If City are allowed to settle outside of court the Premiere League loses all of its value. Several clubs have had points deducted and Chelsea are still at risk of point deduction, but City getting off with a wrist slap just goes to show corruption and greed at the FA.

Whoever is responsible for bringing forward the 115 allegations is also at fault. The problem with having so many allegations is that if even one cannot be proven-and I believe there are dozens that the prosecutor cannot prove-then the City's lawyer could retaliate, jeopardizing the validity of the other provable allegations. They should only file a few allegations that have a very high likelihood of being proven by the prosecutor.
@-A-lm5xb
@-A-lm5xb 20 дней назад
Well the fact is there are only a few, four or five in total. The 115 is made up because they are alleged to have been repeated. A bit like if you get a parking ticket every day for a week it's not one charge, it's 7, and so on. The PL dropped an almighty bollocks by announcing it as 115. They almost certainly have nothing and I assume that they thought they would spook City into admitting something, but you can't prove what didn't happen. Why would the club be spending millions on increasing the stadium size if they were guilty? Why would United poach the main director said to be responsible for most of the deals? If Etihad Airways are to go public, like they have announced, their financial records would then be available for the public to view so it doesn't make sense from their point of view. The owners have an excellent business reputation around the world, why would they risk that and potentially put billions of dollars worth of contracts at risk for the sake of a handful of relatively small and meaningless payments? None of it makes any sense and the PL wouldn't have opted for a private hearing if they had anything substantial. I think they wanted to try to prove to the government that they did not need independent regulation. The mentality of the PL board, who are not lawyers or financial experts, was that they would show the world who is in charge and it's massively backfired on them. Let's also not forget that the PL is effectively the group of clubs in the league, so that's 19 clubs who have been taken to the cleaners and embarrassed by city over the past decade. There are strong rumours that the case was brought by Arsenal, United and Liverpool, the three clubs that would have won more titles had it not been for City's emergence and I know for certain that within all those clubs and United in particular that there are people who are very bitter that City have come along and broken up their little cartel at the top of the league. You can't tell me that they're not bothered, because it's not just the trophies but the hundreds of millions that City have collected in prize money used to be theirs. They can't stop City on the pitch so they're trying to stop them off it. Hey, I don't know any more than anybody else does but it all adds up.

This settlement outside court only makes both City & Premier League lose credibility. City's charges should never be allowed to be settled out of court. I perfectly understand it's financially more prudent to have such matters settled out of trial, but if the EPL are confident in these charges, then they should press on to fight them in court. It would ruin the integrity of the game and put the FA in disrepute more than Man City. A heavy fine and a slap on the wrist doesn't even remotely come close to justice for teams like Everton and Nottingham Forest who have fully co-operated with the FA. If they allow Man City to pay their way out, what message does that deliver to the league? Does it mean it's ok to now cheat but as long as you throw money at officials, then it's all good? The FA are an embarassment if they don't have the courage to see this through to the end. It would also suggest the FA are corrupt. This beautiful game is now ruined, tarnished and destroyed. Football has now become a corrupt business, rather than true sport honest fans pay to watch. All we want is a fair competition. All we're seeing now is a game that has been destroyed by greed.

IF the PL wins … one step closer to Superleague. Nobody in the areas outside of England care if the teams coming up from the championship can compete on a level field (which they can’t anyway under FFP). The best teams are owned by foreign entities who are frankly tired of a biased body trying to artificially keep a status quo hierarchy of teams in place. The PL essentially said, “right then, what types of money do Liverpool, United, and Arsenal have in advantage over everyone else? Ok, those will be the only funds allowed” I’m not a City fan btw. But this rabid attempt to persecute investment in teams is going to destroy the league, and WILL bring the Superleague faster.

@-A-lm5xb Okay sure, yes, I'm using the word "court" as a figure of speech. You know exactly what I mean though. Yes, it's held by an independent disciplinary commission that will decide the verdict with unlimited powers. Of course both parties would be settling if the independent commission doesn't take place. Why would the PL have to settle for damage done to the clubs reputation if it's never concluded that Man city are actually innocent. Furthermore why the hell would Man city accept a settlement if they have 100% evidence that they have done nothing wrong. It's a win win for them to have the independent disciplinary commission conclude the charges as they would probs get a wack of money for the clubs reputation being damaged and then also the whole world would know they're innocent. Can you not think of one quite obvious reason why Man City wouldn't take this route??? I agree I feel sorry for City fans as they may have to suffer for the idiots in charge of their club, if guilty, but you're acting and talking like you know Man city has done nothing wrong already. I mean you must be a city fan clearly. And yes if the PL doesn't take it to the commission then absolutely there should be protests and revolts as it would stink the entire league out. But you can't give proof to somebody if you haven't done anything wrong and there isn't anything to prove, which is probably why the PL are going to have to pay a settlement fee to the club to cover their legal costs etc. and the damage to their reputation over the past year and most likely for many years to come. Terry, this is why we need to have these conversations, as much as some people may not want to. A settlement does not look good for either side. It gives the impression that there was some leniency and/or slap on the wrist, for the violator/offender. It looks weak on the part of the governing body i.e. PL in this instance, and that the accused i.e. Manchester City has something to hide. A lot of times settlements are shrouded in secrecy and come with NDA's which prohibits either party involved from publicly discussing the terms of the settlement. Therefore, it never becomes public knowledge as opposed to court records. The people deserve to know the truth.

No, not exactly. UEFA, the European League, took City to court but the case couldn't be proven and was easily overturned on appeal. They were trying to impose a fine without any valid evidence. Notable - but never mentioned anywhere - was the UEFA didn't challenge the appeal or even turn up at the hearing. The only fine was for not providing documentation on time, but it was effectively the equivalent of a parking fine to you or me, nothing major. £6 million, or around US$8 million. The current case is more or less based on that one. The 115 charges is really only about 5 or 6 with the same charges supposedly repeated over time, like if you park in that restricted area today that's one charge, if you're still parked there tomorrow that's another charge, and so on.

Now with City, the 115 charges are a bit of a tricky thing, you see only 12 of those charges are legitimately connected to cheating. The other 103 are charges related to financials and them telling the PL to go fuck themselves. Now these dont get you in any trouble as they dont really pertain on gaining any advantage at a sporting level. For the PL to punish City they have to prove the breaches on those 12 charges in order get them canned, not the 115.

Settlements are NOT an admission of guilt. Why is this so hard for people to understand? There are many reasons why two parties would settle. It’s not going to matter what happens either way; rival fans have already made up their minds and regardless of whether they’re cleared, settled, or convicted, the notion they’ve cheated is out there for those who want to believe it. It’s very obvious that the PL bit off more than they could chew. To truly throw the book at someone you need to focus the 115 charges down into the major grievances and pursue those. It’s not up to City to defend themselves, that’s the MAIN point people fail to acknowledge. The onus is solely on the PL to PROVE guilt. So if they can’t, and they settle on lesser charges, then the only people to blame are those at the league office.

Sadly this was always going to be the resolution. Take a minute to think about the ramifications for the FA if City were convicted in court regardless of the punishment City received. Lets say that these charges happened over a 5 year period, every relegated team in those 5 seasons would be starting their own claim for damages. After that every team who finished 2nd would brinf forward a claim, every team who missed out on Champions league and Europa league because City finished ahead of them would have a claim and so on. The FA would face at least 20 different clubs coming forward asking for financial reimbursement at minimum. Lets take the team who finished 5th every season they will state we missed out on 4th because City were allowed to cheat. Each season champions league participation alone is worth north of 80 million. Relegated teams claim to lose 150 million if they are not instantly promoted and so on. The can of worms would be so great that the FA would never ever be able to solve the issues to all the teams impacted. How do the FA make it right to Liverpool alone who would have 3 or 4 more premier league titles alone???

The commercial value of having Pep, Haaland, De Bruyne, Foden and so on in the league is huge. Relegating the team would rsult in every player and all the managers anc coaches leaving. You then have the settlements to all the other teams who have been hindered by the cheating. After all that the FA will then have to answer as to why they allowed this to happen and never found the cheating years ago. Nottingham Forest and Everton broke the rules this year and were charged this year. Citys cheating went on for a decade and now is taking years to actually bring forward. Every month that passes more teams are being impacted like Arsenal this season and who ever finishes 5th and misses top 4 due to City being ahead of them and so on.

1st thing 1st, the PL would not bring forth charges if they did not have outright evidence of wrongdoing. The issue here is that MC, like with UEFA, are failing to cooperate with PL investigators (this is one of the charges). If an Olympic gold winner refused to give a sample after a race, they would be stripped of said medal as those are the rules. If the athlete waited for a time period and then gave the sample, it would be flawed as any banned substances would have disappeared. This is similar to how MC escaped the payments from Etisalat due to UEFA's time bar. MC were found guilty of many things by UEFA, but were time barred. To receive a fine for not cooperating is better than the other side. Football should be the same as elsewhere in life, fail to cooperate (I'm not blowing into that officer), then you are guilty by default and receive the highest punishment. This would stop all of this nonsense. If the PL came to an out of court settlement, then this would be the biggest embarrassment as they do not have the 5 year time bar rule. They need to push it to the end regardless of outcome.

The idea that if you are innocent we should just roll over (settle) is not right, so have the day in court stick to the guns and if we are found guilty take the punishment, but also if found innocent then everyone should stop assuming guilt and get on with holding your own clubs to account rather than blaming city for your failures

The talk of ' not co operating ' baffles me , as a former police officer and to my knowledge , No defence team , in any type of case , if they believe the allegations are unfounded , would ever co operate with the prosecution , why would they ? , the burden of proof surely is on the prosecution as they are the ones making the allegations , it is supposed to be 'innocent until proven otherwise ' isn't it ?. This makes it sound like the prosecution saying to the defence ' please give us the information so we can prosecute you ', we THINK you have some information that we can use to convict you ', can we have it please ? ' , why on earth would anyone do that ?, it's bizarre

This is not a commercial dispute that can be "settled". It is an administrative procedure to determine rule compliance or otherwise. It cannot be the subject of a "settlement" since that is just a payment of money unless there is an admission of rule breaking. If you can avoid punishment for spending too much by, erm, spending more......
