correct me if I'm wrong but in case of mortgage by conditional sale, there is too a right of transfer of possession as here the mortgagor ostensibly sells the mortgaged property which as per section 41 is valid as stated by privy council in the case of Ram Kumar koondoo vs. Macqueen, 1872.
Sir agar koi bank se loan leta h aur ghar khareed leta h aur time pr nii chuka pata h toh kya notice dene ke baad,recovery ke liye bank with the help of police uss ghar ko sheel kar sakti h, aur usse khud kisi aur ko bech sakti h ?
But the sale is not allowed if the mortgagor of mortgagee belongs to the Hindu, muslim or Christian class or to any class as mentioned in this behalf by state govt.
