No ACCUSER should be ALLOWED to call themselves VICTIMS during a TRIAL, especially when THERE IS NO PROOF A CRIME EVEN OCCURRED. This can apply to many trials. This is THE SAME REASON A DEFENDANT IS NOT WEARING AN ORANGE JUMPSUIT IN FRONT OF THE JURY, BECAUSE THAT WOULD GIVE THE IMPRESSION THE DEFENDANT IS GUILTY AND NEEDS TO BE LOCKED UP. :::::::::::::::::: Please Know: I believe Danny Masterson is Not Guilty. In the second trial, the Prosecutors were allowed by The Judge to say over and over and over that Danny drugged these women. There is absolutely, positively NO PROOF of this, yet they were able to claim it. The Guilty Verdict of Danny Masterson IS A TIPPING POINT for these types of cases. The alleged events took place in 2001 and 2003, and the prosecution had ZERO physical evidence. This should have never even gone to trial. One of the accusers filed a police report back in 2004, and in the report, she never once mentioned being threatened with a gun. Then, in 2016, she claimed Masterson threatened her with a gun. This DETAIL was to “match” another accuser, who claimed he threatened her with a gun. She obviously made it up. At any rate, I truly believe No One is Defending Masterson because of The Scientology Angle. I think Scientology should be set aside, and The Facts of the case should be looked at.

The only thing I can come up with is that whatever was really going on..... it's more important for them to hide it than it is for them to not ruin an innocent man's entire life. So, it's something big. Especially since it will be found out in the end anyway and they still chose this.

Thing that cases like this show up is a number of people who may act weirdly, but actually may not have done anything actually wrong. It's just that when you start looking beause a crime had happened you find these other people and their behaviour looks suss. Could Kohberg actually be one of those types of people?

He could’ve lined his car with plastic wrap. He planned everything ahead of time that he could. He didn’t plan on loosing the sheath. He didn’t return home immediately, he had tons of time to discard the clothes, plastic, clean before arriving home. He did like the girls Instagram photos as stated by Kaleys mother on the drunk turkey show. The state has a tight case.

Unpopular opinion here. I have been growing increasingly frustrated by the 'hordes' mentality when someone is arrested. They begin reading into every facial twitch, every glance, ever word uttered. And they see it from the 'they're a monster' angle. The person arrested is damned if they do and damned if they don't. Crying? where are the tears? why are they so hypocritical, should have thought about this before you did XYZ crime. No tears? Heartless, cruel, evil. It might be time we have someone wrongfully accused go through the process of getting off on the charge. Or even released before they go to court. This of course would be horrible for the family etc. and I don't mean to wish that on them, but it is time the public and the media check themselves.

I thought they said early on that his cell phone was pinged in the location of the house before the murders were committed several times and then during the time of the murders his cellphone was turned off for several hours and then when it was turned back on he was heading back to his house from the general direction the murders took place. Also didn't he study criminology, wouldn't he know how to keep his DNA out of the crime scene and his car? IDK, this case is fishy but so is he.

To my knowledge, determining location through cell phone ping records in that area is not precise enough to guarentee he was in Moscow. The language around the pings in the SPC was that they didn't exclude him from being at the scene of the crime, not that they demonstrated he was there.

@@kellielynn9637 First, the identified make/model has changed, which gives me little confidence that the identification is precise outside of color and general shape of vehicle. Second, for (almost) any given vehicle, there exist many others that look quite similar. Considering that weeks passed before arrest & the accused was in a different state than the incident, the number of people which the cameras don't exclude (if we assume the vehicle belongs to the culprit) is going to be reasonably large. Those two pieces certainly make the accused a reasonable suspect, but they don't prove he was at the crime scene.

Murdough's case one of the jurors was interviewed and he said that they did not review the evidence, that juror clearly stated that he made the decision because he did not believe AM's tears. Horrible and frightening on the part of that juror.
