Hello sir i just saw ur video amd i have a doubt in ur last vidoe u have made chart on which u said in English mortgage sale can not be done. But while teaching u said that mortgagee can't go for sale only in conditional and usufructuary so what about the English mortgage... He also much not have right in English sale as well...
Hi there English Mortgage in iself is an absolute sale therefore decree will not be needed from court. whereas in Simple and Title deeds sale decree is required as said in the video.
The section contains (before) to which two conditions are imposed that is ( before decree or before payment is made) before is to be read with both the things as (or) is used in the section. Hope it helps
