With President Joe Biden issuing a flurry of executive actions last week to strengthen federal gun laws, state representatives across the country are working in the opposite direction, taking a page from the playbook of immigration activists by advancing legislation that would make their enforcement illegal. On April 6, Arizona Governor Doug Ducey, a Republican, signed the first gun control nullification bill into law.
"Nullifying unconstitutional, federal laws is both legal and it's also the right thing to do," says Anthony Sabatini, a Republican lawmaker and member of the Florida House of Representatives. "It's silly to sit around and wait for something you know is unconstitutional," he tells Reason. "It's time to stand up and fight back. And the methods that we need to use are the ones already being used by the left."
In 1987, Oregon passed a law prohibiting state and local law enforcement from using public resources to arrest or detain people whose only crime was being in the country illegally. Since then, hundreds of other jurisdictions have passed similar laws, becoming so-called sanctuary cities.
Conservative activists are employing the same strategy. While Arizona is the only state where such a bill has become law, elected officials have introduced similar bills in more than a dozen statehouses.
"We know this stuff has been working and the right can continue to complain about the things that the left is successful at, or they can look at it, learn from it, and replicate it," Michael Boldin, the founder and executive director of the Tenth Amendment Center, tells Reason.
Sabatini is cosponsoring a bill in Florida called the "Second Amendment Preservation Act" that would prohibit any employee of the state of Florida from enforcing, or attempting to enforce "any federal act, law, executive order, administrative order, court order, rule, regulation, statute, or ordinance infringing on the right to keep and bear arms ensured by the Second Amendment."
Defying federal law is something that a majority of states already do in one way or another, by becoming immigration sanctuaries or through the legalization and decriminalization of marijuana and other drugs that federal law still deems illegal.
"In terms of the method it's identical," says Sabatini. In sanctuary cities, "they stopped reporting to or dealing with I.C.E., and that's basically what we're doing."
Boldin says that for the nullification movement to succeed against gun control laws and beyond, more Americans will have to recognize that the most effective way to oppose federal policies that violate their rights is at the local level.
"The whole idea of federalism is so important because it's the only way you can have a country with a few hundred million people living together with a wide range of social, economic, political viewpoints together in peace. What's right for people in California is probably not right for people in South Carolina and vice versa. And when we see things that come down from a one-size-fits-all centralized solution, I don't think anyone really ever gets what they want."
Because 36 states have nullified federal marijuana prohibition, Boldin argues, there's mounting pressure for the federal government to follow suit. "I think we can replicate that on other issues and learn that localism is really the way forward for liberty."

The right to "keep and bear arms" does not limit the citizen on how to "keep and bear arms" nor does it limit where a citizen can "keep and bear arms". Any "constitutional carry" is less than successful if citizens are not permitted to "keep and bear arms" in every venue that is currently off limits: public schools, local, state and federal government buildings, and so on. Everywhere a government agent carries a firearm, a citizen should also be able to do the same.

The right to bear arms is an archaic amendment which has NO place in todays society. It was ok when before the US was created for citizens in the "Wild West" to defend themselves. Today it creates a divided country. Guns need to be in the hands of government services - Armed forces, National Guard and all police forces - NOBODY should be allowed to 'go hunting'🫣 equipped with type AR 15 automatic firearms. If the government would be serious to keep all firearms out of the hands of criminals, it would legislate the severest form of punishment to effectively control the guns. I realize that would put the NRA out of business, it may not prevent criminals of obtaining firearms from other sources, but hopefully there would not be any more deaths to young kids or other innocent people I don't know of any other country that is so negligent about firearms.

That's why they'll get our guns first, an inch at a time, so we'll never try to take their power. They know all they have to do is keep from any sudden and big move, and we'll wait for them to do that while they hit us with small infringements, too small to be worth fighting in the streets over. They know what they're doing and see us coming 20 miles down the road. They're much smarter than anyone on the Right wants to imagine. They've focused their efforts on psychology and group think, character destruction, and ways that go much deeper than mere infringement of rights. They know how to manipulate crowd feelings and have you expecting one thing while they do another. They also specialize in idiot control, and they have the majority of conservatives now convinced that "violence never solved anything", so they can use intimidation and guilt tactics that other conservatives will enforce for them. The biggest sign that they've won control over conservatives is how overly resentful of Trump so many were. These laws even have clauses where ATF agents trying to enforce federal gun laws in these states can be arrested and prosecuted. Now, that probably would be difficult to do but it shouldn't be. Anyway, my main point is there are more states that have passed federal gun law nullification than this video mentioned.

I'm a responsible gun owner and unfortunately live in a heavily restricted state. I think the problem is when regulations doesn't make sense not regulation in general. I work with a few people that should not have a firearm till they have an epiphany and gain maturity and common sense. Laws won't change that. Mental health is also a joke in this country. We are not going to spend the money to fix it. It should be a right to defend yourself every where. That should be an element truth upheld by the bill of rights.

@@ponraul1221 Unless the state makes it legal for all citizens to to defend themselves against police who attempt to enforce gun control and possibly even cutting off funding for that station all together until they comply. Meaning the police simply have no legal protection when enforcing gun control policies. So if you can prove that you killed or injured a police officer attempting to enforce gun control, you will be protected and will be let off the hook. This would embolden neighborhoods and also keep the police accountable, in fear of being shot with no legal protections. The only reason police are willing to do what they do is because they have the state backing them, once they lose state backing then the police are going to fall in line in order to survive.
