Info ON Blakely Factor:
The discussion was over the "Blakely Factors". Blakely is when the prosecution wants an enhanced (greater) sentence than the normal sentencing guidelines.
There are TWO Blakely factors submitted by the state:
1- Defendant posed greater than normal dangers to other people as she fired into the vehicle
2 - Potter abused her position of authority as a license police officer in full uniform.
State says defense agreed to have a "unitary" trial, meaning the jury would also hear about the Blakely factors. Defense said they never agreed to that and they want a "bifurcated" trial. Judge grants that. This means:
Bifurcated means to separate this issue from the guilt phase and the JUDGE will decide on the Blakely factors when/if there is a conviction and will solely be up to a judge to determine if the sentence will be enhanced.
MOTIONS:
Potter prosecutors filed two motions today after the problematic testimony from Mychal Johnson on Friday.
1 - Motion to keep defense from eliciting expert testimony from non-experts. (remember Johnson testified deadly force would have been justified)
2- Motion to permit State to elicit testimony related to union membership (Potter was Union president at one time) for the purpose of establishing possible bias in various law enforcement witnesses
Charges: Note: Both prosecutors and defense agree the shooting was an accident but prosecutors say her actions were criminally negligent.
First-degree manslaughter (added in Sept.) - “recklessly” used a firearm - causing Wright’s death. - Up to 15 yrs in prison - In Minnesota, a person can be convicted of first-degree manslaughter if they cause the death of another while also committing a misdemeanor - in this case, reckless handling of a firearm.
Second-degree manslaughter - requires that prosecutors prove only that the defendant acted with "culpable negligence" as the defendant consciously took actions that created an "unreasonable risk" of causing death or great bodily harm. - Up to 10 yrs in prison
Former police officer Kimberly Ann Potter, 49, stands trial for killing Daunte Wright, 20, in a disastrous traffic stop. Potter’s attorney has also said that she will testify. You can watch jury selection in the player above. Opening statements are scheduled for Wednesday, Dec. 8.
There is no dispute that Potter fired her gun. The question is whether Potter’s actions constitute first and second-degree manslaughter under Minnesota law.
As seen on body cam video from April 11, 2021, officers with the Brooklyn Center Public Department pulled over Wright for a traffic stop. Officer Anthony Luckey began to handcuff him against the driver’s side of the car. He suggested Wright was about to resist.

I'm in the trucking industry, and in believing that Dr. Miller's testimony is so incredibly fascinating, I believe that trucking company safety departments should be listening to him and applying policies based on his knowledge to apply to better driving habits of truck drivers. This is my second time listening to his testimony, and I'm hoping that by listening to him and others, I can be safer (as a 36 year driver with no accidents/tix and spotless safety record).

More accurately in this case... Doesn't work! If you want to see how it works, study Sully Sullenberger, or the Apollo 13 story! This woman simply melted down! Either something went seriously wrong recently, or she never should have been a cop!

Potter was given a very specific command. Potter acknowledged the command, yet she pulled the gun and then shot him anyways. When did Potter have a memory lapse exactly?

The judge wouldn't let this expert witness explicitly say that a police shooting is an example of an action error. She basically decided the outcome of the trial right then and there, for better or for worse.

I was looking for an explanation of how she possibly could have confused her left with her right, and a taser for a pistol. Sure, she was under stress. However she had the foresight to say I'm going to tase you, switch a piece of paper from her dominant hand to her left, and call out Taser Taser Taser, before pulling, and firing the wrong weapon. As a drummer, who uses both hands to do very different functions, and yet perform other functions identically, I honestly can't understand how she could make this mistake. For example, I can try to keep rhythm on the ride symbol with my left hand. However, It feels so unnatural, and I'm so bad at it, it's nothing short of comical! I simply can't understand how she screwed up so badly, yet, I don't believe for a second that she did it on purpose.

I was thinking of how playing an instrument might play into this testimony right before he mentioned playing an instrument. I play sax (tenor), and can't think of a scenario where I might hit the octave key with my right thumb for some strange reason, given that I'm right handed, and might be looking at a sheet of music and then using my left hand instead of my right hand to go to the next page of music. People might look at me like I have ten heads if I tried that. OTOH, Thelonious Monk has used his elbow to hit notes before, but he wasn't making a mistake.

@@iamthenews5624 I've actually watched several hours of the testimony which included a lot of the video clips from the incident, since I wrote that OP. Given her reaction after she shot him, combined with the unexplainable screw up, I have to wonder if she's on medication of some sort. In addition to her over the top histrionics, her immediate reaction was all about her, with no sign of empathy for the kid. I have to believe that didn't play well with the jury! She either wasn't well at the time, or should have never been a cop!

@@carlwilliams6977 She is Bipolar 3… It was an Action Error.. She had Tunnel Vision; She was hyper-aroused… panicked, afraid…. And so she pulled the gun which was her default… After, she pulled the Trigger. She meant to pull the trigger, she knew exactly what she was doing because she was “ in the zone.” After she fired, she was “out of the zone” and she freaked out because she could not believe that her default behavior and automatic response overrided the command she was given. She wasn’t negligent, she doesn’t even know that she is Bipolar 3… It’s not her fault.. We need to stop being ignorant and incarcerating neurodiverse people….xo Bipolar people make Action Errors all the time… It is a trait because we tend to be hyper-aroused; hyper-focused and highly anxious and panicked and so we may go to our default position when we become overwhelmed… because we are unable to be mindful as we are doing it. Does that make sense?

@@iamthenews5624 If you're diagnosis is correct, what doesn't "make sense" is that she was a veteran cop, and had never made a bone-headed move like this before! Not to mention, Don't you think she would have used your diagnosis as a defense? I mean, she (and her attorneys) had to be wondering... "How could I have possibly made that mistake? We should ask a psychiatrist!".

This is the most ridiculous defense I have ever heard. If this defense was allowed then all negligence type offence would be thrown out. A police officer is given tools. They are provided extensive training on their operation and when they are authorized to use them. Do you think police would allow this for vehicle operators who make action errors in traffic and get away with it when they kill someone. Imagine the truck driver after a long day who falls asleep at the wheel and causes a serious traffic accident killing others. Imagine your operating your vehicle and you come to stopped traffic and try to apply your brakes but in the rush to do so you hit the gas instead causing a collision. Imagine you're turning left in heavy traffic with a truck partially blocking your view and you turn and into oncoming traffic causing a collision. Aren't these all action errors that people are held responsible for every day. Driving a car like carrying a gun and taser comes with great responsibility and you are responsible for your use of these. If we want to talk about action errors let's talk about Dante Wright. Using his argument the action and poor judgement used by Daunte Wright could be considered action error but he wasn't given that benefit. In my training we practiced often to develop muscle memory so that you were prepared for emergency. I could unholster my firearm in a second without looking or thinking about the two levels of security that were required to be done to unholster the weapon. The same comes with selection of weapon. In my training we also discussed the importance of mental preparation. In down time we were encouraged to consider events we night encounter and how we would handle them. Maybe he should have included a review of the sloppy arrest in this situation. They should have taken him to the back of the car for arrest and two officers should have been involved in the arrest for proper control during handcuffing. The third officer should have removed the female from the car since they were apparently concerned about her safety. If they were so concerned about weapons in the car can someone please explain the nonchalant approach to the arrest with their weapons in their holsters. This guys got to be kidding. The weapons are different colors, have different weights, are carried different and have different release mechanism, have different trigger pull. These are all acknowledgements of potential for error and those items along with training are designed to prevent errors.

Ludicrous testimony from this guy! if a cop does not know a TASER from a GUN nor the FLASHLIGHT from a BATON, that person truly SHOULD NOT be an authority over LIFE or DEATH. since the video shows she killed him, why not work out a deal and serve the time she rightfully deserve instead of putting on this terrible display.

Miller your arrogance and contempt for the prosecutor judging by your attitude , proves that your training is not efficacious, that your are arrogant, and that you're are NOT going to destabilse the Lady prosecutor. She's been found guilty anyway and Ithink you'll have to lear respect for other people.

IMO, whether she 'remembered' saying anything doesn't matter one bit because it's on POLICE BODY CAM footage that it's a fact she said certain things that 'can and will be used against you in a court of law. period. Again, imo, his testimony IN THIS CASE, probably won't be the tipper of not guilty or guilty. Are you clear? Oh, anyone YOU disagree with is a clown? Hmmmm. What is YOUR motivation to say that. You 'thought' and interpreted my comment a certain way that YOU didn't agree with so you made a determination of my character based on incomplete information about me? Gotcha.
