The FTCA Judgement Bar is supposed to act as Res Judicata to protect the Government Employee after a proper lawsuit against the Government but the Supreme Court in Brownback v King endorsed Clarence Thomas' opinion that *even a dismissal for lack of subject matter jurisdiction* can trigger this judgement bar against any other lawsuit. Whether the same lawsuit against the employees can continue remains to be seen.
