We still don't know what the full impact will be of the Sitzer/Burnett case, but one thing is pretty obvious at this point - there are dramatic changes coming to the way homes are bought and sold here in the US. As brokerages continue to distance themselves from NAR, there will likely be a void in rules and regulations leading to some scrupulous agents taking advantage of both buyers and sellers. This will drive many agents to leave the business entirely and by default reduce competition - which is the exact opposite of the stated goals of the lawsuit. Stay tuned for a wild ride...

Loser is sellers that don't understand the business and low tier agents struggling to make a living. Builders will continue offering 4%-10% commissions with partial payment up front and steal buyer pool. Resale angry sellers will create an even more complicatesd system for themselves. Let them get their wish. It pays in life to spend a few extra dollars and get good people around you from medical property legal etc.

Sellers will quickly realize that it makes sense to have a represented buyer on the other side of the transaction - it makes the whole process go smoother AND greatly reduces the chance of a property falling out of escrow due to unqualified buyer. Hopefully, even without clear cooperation, sellers will continue have the opportunity to compensate buyer agents on behalf of the buyer. We'll have to wait and see.
