Judge Merchan is simply making it clear to Trump that he doesn’t want to be left no other choice, because jailing Trump now will cause a delay in the process. However, Merchan does have the option to Stay the punishment for a time after the trial ends or for example during deliberations, so as to not impede the judicial proceedings. Hopefully the prosecutors will make this request.
