But Congress may by a vote of two-thirds of each House, remove such disability. Nowhere in this text does it say one has to be charged. I highlighted the important part for you with capital letters.

@@infledermaus You might want to continue reading that constitution that you love to quote of section 3. Section 5 of the 14th amendment. "The Congress shall have power to enforce, by appropriate legislation, the provisions of this article." Congress is the only power to enforce the 14th through legislation. Not the states, not the secretary of state, not the president. Congress and only Congress has that power. Or, can we kick Biden off the other states ballots for any reason we want, with no recourse for him to defend himself?

Congress has the authority over the 14th amendment enforcement through legislation. They can pass laws to enforce the insurrection clause. Not the secretary of state of Maine.

By promising to pardon Trump, and insurrectionist, both Ronald DeSantis and Nikki Haley have given aid and comfort to an insurrectionist, and are likely now in violation of section 3 of the 14th amendment. As a result, arguably, Ron DeSantis is no longer the governor of Florida. Note the language of the amendment. Ron DeSantis was a congressman. He swore an oath to the Constitution as a congressman. He is subject to the 14th amendment. In my opinion he has now given aid and comfort to an insurrectionist. I believe that under the terms of the 14th amendment he is no longer authorized to serve in any state or federal office. I believe equally that Nikki Haley is now barred from holding any state or federal office. She was a sworn officer in a lrevious administration. That too makes her subject to the act.

If a bank manager attempted to rob his own bank, no would consider reappointing him as bank manager. To declare that Donald Trump is qualified to run again would be insane. Section 3 of the 14th amendment makes that very clear!

A much wider application of the 14AS3 must be applied. Trump was not alone in his efforts to retain power extra-constitutionally. The 14AS# is not limited to the Office of the President of the United States of America.

I watched an interview with an U.S. historian who described the details and the month's-long debate, and the men involved, that ensued in writing Amendment 14, Sec 3. to make it as clear and airtight as possible so people just like Trump and his followers could not wiggle out of this LAW! Very enlightening and educational. This should aired more often. The author's of Law were extremely serious for such a time as this.

Amendment 10 to the Constitution makes it clear that any powers that are not specifically given to the federal government nor withheld from the states are reserved to those respective states, or to the people at large. So, each state may act based on their own balloting laws, even for federal elections. If nothing else, 45 will force more Americans to learn about their own Constitution.

Actually the power to control the elections is Specifically GIVEN to the states IN the constitution, so it is not only not withheld, but given to them. Congress CAN change it, but they must actually take action to do so. Much as they did with the civil rights voting act, and what are the chances anything can make it out of the current republican snafued congress? I would not bet on it for anything atm, they like their breaks and not getting anything done.

As a nation, I think we collectively are starting to realize how our education system may have been insufficient after all these decades. Although our teacher was a nice person, the course was boring as heck. I learned more about the Constitution from a history class. That history teacher was phenomenal.

"Let the people decided" is not a very good argument. Specially elected or selected people are ultimately responsible for who is on the ballot and who wins the Presidency. So, states should stop pussyfooting around and 100% kick Trump off the ballot based on the 14th section 3. It's each state's individual right!

There are only four restrictions in the constitution and amendments on who can be president. A natural born citizen, lived at least 14 years in the US, be at least 35 years old, and not have engaged in an insurrection after taking an oath to support the constitution. You must meet all four. It's not three out of four. If you believe in following the constitution you believe a president must meet all the qualifications listed in the constitution.
