I think it was because he was analyzing the situation. He knows Marty is far too crafty to go into a situation like that and just let himself get shot. He didn't look like he believed it , more like he was trying to figure out if Marty was faking or if maybe Tanner missed.

If he does hang, he might have already have or sired offspring. In a deleted scene he does kill the Marshal and his son saw him. There's no reason why he wouldn't tell them would be hanged for sure. The fact Biff exists in 1985 is proof either Buford's son, Biff's grandfather had already been conceived or already born. In the case of either, Buford dying would make no difference as he had already continued the Tannen line.

Unless he already had little Tannens before this. Or maybe he was sentenced but escaped.

That’s the beginning for BTTF4 = BiffToTheFuture Marty, back with Jennifer in his brand new 🛻 from what he thought his last farewell to Doc, went home to introduce Jennifer to his parents. A ‘Miss Lorraine Baines’ letterbox greeted him. Jumping down to have a better look, aghast at the implication, he saw the house in utter disrepair & the overgrown lawn strewn with empty whiskey bottles. Turning to ask Jennifer if she saw what he was seeing : no Jennifer no 🛻 ! Raising his hand in a terrified bout of déjà vu, he saw through it coming at him the same Toyota 🛻 with Needles at the 🛞 & Jennifer laughing wantonly at the good-for-nothing’s side. Out of his despair an explosion 💥 startled him : Doc’s Time Machine reappeared above him & Doc’s iron vise of a grip lifted Marty by the scruff of his neck into the hovering craft which promptly disappeared in another 💥 A prematurely aged puffy-cheeked Lorraine a half-full whiskey bottle in hand tumbled out of the house to see what the hell was going on. Catching a glimpse of the 🫥 airborne 🚂 she looked at the bottle & emptied it in the shrubs : Never again whiskey in the morning ! Never again !

… Not far from the Baines house, George McFly, a pack of his scifi stories under the arm in search 👀 of a publisher was stunned 😳 by the sight of an airborne 🚂 disappearing in a 💥 Looking down at his pack he threw it in a nearby 🗑 well resolved to never again write such hallucinations-inducing stuff.

He was originally arrested for the Murder of Marshall Strickland but the scene was edited out and the dialogue was changed.
