My thought: mediation is confrontational as are many things in life. I'm older, I'm retired and have nothing to lose. Stalling tactics and being obtuse in situations like a mediation only strengthen my resolve. I've worked my entire life and all I have left is free time. Keep that in mind if you're an attorney or adjuster going forward.
I have a mediation later this month for a bus accident I was in back in November 2020. I’ve been waiting over 3 years for this day. This video has given me good information on what will happen during mediation since my attorney didn’t explain what is going to happen during mediation very well to me.
@@sleepybear7642 My mediation ended and I still got a 5 figure settlement but it was nowhere close to what I was expecting to get. My attorney didn’t want to continue with my case if we didn’t settle during this mediation so I just accepted what I could get and called it quits.
As I prepare our case against the POA who has grievously harmed us with poison I feel somewhat empowered by these informational videos. I learned here something I didn't know, that, the insurance adjuster must refuse five times before a settlement. Id rather have an attorney help us but no attorney will. They all want the huge class action suits. Neither of us, in our 70's, have knowledge of the law. Maybe when we show our serious symptoms and damages from toxic poisonings, we might have an argument they will listen to? We had to sell our beautiful $900K home to and go to a rental to escape the sprayings. If anyone out there has suggestions, we will gratefully receive.
Thanks for this video! I never engage in mediation in a serious injury cases until discovery is completed, There is a firm trial date, and dispositive motions have come and gone if there is some prospect out there of it. I also only do agree private mediations and don’t want time wasted (defendant’s lawyer had to call me beforehand and have a good faith discussions and he had to tell me the numbers he’s recommending to his client to make sure it’s not a waste). Just my take anyway.
21:00 Excellent video. However, I firmly believe there must be a time limit on the mediation. I would say it depends. It doesn’t have to take long. Prepare documentation prior to showing up and prior to being on the clock. Recommend making 3 lists: 1) what I want; 2) what is negotiable; 3) what is absolutely nonnegotiable. Obviously, the money 💰 on the clock is not an issue to the attorneys. It IS for the clients. Thank you so much for sharing.
In a civil suit with my former employer, big corporate. Nearly two years on this case. But my attorney has so much evidence and validated points that she wasn't done with one of the depositions on the many employers she's depositioning this pass Friday 4. Now my mediation is on the 9th next week. My attorney still haven't finished Friday depo and has 1 to go. If no settlement trial August 4 for sexual harassment, quid quo pro, sexual assault, sexual battery, retaliation, wrongful termination, gender discrimination and more. Gosh I hope this settles because after getting fired I'm in my car and need to get a home to sleep in. I was nervous but this video helped calm them.
I’m being forced into court ordered mediation in 3 weeks for a small claims diminished value case. They’re making me pay $400 just for the privilege! Well I have no intention of settling. My case is solid and my documentation is above reproach. I’m looking forward to humiliating the insurance company in front of a jury. So at mediation they can either pay me what they owe or we can go to trial. I’m not coming down
@@DuttyBoukmansToe well my State forces mediation by State Law. So there’s that. And while most of these types of cases don’t go to trial, it is all completely in the hands of the Insurance company. If they want to make you fight to get your money then all they have to do is not pay and there’s nothing you can do about it. The only option you have is to go to trial. And that’s what happened in my case. The insurance company decided up front that they were going to make me go to trial if I wanted to get my money so they refused to even read my appraisal report or negotiate in any way. Because they know they can win 99% of the time just by forcing you to sue and go to trial because it’s such a hassle and expensive so most people just don’t bother.
I' m with you Steve! My documentation is above reproach, along with the unconscionability of the entire situation. If they want court, let's give 'em court. They wanted to humiliate me and make me homeless with a lie and eviction, after causing me to spend all my money because of their lies about repairs. Still devastated but not DEAD!
Thanks great video I have a mediation coming on July on a wrongful termination lawsuit hopefully I get enough so I can face this economy can't get a job on a same pay I was earing 27.61 before now its 21 can't put a food on a table it was a wrongful terminated as per your experience how much will I walk away with

my mediation was personal injury my lawyer did not help at mediation i had to do all the talking to the mediator he was not helpful at all i was struggling with pain from the accident went on for 7 hours i had to quit and settle for less after 13 years i suffer still in pain i picked the wrong lawyer
Well I filed for my apartment building class action in May and they finally got it in August but at the end of August my lawyer stopped communicating with me the night before the first settlement court date or mediation I was texting my lawyer he didn't tell me anything he was ignoring me then I found out that it was a court date for the first one August 29th and he never told me nothing and I went to The Courts and told everything and now he's getting mad at me because I told on him and I'm on my third court date of the mediation for the class action settlement which I'm on there with somebody else I have to find out the case number and everything by myself actually the third court date going to be on Zoom November 15th next week and I don't know what's going on my lease is up at the end of this month so they're not going to renew it so I have to find a new apartment in December and he just my lawyer's just not talking to me right and he's putting it on me like I'm going to lose the case cuz I keep talking to the courts but he's doing things and not communicating with me so I don't know if the settlement go wait till I get out the apartment at a settlement because it's for the two years I've been here and my lease is actually up at the end of this month so I don't know what's going on
I just went through mediation and it was a complete joke.I would have come out better tossing the 2500.00 out of the window,this occured in Mississippi.The mediator trys to force you to give up more than you are willing to give up.

After being struck by a drunk driver, in DC while picking up a Lyft customer, in 2020 and undergoing more than 20 surgeries after 19 months and having more surgeries coming ahead, it is a good idea to go to the mediation ? Or a trial will help much more better when it comes to settlement.
I am in a wrongful termination case, why is defense delaying to provide supplemental responses (2 times already) and also can a you skip deposition and go straight to mediation?
What if it’s too soon for meditation and too low of a settlement amount in a “permanent injury to multiple body parts” personal injury case? How can a person just settle for a lowball claim?
I mediated a case back in 2014 it’s now 2022 the case was against me and but I did not agree to paying anything just to remove myself from the promises but now they’re saying that I was supposed to pay what do I do? They want 6k from me
Mediation point by whom? Why my mediation take my money and stand for the other landlord side. He did not listening to my point building landlord lie and many building violation he said if I don't settle I will lose the case.
