I’m glad Matt Reeves had the sense to use none of Chris Terrio’s material when doing his own Batman movie. Terrio is the same guy who helped write Batman v Superman and Rise of Skywalker, keep him away from franchise movies please.

You can’t sue for plagiarism. It’s not a legal cause of action. You can sue for copyright infringement, a similar but not identical concept.

The Batman is one of the best Batman movies ever made. Even though I Batman Vs. Superman, I liked The Batman more. It was my 3rd favorite movie of 2022.

But he wrote a "pitch" document. He has to use those characters if he's "pitching" the story. Was the pitch to D.C. itself? Was he still working for D.C. while he wrote his story too? If so won't he be under contract (as a freelancer) for D.C. therefore not really infringing copyright. Such a gray area.

That seems like such a slippery slope to call it plagiarism if you write something that wasn't requested. I could understand if he tried to sell it to someone that wasn't the company that owned the IP, but presenting it to that same company that owned the IP in the hopes that it might be considered for use seems a bit excessive and perhaps an overreach.

If you’re going to include Mask of the Phantasm then you have to include any other animated movie. It’s irrelevant if it was released theatrically or not. And also Batman Returns is better than 1989.

I only included Mask of the Phantasm because that is the best animated one. Between Batman 89 and Returns, Batman 89 is the the best one. The Dark Knight Trilogy is a Masterpiece. But The Dark Knight is the best one of the three.

I don't quite understand. When you do a pitch, you use their characters. That's the point of doing a pitch to a studio and it happens all the time. Did he publish stories or adapt them in any way by himself?

Technically you can't write a spec script for Marvel or DC using their character and also you are also no supposed to write fan fiction and publish it online (but most don't care). If you want to write a spec script for DC or Marvel you would have to write it with legally distinct names and other changes. Upon purchase these things would be changed back (cape-man to Superman).

The way I have heard it done is people use public domain super heroes. There are public domain characters that fit pretty close to every major DC character and the thing with public domain is you can change the character how ever you want so you want a wonder woman sub, it might be easy to find an female Amazon warrior type, but she doesn't have the lasso and is more just like the snusnu women for futurama. Well, you change the things you don't like, and you say she has a magical bolas.

I don’t think so. People have a weird understanding of what fair use actually is and im including myself in that. I think we tend to think fair use covers a lot more than it actually does. What im surprised about is if spec scripts are not allowed how on earth do you pitch something to these companies.

The judge likely brought up copyright infringement because it almost always comes into play when money is involved. 9 times out of 10 most companies don't necessary care if people use their IPs for fan projects as long as those projects aren't in some way monetized either directly or indirectly assuming they're not being used to dilute or stain the brand. Star Wars fan projects are a big example of this where we see tons of them but Disney typically doesn't do anything to shoot them down as long as they're not monetizing their IP or otherwise souring their brand. Now, if you're gonna try to sue someone about a spec script that you wrote using someone else's IP then you're obviously crossing that line as you're trying to both gain financially from an IP that you don't own as well as sour the reputation of the people holding that IP. I know that many people have issues with the copywrite system and while I certainly don't think it's perfect I do believe that people should be allowed to own the things that they invent for a reasonable amount of time and should therefore be afforded certain rights to said intellectual property for the time that they fully own it.

I could be completely wrong on this but don’t companies usually take down fan projects because if they don’t they could lose their copyright. I remember seeing this back when Nintendo and WB were nuking fan games left and right. This was around a decade ago when unreal engine and unity became super accessible to the general public and you didn’t need crazy strong computers to run them.

Technically the judge is right. He wasn't asked or given the right to pitch them a script using their characters. I'm sure the judge knows more about the law than us keyboard experts but I think the dude was crazy to think he could sue them for that

I question the judge’s claim that the man bringing the suit is guilty of ‘blatant copyright infringement’. Is there proof he was out there profiting off his script somehow? If this is the new law better go after all the fanfiction websites too.

The judge clearly overstepped. A spec script is part of tje industry's process for getting new stories in, of course they'd be using material IP that the company being pitched to owns. His statement risks setting a precedent. Its not like this guy went and tried to sell it to anyone else. And I'm fairly certain IP had nothing to do with the case anyway, Wozniak would have been arguing about his work being used, not the IP he was including. If he replaced all the IP based characters it would have still been his work, as structure and plot isn't inherently tied to the IP being used. If Wozniak's work wasn't used that makes the case null and void but it sounds like the Judge still overstepped making that statement.

What work of his was being used exactly? He didn’t publish the story of the Batman movie ( the one he claims was plagiarized ) he doesn’t own any of the ideas of story either. There’s no proof he ever even worked for WB or DC. The guy just wanted money and tried to sleaze his way into an easy payday.

@@cesaracosta5483 I never said his work was being used. Read my point at the end where I say if his work wasn't being used then the case was indeed null and void. You didn't read or absorb that. Work and IP aren't the same thing. If you write something you write something, even if the characters you are using are not your own. When someone does use IP thats not their own it certainly complicates things, but his spec/script still would have been written by him unless he directly stole someone else's story. Unless the judge specifically stated what story beats he had stolen from DC, all the judge seemed to claim from what I saw was he stole IP. But of course he did, he was submitting a Batman story to DC, he wasn't going to use original characters. Hence me stating the judge's point is seemingly pointless, because the case was thrown out because his story wasn't ultimately used at all. The difference between IP and the story aren't inherently the same thing. This was my point but I suspect you read everything I wrote as "Wozniak was right", which wasn't what I was saying.

Wozniak actually showed several scenes lifted directly from his script. Problem is studios have the right to steal from writers without credit. Rounders and broken flowers have entire scripts used by changing some lines. The lawsuits are always thrown out as judges side with studio execs.

Does anyone actually know what the, or the extent of similarities from Chris Wozniak's story, and Matt Reeves' The Batman are? If there are, they could be coincidental - how much can you do with Batman really, which hasn't been done before. But this does set a concerning precedent. They're are tones of Batman fan made films on RU-vid. How would this judge see those? It's actually hard to say/write WB wouldn't be so stupid to, but... they have made a lot of dumb decisions with DC over the years. Whose to say they wouldn't take an idea from said fan films. Honestly, I think WB is arrogant enough to do just that, espeically now, knowing most likely a "little guy" couldn't afford to take them on. If you're not aware, WB pretty much tried to buy off the Finger family instead of giving Bill Finger co-creator rights for Batman. BVS was the first film to acknowledge this in the opening credits. Sorry Ray, while your comment has some merit, the 'shut it down' attitude is a serious problem when it comes to discussion. How would Wozniak know there were similarities before the film came out. End of the day, some of the comic book companies have done some real shady things, like putting contracts on the back of cheques forcing creators to sign over their rights.

To me the only good things about this movie are the cinematography is AMAZING, The upside-down shot in the rain 👌, Colin Ferrell Penguin's performance is great, the make-up on Penguin deserved an Oscar, and Gotham for once looked dreary like Gotham is supposed to be. To me, everything else is mediocre at best.
