I saw the video, and as a former courtroom clerk, I agree that should never have happened. I never had a docket quite that busy, but, unless everyone was there and ready, cases weren't called until 15 minutes after the scheduled time. We didn't want to waste time on adverse documents. More often, it was the attorney we were waiting for,as there were 7 other courtrooms in the building that they could have been in.

The defense attorneys the prosecutor and the judge should all have to spend 2 weeks in jail just like they did to him and it should be broadcast around the world that they are in jail and what for so they are embarrassed as this man was. They should also lose whatever money they would make over that 2 weeks that they are in jail and it should be given to this man.
@nerys71
@nerys71 2 года назад
@Aerrin Longheart Several things FIRST QI for POLICE is "in the courts" very different from QI for prosecutors and judges QI for the legal folks is actually STRONGER and more ABSOLUTE but also has stricter conditions. IE if they commit an actual crime they are NOT usually protected although this brings up the second issue. the DESIRE of a higher authority to push to prosecute them. but that's another issue all together. SCREWING a man because of ignorance or you don't care or "fuck em all" attitude. YEAH. their protection is pretty much absolute. you are NOT breaching that QI However. if you knowingly and obviously step outside your authority IE you willingly and with knowledge commit a CRIME. the QI simply does not exist any longer (like I said its stronger and nearly absolute but has stricter rules) With POLICE "pretty much anything they do" is counted as "on duty" and within their scope. this is wrong but it is what the courts are enforcing. A judge or DA committing an obvious in your face actual CRIME ? not protected. but still very hard to prosecute because of the second issue.

The public Lawyers were not just negligent in this case. In the video, they can be clearly heard conspiring to put him in jail and seen having fun and joking about how they are going to betray him and throw him in jail just for giggles and having a fun story to brag with. I’ve seen attorneys that were paid by their clients actually working against them. Happened to my little brother back in 2009. His own attorney forged his signature on a plea agreement that included 30 days jail time for a crime he didn’t commit (eluding on his motorcycle). We filed a bar complaint and there was eventually some sort of minor sanction imposed, but it was nothing more than a slap on the wrist. His conviction was pardoned and expunged 5 years later by the state’s governor after a review of his case. He had just turned 18 at the time he was charged. The cops, Asst DA, and his own lawyer were trying to ruin his life before it had even gotten started simply because they didn’t like motorcycles. He was still in HS for goodness sake. I saw the video from the court room showing that guy waiting out in the hallway expecting his attorneys to notify him for his turn to appear in front of the judge. The guy can be seen through the glass of the court room doors calling his attorneys on his cellphone, and the one attorney purposely turning off her cellphone. The most disturbing part is how the attorneys, bailiff, and court staff were all seen and heard laughing about the court ordered arrest as it was being processed. Talk about cynical and callous behavior in that court room. Both defense attorneys should be disbarred for not defending their client and putting their own interest over their client, and the judge should along with the court staff should be investigated, disciplined, and or fired. That was by far the most unprofessional courtroom I’ve seen. It was literal in a sense a kangaroo court.

I’m a retired Palm Beach County Prosecutor and Judge and had this abominable, unethical action occurred in my court, these attorneys would have been banned from appearing in my court and referred to the bar for disbarment. BTW, I had once been assigned to a one Judge Courthouse in the northern quarter of Palm Beach County so being barred from my court would have put quite a crimp in any attorney’s ability to practice law in Palm Beach.

@moodiblues2
@moodiblues2 2 года назад
@@robinperini9260 Yes, the Judge seems like she acted in an unjust manner. On Mondays, when I was presiding in criminal court, at around 8:30, I used to have dockets of maybe 40 cases for mostly status checks or calendar call. Attorneys who had cases in several courtrooms, had their cases called first. They were mostly ready and we’d handle maybe ten cases rather quickly. Then, I’d call the docket. If a person’s case was called and they weren’t present, I would go on to the next case until all were called. It was then, maybe two hours later, that I’d call their cases again and if they weren’t present I’d issue warrants. Most people in criminal court had the Public Defender and frequently, they’d ask for time to call them or ask for their case to be reset to the next day. If a person came in late, and a warrant had already been issued for them, the warrant would always be withdrawn. This was for two reasons, to me it was unjust to lock up someone because they were running late, and the jails were over-crowded with dangerous people. Some Judges seem to forget that they are there to assure justice is done in all matters in their control.

We had an incident where we were ready to appear before the Judge, however our Atty was nowhere to be seen. The case was called and we verified that we were indeed present only to have the Prosecutor inform the Judge that our Atty had called him because a very critical case had moved ahead and he had to be there and was hoping to be back to our courtroom before we were called. The prosecutor informed the Judge that motion to dismiss had been presented to his office and he agreed with it, so begging the court's forgiveness, would he approve the motion, dismiss us and inform our Atty of the results as soon as possible. The Judge thanked us for being there and being ready (or as ready as we were going to get), told us the case was summarily dismissed, all charges removed from record and that we were free to go. We sat there unknowing for a few minutes longer before another Atty told us that we could quietly leave the courtroom - we were done and to have a nice day. Somehow I don't think these two were quite on that level.

Cool result. Mine wasn't so good, Atty didn't show until too late. I kept recycling it as long as I could. Judge eventually ran out of patience and I wound up defending myself. Trying to get a fairly serious traffic charge thrown out due to bad paperwork by the officer roadside and conflicting information on the original summons. Due to the stress and pressure, I decided to change plea to guilty. The judge did take pity on me to the extent of minimum allowable sentence. Atty still invoiced me for the appearance! 30+ years ago in New Zealand.

When I was 19 or 20, I got a ticket for 78 in a 65 on a highway that went through some small town in NC. Since I was going over 75, I had to show up to court...I think it was 75...I got there and I was directed to a courtroom for some reason, but it was the wrong courtroom. Nothing related to traffic tickets. It was things like assault and drug possession. Anyway, if someone wasn't there, this judge was stopping to issue bench warrants in a packed courtroom. If you're curious what happened to me, after about an hour, I quietly made my way over as close to one of the bailiffs as I could and got his attention. I showed him my ticket. He said I was in the wrong place and told me where to go. I got up to walk out and I hear "excuse me sir, where do you think you're going." I got pretty scared because of all the bench warrants and was worried I would end up in jail. But, the bailiff quickly said, "his ticket was filled out wrong and they sent him here by mistake." The judge said "okay, you can go". When I got to the correct courtroom, I didn't even say anything they just dropped it to improper equipment and charged me $90.

I think he has every reason to be irked on this one. He said it before that there are bad judges, and bad lawyers (so many people in the field, statistically it will happen). The issue in this case is the taint it creates because of the behavior by the parties involved. Everyone says the system is rigged, sadly this case not only proves that it is but also puts out for whole world to see. Steve's whole way of life (being a lawyer) just got harder because of this case. Every person he works with as a lawyer will think about this case and now wonder if he is in bed with judge. The case was that the defendant was alleged to have broken a window on his ex-wife's car. While it was alleged that the defendant was seen in the neighborhood around the the window was supposedly broken there was a little problem with the whole case. The foreman called for a poll of the jury to see where our minds were on the topic and everyone said "not guilty". My problem with the case was that the prosecution never were presented with evidence that a window in the car had actually been broken much less that the defendant had been in a position to have done the deed. No proof that a crime had been committed means to me that the defendant is not guilty.

I know of an instance in which a judge committed misconduct which normally would have disqualified him. However, the defendant's attorney didn't want to cross the judge, so he said nothing and let his clients suffer the consequences. In that case, both attorneys and judge were aware of their respective duties, AND they would have been aware that they each was not fulfilling them. The judge knowing full well whats going laughs about it. The laughs about it with the court clerk and bailiff. Then starts working on the cover up. This was horrible! everyone involved here should not be allowed to work in the legal system again. This is a massive miscarriage of justice and corruption. The Judge then states she issued the warrant after 9 (a blatant lie to cover up her criminal activity on the bench. The giggling and laughing they did at this man and at his expense i find very sickening. That is a sign of a twisted deranged mind that gets pleasure out of someone else's suffering or misfortune. John Rawlins- yeah, when they all seemed to get a kick out of railroading this man, just because they could, and all had a good laugh about it, well, it made me feel felonious. None of these people have any idea of how going to jail affects a person, it's just something they see on paper. They think that they are not the type of people that jails and jail time sentences were made for. They believe that they are somehow removed from the possibility of ever having handcuffs put on them, and led away to a cement holding cell, cutting them off from their cushy lives. But clearly, these people, from the judge,to the clerk, to the bailiff, are actually committing crimes, right in front of a camera. They are involved in the illegal incarceration of another human being. Their lighthearted laughter only proves their disdain for an average person, and distinctly reminds me of how the 'royals, and their court' used to treat peasants in England. I would like to see everyone involved jailed. For at least 48 hours. Stood up, with no warning, handcuffed, led away, booked, thrown into a holding cell, and then eat jail food for at least 2 days, without any promise that they will be getting out anytime soon. And extremely limited contact with the outside world via a landline and monitored phone. Put them into shock, it would. Put a little reality back into their thought processes in the future, perhaps.

Incorrect. The judge is ultimately responsible for all of the proceedings they oversee in that courtroom, and all decisions made must go through the judge before it is validated. Plenty of lawyers do stupid or out of order things during court hearings, and the judge, unless biased, will strongly correct and warn that lawyer that it can not continue. None of the plantiffs wanted to participate in the replanting process. Now that the work is completed they are suing us. Fortunately, I had them sign a note saying that they did not want to participate. Thus they came up with a scheme saying my parent was not a legal heir. We won our first round but they have appealed. Their plan is to spend us into submission and take control of the property now that the work is done. I talked to a DNA expert and proposed that we could settle the paternity issue with an DNA examination. We all would carry my grandmother's genes. My lawyer stated that we might not like the results. Probation is another trap that sends people to jail over dumb crap. I had a friend on probation for shoplifting food who was given 18 months probation. A year in, she dropped her phone and it broke. Life happens, right? She got a new phone that day and called first thing in the morning and let her P.O. know and give him her new number. He violated her and made her do 30 days for changing her number “without advance notice “. 🤦‍♀️ Meanwhile , to be in drug court you can’t have a prior drug concern (WTF?), have to be in court every week, And also call every morning for the “color of the day “ and if it’s your color, you got to get there before probation closes at 3-4 to get drug tested. My BFF died because he didn’t have a ride (no public transportation around here) , couldn’t truly work because he had to leave but didn’t know the days except for court every Thursday morning, etc but he has to keep the job but if he missed work or an appointment he’d be fired then violated or violated. Anytime something happened , he would run afraid and didn’t get help (suboxone) because he was just gonna be made to detox in jail. He ODed after walking 3 hours to try and make it in time (he didn’t). All this over a bad $100, but anytime he was violated he got more impossible terms to meet so six months probation turned into 3+ years and 8 months out of his last year alive behind bars. But don’t worry, a guy who molested his niece and sent “pics” to her only for a 60 day sentence. 🙄 Jails are filled with people sitting on BS technicalities like that (And of course this is without bail as well) while molesters get a slap on the wrist.

I knew one guy from an upstate New York county traveled across the river to appear as respondent on a complaint in court versus a local of that county (a lot of these counties have Hatfield & McCoy syndrome) and after making his first appearance before the bench, was instructed by the judge to take a seat. The only seating available was in the public gallery the first rows of which were reserved for litigants. So this necessitated him to pass through the two little swinging doors in the low rail separating the public gallery from the active courtroom. The doors were equipped with springs just strong enough to return them to their closed position with a minimum of swinging and banging (I suppose, or the judge would have never tolerated that distraction in his courtroom). He was unaware that the bailiff was on his heels so when he released the door(s), it(they) hit the bailiff and the bailiff immediately grabbed him to put him in handcuffs, accusing him of assault. He took him out of the handcuffs around 20 minutes later after emergency surgery at the local snowflake infirmary. I think they were ready for this McCoy. The whole matter started when he was riding in his car with sunroof open with his wife driving. At one point, she remarked that some other driver was following too close and had been doing so for some time. So, hubby in the passenger seat started flipping pennies up and out through the sunroof opening. It apparently made someone angry.

I have a solution for the conflict of interest that’s inherent in a public defender. If it’s a person’s right to have a the state provide them an attorney then it means the state is paying for that attorney. So just give the defendant the money instead so they can choose their own attorney. Then you have a real free market solution where defendants can shop around and make a decision that they don’t feel coerced into, the attorneys will be subject to public scrutiny (word of mouth) and forced to perform well, and there’ll be less question about whether the attorney, who works in the same building as the judge and prosecutors, is loyal to their client or to their colleagues.

I saw that video, the judge is at fault too because she conducted business BEFORE 9 AM and issued the warrant.

So Steve, my friend that lives down in Utah said that he had that same defense attorney. They did not allow him to talk to the judge talk to the defense attorney unless it was written down on a piece of paper. And his case went just as what you think. I got screwed over and slapped with a bunch of inappropriate in fractions and fines.

I had to be in court (divorce) once at 9:00 am. The judge waited until 9:27am until my ex wife showed up without any reprimand.

The 2 weeks in jail is the worst part of this story. I hope his lawyers get disbarred....short of that they need to spend a night in jail themselves!

I have always made my best efforts for my clients. What happened in this case is outrageous. I always ask the Judge to give me time to try and contact my client. I have never had a Judge deny me the opportunity to contact my client.

It had to have been very obvious to the judge that the attorneys were engaging in misconduct. If nothing else, it was clear when the guy showed up and asked what time his case was called. You nailed it with the attorneys. They said they were ready to go when their client wasn't there. That is shocking misconduct.

Thank you for the update to this story. I feel such empathy for this man. In Oregon a public defender crossed my path one day. He was self-absorbed and concerned upon our meeting with his tattoos. Now I have met many nice or decent people with tattoos but they, (generally speaking), had other interests. In this situation I ask that we, “let the ink settle.” When public defenders are more concerned about THEIR interests, they are public enemy number something! This is a legal example of where, those who presumably have power to yield. They lack or yield it in such a way, that the coverup or attempted coverup. It is far worse than the crime itself. Please keep us posted! Not ok! The ethics and lack thereof, are beyond disturbing. Again thank you 🤔❤️🇺🇸

I saw the video a few days ago The judge, prosecutor and the two defense attorneys should be disbarred, monies the defendant lost should come from those four knuckle heads personal monies and they should be in jail for at least as long as the defendant. These Jackasses we're actually laughing at this guy predicament.

I'm not sure but I also thought the judge ordered the clerk to alter the time on the warrant to try and hide the fact they called it early.

I wondered what happened with this case. Everyone in that courtroom with a law license should be charged with a crime and disbarred. SAD, SAD AND SAD. This man's own lawyer threw him under the Bus.
