Ano ba ang gagawin ng buyer bago bumili ng agricultural land na may existing agricultural tenant?
What is the Right of Preemption/Pre emption? What is the Right of Redemption? Why are these rights of a tenant important to know before buying an agricultural land?
When should these rights exercised by the Agricultural Tenant?
These are some of the matters we will discuss and learn in this video lecture. We shall discuss the laws that gave birth to the Agricultural Tenancy relationship between a landowner and a tenant, its evolution and amendments.
Oftentimes, buyers of agricultural lands do not conduct due diligence in knowing whether there is a tenant or none. Do not just agree to the explanation of the seller that there is none. You have to conduct ocular inspection on your own and view for yourself the existence of such tenant in the eyed agricultural land. Diligent efforts must be exercised to the extent of inquiring from from the barangay where the property is located including the neighbors adjacent to the land whether or not there is an existing agricultural tenant working or tilling on the land.
Tenants of agricultural lands enjoy land security tenure and could not be dispossessed except in some rare instances allowed by law and order by the court.
