I Live in a HOA development of 15 semi-expensive homes. All the residents are members. If you want to make a major change to the exterior of your property you have to run it by the HOA(or not😁). No one has been turned down and everyone is too busy working to get caught up in any drama. Basically, we pay a small fee annually to maintain the development sign, that's it. No rules about flags, lights, landscaping, yada, yada. There's plenty of city ordinances to keep property owners "in check".

People do it, because some people have had ignorant neighbors that do stupid stuff to ruin it for the whole neighborhood. Look up music artist Chris Brown. He lived in a gated community, and he decided to paint his mansion in ugly ass graffitti art all over the house and property like the drive way. His home looked like a crack house. Who wants to live next to a person like that? Unfortunately some people just don't have any common sense and like doing stupid useless shit that creates an eyesore to the community.

I’m a Palm Beach County retired Judge. Back in the late 1980s and early 1990s, I lived in a small waterfront community. We had a strict HOA with lots of stupid picayune rules. After getting some stupid HOA complaints against me, for things like having a boat in my driveway, I got together with some like minded neighbors and got enough votes to allow me to rewrite the HOA bylaws. So I wrote up the greatest HOA bylaws imaginable, and got my buddy, a smart lawyer to have them recorded. No more HOA Nazis and silly rules about the color of our front door or the number of cars you could have.

HOA Rule #1....... Don't. Its the only rule I need. Never, Never, Never. My Property is exactly that, MY PROPERTY. Common courtesy dictates decent curb appeal. Beyond that, it's none of anyone's business. EDIT, Y'all seem to be misunderstanding what I said. I'm not talking about keeping your yard neat, cutting the grass, or not collecting derelict vehicles, all that falls under the Decent Curb Appeal I already referred to. My objection to HOA's is because some busybody who ain't paying for my house thinks they can dictate what color I can paint it. What kind of vehicle I'm allowed to buy and drive. What kind of trees I plant. So as long as I have Decent Curb Appeal, It's still MY PROPERTY, Still Nobody's business but mine. And STILL doesn't change my first and only rule for HOA's.........Just Don't.!

If a municipality truly has the interest of residents will control the problems that people sometimes fall into allowing their property to become a sore sight. Many rural communities have ordinances to keep lawns clean and trash picked up on your property.

The HOA has to exist because the public areas of these subdivisions are actually private common property, they don't belong to the city. Consequently the city is not going to maintain them unless they are paid.

Thank God I didn’t buy into an HOA community…..I’m in an older established neighborhood that is lovely (yes in Florida). My Sister, however, lives in an HOA community and has been put on the “repeat offender list” for the following DASTARDLY offenses: 1. Her curbside mailbox sits 2” HIGHER than regulation. 2. She had her garage door open while drying clothes (her washer /dryer are located in the garage). 3. The gate to her vinyl privacy fence was left open while she and her husband were carrying bags of mulch to their backyard landscaping. Yes…these are the terrible offenses that prey upon the minds of these HOA ***FREAKS****

Not anymore. Now, the HOA has to send you a letter and give you 14 days to correct the issue. THEN, if not corrected, they have to schedule a hearing. If you lose the hearing, they have to schedule an appeal. If you correct the issue anytime during this process, they cannot fine you. Only if you lose the appeal can they finally issue the fine. It's about to become near impossible for a Florida HOA to use fines to extort their members. I bet a lot of HOA budgets are suddenly WAY underfunded due to the lack of fines levied.

Our HOA board is wonderful. I've yet to hear any real complaints since moving in back in 2016. Irrigation, guard gate, private road gate issues are the major problems and dead plants in the common areas.

One HOA home taught me my lesson - never again. HOAs always become a playground for petty tyrants who love trying to control the behavior of other people. I'd rather have a trashy neighborhood than one with an HOA. At least in a trashy hood one can get with the neighbors and see if there is some way to help them have a cleanup day, with neighbors helping, instead of fines, angry messages back and forth, and property liens. Anyone in an HOA has at least a couple of horrible experiences to relate, and I'm no different. Like I said, once burnt, twice shy; no more HOA days for me, ever.

I'm in one of those right now. We have a guy that rides around on a golf cart and reports petty violations anonymously to the Management company. It doesn't matter if he likes you or not. Infact he's been called out on our Neighborhood Facebook page several times. I will say 95% of our HOA are nice people who by and large just want to be left alone. Any ideas on how to handle this turd without going to jail?

Wrong. The FAA regulates the airspace...even the airspace 1 foot above your house. Privacy laws regulate the act of videoing or photographing space that would be considered private....which DOES NOT include your backyard...fenced or not. Just wait until Amazon has delivery drones hovering over your house/property and you have no say about it.

The FAA controls the use of airspace from the ground up. You cannot restrict the use of airspace being used by vehicles in flight over your property. The FAA can also prohibit you from building a structure over 200 feet tall if it is deemed to be a risk to flying vehicles, such as near an airport. If a drone is hovering and looking in your windows, peeping Tom laws still apply, but not trespassing. You can prevent your neighbor from building a structure which extends past your property line, that's the air space restriction you can control.

@@ncd9656 nope FAA governs all airspace. Homeowners do not have airspace rights a drone can fly over your property just like a plane or helicopter can. Now having said that if some creep has a drone up and they are hovering by your window trying to look in that’s a different story. And just like was posted in this video you can shoot a drone down even if it’s over your property it is a federal offense. I fly drones and do video but believe me most drone pilots have no interest in your home or property. Also cities are now using drones to check for code enforcement violations.

Been fighting my HOA for years about our personally owned Sprinter passenger van. We have my wife's band logo on the side windows. They hired a piss-poor attorney and my attorney ate them for breakfast and caught them lying and making up their own rules. We cover the logos with black window cling when parked but last year the HOA management company sent us a bill for attorney fees to have them send us another threatening letter. Turns out, it's illegal for them to bill us for a letter that was actually written by the State of Florida and the HOA board have never authorized coming after us. When we demanded the minutes from the meeting where they had authorized it, they sent us the minutes from the meeting a week prior that was 6 months AFTER they came after us. Then, the attorney negotiating with our attorney made some stupid mistakes, even admitted they were wrong, and was fired by her firm when my attorney filed with the state BAR against her. We never did sign any agreement about keeping the logos covered so, as of tomorrow (6/24) we are 1 week out from HB2103 and I will remove the covers for good. Can't wait for them to try and contact/threaten us again. BTW - My attorney is a family member that spend decades working for the state dealing with HOA/Condo issues. She knows the laws better than anyone...and costs me nothing, until they lose and have to pay our attorney fees.

You didn’t mention one of the most important law changes that starts on July 1, 2024. It doesn’t apply to only HOAs, it applies to all homes. It’s the Florida anti-squatter law. Squatters break into unoccupied homes and live rent free. Oftentimes, they do illegal activity in the homes that they squat. It can take months or years to get the squatters removed, and can cost the homeowners more than $100,000.

I have no sympathy for current long term condo owners who's mgt committees repeatedly deferred major maintenance, to keep their fees low, and are now being called to pay the piper. Future owners now wont be screwed, buying into unsafe buildings, and units in poorly maintained buildings will begin to reflect their true value. The ability to game the system has been reduced. 👍

Florida is no longer for retirees. It's way to expensive (and will continue to be) to retire here. Don't give me that nonsense about "no state income tax" because all of the other fees clearly beat any income tax you would pay. Most Toll roads in the United States, HOA fees (if you lived outside of an HOA, no fees), cost of living is the same as the other top 5 states....Food, Fuel, Insurances are the same if not more and will get worse.....WATCH!!

Many HOA people are clueless as to how expensive and how NICE many pickup trucks are now a days. Yet it would be ok for people to park their old, cheap beater cars in their driveways. This anti truck rule never made sense to me. Thankfully it is changing. PGA National in PBG does not allow trucks so we have passed over many houses in there even though our truck is high end and cost more than many of the crappy cars I have seen in that hood. It's about time!

My husband has a work vehicle his entire career. When we moved to Florida we had to go no-HOA because of it. It always BLEW MY MIND that the person PAYING for the house cannot park at the house. This is wonderful news!! (Plot twist, his newest work vehicle is a plain white pickup truck with no lettering, but we have our house outside of HOA-land anyway LOL)

When I lived in an HOA there were restrictions, as in most HOA's about outside antennas. Being a licensed Amateur Radio operator I wanted to erect an antenna. After careful studdy of FCC rules and regulations I determined that there are two regulations that allow me, or anyone, to erect an exterior antenna without the HOA having any power to deny the installation. The current version of FCC Part 47.15 forbids ANY governent, public, or private agency from denying the installation of a communications antenna for Amateur Radio use. Another rule puts the same denial restrictions on a "receiving" antenna, which may be for shortwave reception, TV reception (It allows satellite antennas to be installed in an HOA), and just about anything the installer is seeking to receive from signals in the air. In my case i informed the HOA I would be raising an antenna and gave them a copy of the FCC rules and regulations relative to my letter. The feds do trump the HOA.

Sold my TH in HOA community where I lived for 13 years in Tampa Fl, renting right now for the time being. Our monthly fees were JACKED UP among other expenses like Tax and Insurance. I’m not going back to something like that again. Next home will be in a non HOA and out of Florida. Bought a small place outside the country as well just in case. I do not like what is going on here.

TH associations have some of the same issues with insurance. I'm not sure about Florida but if the HOA is responsible for roof or exterior damages, that insurance has gone up. Even rentals have similar escalating costs, which may result in rent increases.

That was the reason why I decided to purchase a home overseas, if rent gets out of control I’m am taking break or an early retirement away from this mess. In this time it is extremely important to have a plan B and not get trap in this vicious cycle.

I am from Arizona. When my wife and I looked for a home we only looked at non HOA homes because we wanted to park our trailer on side (behind fence). Man it was hard because AZ is HOA hell. There is a new master plan community where they made the driveways so short no modern truck fits. And you can’t park on street. Just insane and I refuse to deal with it.

I hear you. I'm from AZ too. The new homes do have shorter driveways if you have a monster truck or SUV it won't even fit in the garage no mind the driveway. We live in a 55+ golf community and love it. There is always bad politics with any HOA. I wish there weren't so many of them in AZ but what are you going to do?

I Live in a HOA development of 15 semi-expensive homes on half acre lots. All the residents are members. If you want to make a major change to the exterior of your property you are supposed to run it by the HOA(or not😁). No one has been turned down and everyone is too busy working to get caught up in any drama. Basically, we pay a small fee annually to maintain the development sign, that's it. No rules about flags, lights, landscaping, parking, curtains, yada, yada. There's plenty of city ordinances to keep property owners "in check".

There is an HOA in Albuquerque NM, where we average only 9 inches of rain a year. In order to conserve scarce water, our city began giving water rebates and encouraging xeriscaping . The HOA required a certain amout of grass, and fined owners who converted to xeriscaping. They lost in court, but it was a big case, lots of fighting by the HOA..

Sooo…….you are telling us you are just fine with potential buys for your house turning around and leaving because they guy at the end of your street has an old fishing boat loaded with bags of garbage with a couple of them also under the boat? You OK with a neighbor controlling your ability to sell your house for top dollar? Glad you don’t need equity there bub but most of us gotta get every dollar we can when we sell. You can always go down there and knock on his door and ask him to please clean up his property but why should you be put in that position to deal with that?

Good video. I really appreciate you guys that take the time to enlighten us. HOAs have way too much power, and always have. I don't want to get too detailed here, but when I was living in Las Vegas, there was a disagreement between a couple of neighbors regarding a behind the house addition that blocked their view. The HOA simply did not know what to do. So they hired a bunch of lawyers on our dime. Long story short, the neighborhood of 46 homes was so divided, we didn't wave to each other anymore, there was so much fighting going on. Here's a situation where the HOA really didn't understand what the CCRs entailed, so they hired lawyers to try to decipher. It was a disaster that cost us literally hundreds of thousands of dollars.

Totally unnecessary. The HOA doesn't really regulate construction/additions. This is a city/county issue with building permits and such. Neighbors that disagree with the addition plans should talk to the permitting department. HOA should stay out of it.

In Russia HOA doesn’t have authority over homeowners, your property looks the way you want it and HOA has no right to fine you because no rule has any power. It’s all voluntary . Also there is no code enforcement ( very few codes exists but there is no government agency to check and enforce) Americans sure love to be told what to do in their daily life.

I'm selling $1.3M home in a gated community and a lot of the people living there have companies with work trucks but they can't park them in the driveway, most hide their trucks in the garage. total BS. I dont think it will affect the prices at all. The home value doesnt change one bit because there is a pickup with decals, Its such a stupid ass rule.

As a current homeowner in SW Florida who lives within an HOA. My wife and I plan on moving out of state, and we have both agreed that never again will we be living in an HOA community. This definitely will make it easier for me for the next two years until we move. I no longer have to cover my work truck and hope the night storms didn’t knock my magnets off and I get fined, which has happened before. At least my last two years in Florida will be somewhat more peaceful.

Many of the HOAs are just ignoring the law's that Texas passed and signed into law this year are acting like they have no idea they apply to them. Some HOAs in Texas are just acting like they don't exist and saying pay or get another fine! I just received a fine last week for my trash can on the curb passed the 5PM deadline. The trash company had a truck brakedown and couldn't make it. Nonetheless, I received a $100 fine as everyone else on my block. We have had it with the HOA police and are taking them to court.

I just saw this comment on HOA , let me tell you something some one should come out here to Fox Hollow Dr in Titusville, FL that the amount pay every year is $547.00 to the HOA so that you can leave your trash can out all year long and the beautiful thing about this is that you as a landlord don't get fined. Someone should really investigate this issue. It looks like a gatto place.

And regulations can anyone should check out the rules and the regulations make sure they agree with them and that the people that are happy and you're going to be happy with them before you purchase in there!!!! I’m a retired firefighter. My can would be out for a day or two sometimes. When you work a 48 hour shift, how you going to get the cans in. I also had a take home city SUV when I was Chief. I wouldn’t be aloud to have my city car in the driveway? Never live in an HOA.

I used to live in Idyllwild, it remained much the same since the early 20's. Movie stars and musicians, artists, writers and assorted bohemian types lived there from then till now. I actually lived just above the village in Pine Cove. Idyllwild is a special place, on one side of the base of Mt. San Jacinto is Palm Springs. On the other is The Hemet/San Jacinto Valley which was a gorgeous place, to live, high desert, and lots of agriculture. There is a tram-tower system goes from Palm.Springs up to Idyllwild, amazing ride. A lot of people visit and there are a lot of people who really love and appreciate it for what it has been and still is. Several years ago, there was a huge forest fire that came very close to the village, it was in July. It looked like it was going to burn the whole place down, then out of nowhere there were thunderstorms and helped put the fire out. The list of famous people who have lived there is a who's who of the famous.

$500 fine for ONE dandelion on my lawn! A $500 fine anytime I walk my service dog in my power wheelchair. This hoa considers my Pride power wheelchair! My hoa told me they override the Americans with Disability Act! I can’t fly my US Flag “because I might offend neighbors who are not from the US.” I am a 100% service connected, permanent and totally disabled veteran. I like my house, I like my neighbors, but I h a T e my hoa. I live in Alabama. But I’ve lived everywhere.

I've served on our HOA board. We are a small community. We are limited greatly here in Texas on what we can do by the laws in Texas. Our biggest complaints are usually that we "haven't done anything" about a problematic neighbor. We usually have initiated something, but we are greatly hampered by the laws in Texas.

Problem is, even a great HOA can suddenly become horrible if the wrong person/people are elected. You cannot predict the future. HOAs have WAY too much power. Florida needs to cut them down to managing common property and basic rules. The rest need to fall on the city/county code enforcement.

Too many old people on the board! My lake community neighborhood was horrible 12 years ago when I moved in. As the neighborhood grew, more and most younger families came and we started running for board seats and now it's the greatest place I've ever lived. No more worries about parking our boat in the driveway throughout summer or really anything at all! We can have golf carts or side by sides, we have parades and bands and food trucks come in. My neighbors have a bloody Mary bar in the driveway every Saturday morning. All our fees go to something fun or important now like road repair or fishing parks, or things like dredging our lake and our cornhole/pickleball/sand volleyball triathlon. Lol! 10 years ago I got a $100 fine for leaving my back porch light on all week while on vacation... Now many of us have mini fireworks displays in our yards throughout the summer and a neighborhood display over the lake on the 4th... Just gotta get the younger or more laid back families involved with the decisions and most importantly run to be on the board. Thats my personal experience and I'm so glad I didn't move in those first rough 5 years

I once rented a condo with an HOA and I owned a truck at the time. The truck was my personal vehicle, but was still subject to the same rules as a contractor - electrician, plumber etc. etc. and had to park my truck in the designated corner of the parking lot with the other trucks. If I didn't then I would be fined. They also had a problem with me parking my truck in front of my place to do such things as bringing my groceries into my house too. I will never live in an HOA governed community again. Renting, or owning...period.

Uhaul trucks that are 27’ are under 26,000 lbs. and so are most box trucks! That rule needs to prohibit those type of trucks. Vans and Pickups I’m ok with but I’m glad city Ordinances prohibit box trucks and huge vehicles like that by weight also.

I lived in an HOA for 3 years and hated it. We got written up I think at least three times for infractions like having a car on jacks in the driveway, boxes on the porch (after we moved in!) and I believe they wrote in the new HOA rules about not having trellises for your garden (which yours truly had!). Now I am HOA free and love it; not just for the freedom but also to not have yet another tax that increases every year.

I like the ability to park work trucks in the driveway of homes. I don't have a lettered work vehicle, but I know my neighbor had to park his work truck at a local park, have his wife drive over and pick him up, bring him home, and then take him back to his truck in the morning. What a pain! So happy they'll be able to use their own driveway and live in peace finally.

Florida V&T laws cover golf carts. They can only be driven on the street when local legislation has been passed for an area that has been marked showing the boundaries. They are still a motor vehicle that have to obey all laws including registration's and insurance. If you are injured on one, be prepared that your health insurance may not cover the injuries. Out side TV antennas cannot be banned due to FCC regulations.
