On March 1st, 2022, the New Mexico State Supreme Court reaffirmed that all New Mexicans have a right to fish, float and otherwise recreate in the rivers and streams of New Mexico even where those waterways cross through private property.
Congratulations to all New Mexicans who now have equitable access to this cherished, public, natural resource.

This is a very important ruling. So happy that these public resources are not limited to private enjoyment.

how about dry river beds?

We'll have more guidance after the NM Supreme Court issues their full opinion explaining the ruling. My assumption is that dry river beds will not be treated the same as flowing streams and rivers. The basis for public access to rivers and streams is that the pubic has a right to recreate in the water. I think a test of reasonability would suggest that if there is no water then that public access component does not apply. There may end up being exceptions, like perhaps a waterway that has water in most segments, but has short dry sections that need to be crossed to access the next pool or flowing segment? In short, right now we just don't know but this is one of the nuances that will have to be addressed in the near future.
