In some places you have to build a certain distance from the property line without some kind of permit or unless you get the other person to agree to sign a variance. With the complexity of real estate laws it may be different in some place. In some places Mr. Johnson may be considered to be a criminal depending on how the law handles it. They may in some places make building on someone's property without permission theft of the land and a felony of some degree.
