I live in Illinois, which is a stop and I.D. state, but i'm still not clear on what that means. An officer still has to suspect me of a crime before i give identification .. correct ? Would love to see a whole episode of content on the subject and scenarios.

Not sure if you can cite the department for littering but he certainly can give the officer a personal ticket for littering. They aren't above laws to protect nature just because they are cops.

That’s exactly what I was thinking. If he was seriously concerned about it possibly containing a bomb, wouldn’t he have called for a bomb squad to come out and make sure the surrounding area was evacuated?!? Obviously he was just searching for something to post-justify his initial contact.

My brother-in-law went to school with officer Stochi. He said he was picked on in highschool and was a loner. So that being said it makes sense that he is using his badge to assert authority on people that remind him of kids in school that picked on him.

@@Meng776 Legally, they can ASK anything they want. it doesn't mean you're required by law to answer their questions. Just remember, for every bully cop like this one, there are thousands of good cops. But as more and more people record and report the bully cops, the rest of the cops start acting better over time. My brother is a retired cop and he was (thankfully) a good one. I rode with him one day and he arrested a guy for DUI. When he was dropping the guy off for booking and talking to the magistrate he had counted the incorrect number of steps taken by this intoxicated suspect. A minute later we were outside the magistrates office and I told him I counted fewer steps and he looked at me and said, "Oh, really?" and then stuck his head back into the magistrates office and corrected the count without hesitation. And just to make you laugh, my brother also almost shot a cardboard cutout once. He responded to a convenience store (7-11 sized place) for a breaking and entering and while clearing the store he came around the end of an isle and there was a cardboard cutout right in his face and the cutout was standing about how you would expect someone to be pointing a gun at you. It startled him so bad he said he almost shot it, then he just started laughing at himself really hard.

@@Troy-Echo I know some cops are good. Heck, some are remarkable. But there has to be a way to remove the bad ones. The culture hides the bad ones. Cops have too much power imo. Their jobs need to be simplified and their power needs to be lessened. People see them as the solution to everything and they can't be.

@@Meng776 They need to put them back into training and remind them that they are there to protect and serve, and not bully or try to talk people in circles until they say something that will allow the top to escalate the stop. And then those that do not learn their lesson need to be demoted as a last stop, and if they do not straighten out, fire them. My brother was in the paper multiple times for being an excellent deputy, but his supervisor kept trying to find any way to get him fired, just because my brother married his ex-girlfriend. He took one guy that misspoke and my brother ended up in court defending himself against his supervisor, and defending himself, made his supervisor look like an idiot. The sheriff noticed and it wasn't the first time he saw this action and the supervisor was moved to a supervisory position with NOBODY under him. I'm not sure what happened after, but the sheriff sent my brother to work with the DEA for about 10 years, except for the week or so he was pulled back for the DC Sniper which was in our area. Sorry, I'm tired and rambling, but you're right, they do tend to stick together more than they should. They need to watch complaints and if they get a set number of valid complaints that are justified, they need to take action. But on the flip side, people live under the protection of the constitution, and never take the time to learn what these protections are, so a cop can talk people in circles and if people don't know and understand their rights, they will screw themselves over. People also need to educate themselves.

@@DarkInstinct05 I would say anything found in that search wouldn't be used in a court case against the accused but if this was not videoed by the accused, no one would believe the accused vs 2 lying cops. Hell I personally know of a time where cops deleted and edited bits of an audio recording to make the accused say something they where not and the cops 100% got away with it because the cops are the only ones with the single recording. It needs to be easier to hold cops accountable ffs.

The officer that searched the bag illegally was looking for anything possible to get back at this citizen that knew his rights, likely hoping to have some evidence to detain/arrest him. I would sue. Easy open/shut case of rights being abused.

A case may be open and shut but the cost of obtaining council, missing work/family time and going to battle with police unions/juggernaut beauracracy makes litigation almost impossible for an everyday citizen. And cops know this.

@@SonoftheWars I would suggest a different approach - attend a lower criminal court (such as where they handle DUI arrests), hook up with a lawyer (maybe per case paid public defender or cutting his teeth on lunch money suits), file a case, and take the early settlement offer.

I got questioned by a detective once on the side of the road, being accused of something I didn't do. She kept asking me why are you so nervous? I explained that I've seen numerous examples of people being wrongfully convicted of crimes and later exonerated and I was scared of going to prison for something I didn't do and she just rolled her eyes at me like that doesn't happen. It was insane. At one point I told her I knew our conversation was voluntary and I knew I could leave at any time and I was just trying to give her my alibi so she would leave me alone then she started acting much nicer. Looking back on it I still talked way too much, but she sure acted much more respectfully when she realized I knew my rights.

@khlkhjhlk Exactly. I tell people all the time that if you're having a conversation with LEO, they're doing an investigation, ALWAYS. Even if you had good intentions and felt the desire to offer LE an alibi that alone could have been enough for the LEO to conclude in his/her investigation that you're suspicious because you felt compelled to offer a alibi or could be interpreted as you had a alibi readily available in case you were questioned. For LEO to question your involvement to begin with LEO were, in fact, investigative in their conversation with you. Consensual conversation is just as harmful, and you should always invoke your 5th before you invoke your right to stay silent!

If he was a scientist and he has explosive material in his backpack and that's why he set it down while riding, they could be in deep trouble if that thing explode and it would not be his fault. The casual nature of the officer when handling the bag implies that he knows that he is not in any danger but salivating to catch a would be criminal that refused to give up his ID.

@@jy9291 are you serious? Did you watch the video? Those cops weren’t there to correct fowl behavior. They were there to be assholes. The guy was practicing riding his bike on school grounds. What better place to learn than at a school. Especially after hours... the second the citizen showed some knowledge of the law, the officer went straight to intimidation by unlawfully detaining and then blatantly misconstrued the law to implicate him in littering. They deserve to be fired.

I'll tell you this growing up I did not care to know about my rights and freedoms, would have gladly given them up to allow for police to investigate. Watching these videos now has helped me better understand the law, and to look into state law to better prepare for a potential police interaction. Hopefully those garbage cops will eventually get weeded out

According to the cop's logic, anybody parking their car in the lot and walking away from it lost their right to privacy in their vehicle. It can be considered "abandoned", according to the cop's logic. And we hear it over and over again "We need to know who you are.". That's the last thing they need to know is your ID. They should establish a crime has taken place first and ID last, as IDing someone will not tell you if they are committing a crime (other than being wanted for warrants, which generally has nothing to do with why they are interacting with the subject, it's like catching criminals by accident).

I think the abandoned doctrine would more apply to an example : the Hunter Biden laptop that was left at the repair shop for more than a month after they called him multiple times telling him it was fixed. I think this would be considered an abandoned effect.

Most shops have a policy about how long they will hold your computer after it’s repaired that you agree to at the time you agree to the service. W/o the contract the shop would likely find that the law would require they hold the property for a number of years before they could dispose of it.

If a US police officer asks for ID, ask whether that's a request or a demand. If they say it's a request, refuse. If it's a demand, plead the 5th amendment and DEMAND Assistance of Counsel for your defence as per the 6th Amendment. Note that it MUST be a DEMAND - saying "I want a lawyer" or "Shouldn't I have a lawyer present" is not sufficient under the laws as they exist right now. If the cop asks why you want a lawyer (and they'll probably phrase it as a want rather than a demand so they can dismiss it), point out that they only have a right to demand your ID if they suspect you of criminal activity and (if you remember) cite Brewer v. Williams, 430 U.S. 387 (1977). "An individual against whom adversary proceedings have commenced has a right to legal representation when the government interrogates him." Then repeat your demand for a lawyer. This probably won't work during a traffic stop because while a cop does need a reason to pull you over, you are usually required to provide it along with registration and insurance documentation to the police officer as part of the stop. But this line of reasoning should hold up if a cop stops you while you're just walking on the street, for example. And if enough people do that, then maybe it will stop the cops from almost automatically demanding ID from people.

I've had the opportunity to live in a few countries in my life time. And I would agree with you. American has in my opinion the best structure for policing. Marshalls, Metro/City, County, State, Federal, Sheriff's with Sheriff's being the highest enforcement office in the land, as Sheriff's are elected officials and can deputize under the constitution. But yes... All of the other countries I have lived in train their officers far better. 2 years in a police university, then 1 year on supervised duties from a sergeant or above until they are a police officer. In America it's lucky if they receive 6 months of training.

Whether this officer sees “suspicion” wherever he casts his eyes or whether he just has a hard-on for bikers, his conduct demonstrates a fundamental misunderstanding of the proper role of a peace officer. Once the biker began inserting his rights, the officer’s overly inflated ego and sense of power took over, and he was going to teach this biker a “lesson” about who is “in charge”. The police unions need to be abolished alongside many of the police perks most notably "qualified immunity" before anything is going to change. Mayors can but highly unlikely do anything about cop issues. Mostly in smaller counties the police holds way to much power for the authorities to do anything about it. In this case at max the mayor can ask the chief of police to investigate the issue as that is the only person that actually can induce consequences on these two cops. But it likely will be another case of "We investigated ourselves and found we did nothing wrong".

Mr Shared was there to practice riding on his ( probably) new motorcycle. It was the act of a responsible citizen to ensure his own and the safety of others on the road. My dad began teaching me to drive in the large deserted parking lot shared by two schools. Instead of commending Mr Shared for being a responsible driver the police harassed him. Their suspicious concerns were desolved when he told the officer what he was doing, after that they started making things up.

if there is NO "absurd results doctrine" in Michigan, another states established Doctrines, and even federal doctrines can be invoked in appeals court as "a matter" of law. Sometimes even fuedal times laws are used as a standard, especially in tort law, even treaty's and common law from foreign countries can all be evoked and suggested as standards for American Law. "the spirit" of the Law is a real "thing" too, and is very similar to the "absurd results doctrine".

I have watched a lot of these auditor videos and one thing is painfully clear is the cops are actually very ignorant of the laws they are supposed to uphold and that needs to change! Auditors have opened our eyes to this fact! And I thank them for bringing this to our attention!

I disagree most cops know the laws and your rights. The average person does not know their rights and laws. When a cop asks for something or tells them what to do the average person listens and obeys. Cops are so used to it of course they try to enforce non laws and violate your rights. Those that challenge the cops on a non law and a rights violation the cop gets upset. This video is a good example.

What do you expect? They do 6 months at the academy, maybe a year with a training officer. A hair stylist needs 2-3 years of training before cutting a customer's hair.

Abandonment is a matter of time and distance and indifference. Neither of these things occurred in any appreciable amount that would cause a reasonable person to believe that Mr shared is intentionally or unintentionally leaving his bag behind because he's going nowhere to believe anything behind anyway

When we were in lower school, the bois always played a prank saying we littered when we placed the school bag on the floor due to heavy weight. but after a while we lost interest because we thought it was quite stupid. Glad to see the that such prank is now being taken seriously by law enforcement

I've never seen anyone throw away a bag that is in that good a condition. Who wouldn't place a backpack on the ground. It is not like he threw McDonalds wrappers all over. These two idiots are more examples of the low caliber people that are hired. If you look into their background there is almost certain to be "nepotism" , they have or had a relative in the same job. This is the same with firemen. And this accounts for why for a century no African Americans could ever get hired as acop or fireman or any other DPW city job. White people "only".

This was my very first assumption based on the premise. Any reasonable person would come to a similar conclusion first, and not jump to wild conclusions. This guy was way off base. There may be exceptions. Sunglasses give a tactical advantage. Cops need to be attentive on their job, so getting blinded by the sun is not acceptable. And when the weather is sunny, naturally most of them would be wearing shades.
