Marshalling by subsequent purchaser: Sec. 56 TPA 

I forgot to mention in the video that marshalling does not apply on a single property it applies on two or more properties.

You explain things very clearly and also try to tackle questions that may arise in one's mind.

Sir, there are two questions regarding the concept First, When you read sec 41 of TPA it says that if transferee took reasonable care with regard to the property than the transfer of rights to the transferee doesn't become voidable..Means even if he is deriving from bad title the property delivered to the transferee becomes good title but, sec 53 contradicts and says that sec 53 can make the transfer voidable at the option of creditor if there is any fradulent transfer which means that transferor cannot derive property from bad title..So i am confused regarding the two contradictory sections Secondly, section 53 and 56 are also contradictory in a sense that if creditor makes the transfer void then marshalling cannot be applied..It is only when creditor chose not to make the contract voidable..then only sec 56 can come into play..Is that correct?
