On July 13, 2022, South Korea’s Unification Ministry released photographs of two North Korean fishermen being dragged across the border from South to North Korea. At the time of the 2019 deportation, the government of then-president Moon Jae-in called the fishermen “dangerous criminals”, who had killed 16 fellow shipmates in a fight over an abusive captain before the ship crossed the sea border. The current South Korean president has revisited repatriation cases in a recent show of support to defectors. The UN has also said South Korea likely violated the men’s rights.

@@fask1851 Yes. Human rights exist to guarantee a due process. Due process exist to guarantee that noone faces an unfair process, to stop abuse in the justice system, the fabrication of charges and evidence, and above all to stop torture. When I defend human rights I do it not because I think people is innocent, but because I want everyone to face a fair process so justice can be truly served. Now, when it comes to the fishermen I don't know what else could have been done. The situation between the two Koreas is pretty tense as it is.

@@C4rnee It doesn't mean South Korea doesn't have propaganda. The SK side of the DMZ plays K-Pop and various other genres, but they only do it for a few hours of the day (compared to NK doing it for nearly the entire day).

It was self defense The trio tried to escape and their 16 coworkers in the fishing ship tried to stop them They fought to the death and the trio won They were escaping a communist dictatorship They basically punished them and sent them back to North Korea to be publicly executed for the crime of leaving a country that’s just a giant concentration camp

I think the huge thing people are forgetting here is that these men were most likely tortured after they got sent back. Yes, they’re murderers, but have you considered that in most democratic countries, murderers at the very least go through the legal process and sentenced? They sit to rot in jail or prison. In North Korea, you go through a “legal process” and get tortured and hanged. Your family is also likely to suffer the same fate. Rotting in prison for years is one thing. Having the last few months of your life be purely torture is something entirely different.

Humans writes should change its name to criminal rights, because protecting someone's rights who has grossly violated multiple peoples rights is no a humanitarian act, but a criminal act. Natural law or human rights law states: violating the rights of another person will be met by equal retalitory force by legal authority to protect the rights of others and provide justice to compensate the victim. In this case I believe this to be an equal demonstration of retalitory force and just compensation to the victims. Human rights watch is wrong for upholding the rights of criminals who do not respect or care about the rights of others.

It is not our place to judge the North Korea judicial system and whatever law they had. Why not question USA's lobg time buddy, Saudi Arabia? USA did not question the human rights violation and the syariah law in Saudi Arabia which did utilize torture as a punishment method. No offense, those in democratic countries should kept their business to themselves first and foremost, rather than poking their noses in other countries business.

Not saying this is the case but after watching seaspiracy or something similar, from what I remember workers can be treated as literal slaves when they are on the fishing boats around those waters. There's no one to regulate them when out on sea and they are at mercy to the ones in charge. Anyone that doesn't take orders can be killed and when the boat comes back the captain can just say they accidentally fell off the boat or something.

While I haven’t yet taken a look at any sources, some have stated that the murders were not in an attempt to defect, rather the North Koreans chose to sail to the south in order to avoid the punishment brought by the DPRK (whether that may involve public execution or the killing of the criminal’s family in this case, I do not know). If this is indeed the case, while unfortunate in the opinion of some, considering the major human rights violations that North Korea is known for (such as the ones previously mentioned), the deportation of these individuals is not unwarranted.

Technically South Korea should have tried (and most likely have executed) the criminals, since they don't recognize the sovereignty of North Korea, therefore they have no 'North Korea' to repatriate them to. They would've still remained guilty and tried though. Either execution or life-sentence would've been unavoidable.

All of this happened because of the pro NK left wing former President Moon. NK said 2 fishermen were violent criminals who killed 16 people. They said fishermen fled to SK for fear of punishment. However this is one sided claim by NK. There is no evidence. The territorial clause of the Constitution of the Republic of Korea states that the Republic of Korea shall be the Korean Peninsula and its annexes. In addition, it is stated that North Korea is an illegal group that rejected the legal order of the Republic of Korea and occupied part of the country without permission. In other words, North Koreans also potential South Korean people. If North Koreans express their intention to defect , South Korea must accept if they are murderers. And if it is investigated and found to have committed a crime, they should be punished according to the laws of the Republic of Korea. Everywhere in the world, criminals are punished according to the laws of the country, not banished from the country. However, Moon Jae In forcibly repatriated the two fishermen without proper investigation. The Ministry of Justice also said this was not legally correct, but the Moon Jae In ignored it. The Moon Jae In asked the Defense Ministry to cooperate in repatriating the two fishermen, but it refused. He then contacted the police commandos under the Ministry of Public Administration and Security for help. Police commandos were sent in without knowing what they were doing. Hours after the two fishermen were repatriated, Moon Jae In sent a personal letter to Kim Jong-un asking him to revisit South Korea. He is the worst president in the history of the Republic of Korea.

They got themselves into a pickle but it was predestined, self-undoing is such a cruel hand to be dealt but karma will inflict upon anyone whose debts must be paid immediately. We should all take heart in the fact that we must and will pay for everything in this world, even if sometimes only through our own deaths. There are still many criminals at large who have committed heinous crimes and they think they are sheltered and free, but make no mistake there is something else awaiting, even if it's not punishment in its human form.

SK said that since 2010 they have over 200 fishermen in and since 2010 they only deported/expelled 2. These two. But the thing is, they are not yet tried, prosecuted nor found guilty by the South Korean judiciary. Fyi, South Korea constitution, defines all North Koreans as South Korean citizens.

All of this happened because of the pro NK left wing former President Moon. NK said 2 fishermen were violent criminals who killed 16 people. They said fishermen fled to SK for fear of punishment. However this is one sided claim by NK. There is no evidence. The territorial clause of the Constitution of the Republic of Korea states that the Republic of Korea shall be the Korean Peninsula and its annexes. In addition, it is stated that North Korea is an illegal group that rejected the legal order of the Republic of Korea and occupied part of the country without permission. In other words, North Koreans also potential South Korean people. If North Koreans express their intention to defect , South Korea must accept if they are murderers. And if it is investigated and found to have committed a crime, they should be punished according to the laws of the Republic of Korea. Everywhere in the world, criminals are punished according to the laws of the country, not banished from the country. However, Moon Jae In forcibly repatriated the two fishermen without proper investigation. The Ministry of Justice also said this was not legally correct, but the Moon Jae In ignored it. The Moon Jae In asked the Defense Ministry to cooperate in repatriating the two fishermen, but it refused. He then contacted the police commandos under the Ministry of Public Administration and Security for help. Police commandos were sent in without knowing what they were doing. Hours after the two fishermen were repatriated, Moon Jae In sent a personal letter to Kim Jong-un asking him to revisit South Korea. He is the worst president in the history of the Republic of Korea.

I asked my mom about this and she was super angry at the government. I asked her why, because clearly, to me, they deserve it. Imagine killing 16 other people and trying to pass it off as if your a defector to avoid going to prison. She told me that defectors are labelled as “murderers” in North Korea. Furthermore, she said that South Korea says that every North Korean citizen who comes to the south is automatically a citizen. So she was mad at the government because if they are the south’s citizens, shouldn’t they have been given a proper trial? Shouldn’t the authorities have investigated the case further? I’m absolutely lost idk who to believe now 🤷🏼‍♀️

Its true. There was no investigation done to verify that North Korea's version of events were true. This was an executive decision made by the president to appease North Korea. Northing more and nothing less. Government officials told the president this was the bad move and the court found President's moon actions to be illegal. You mother is right legally North Koreans are legally citizens of the South.

They're already dead. This happened in 2019. The current president of south Korea felt that there was something wrong with the case. Who knows maybe instead of them killing the other fishermen, they were the only ones who survived.

I think the huge thing people are forgetting here is that these men were most likely tortured after they got sent back. Yes, they’re murderers, but have you considered that in most democratic countries, murderers at the very least go through the legal process and sentenced? They sit to rot in jail or prison. In North Korea, you go through a “legal process” and get tortured and hanged. Your family is also likely to suffer the same fate. Rotting in prison for years is one thing. Having the last few months of your life be purely torture is something entirely different.

First, their families would have been punished by the DPRK regardless of if South Korea deported the men. The three generations sentencing might have even been worse with the men absent. Second, if someone commits severe crimes, such as multiple murders, in any other country, and then flees across borders to avoid punishment, are countries not expected to extradite the criminals then? Where are we drawing the line as to which countries have a "fair enough" legal process?

They didn't deport them men without a trial; they "relocated North of the DMZ" these men without a trial. A bunch of baloney. Murderers deserve the same thing everyone else deserves: to be tried in court (with legal representation) by a jury and sentenced by a judge, whatever the outcome may be.

I understand, but I agree with the commenter who said to send them back (@Welst Nitmere). As seen in the video, these two men killed 15 people in addition to the captain. After killing them, they returned to the shore, but one of the killers was apprehended by North Korean police. The other two men observed this and fled by boat across the border to South Korea. Once there, they reported what they had done to the South Korean police, which resulted in their deportation back to North Korea. dont side with them eventhough They didn't deserve to suffer because the captain treated them so brutally; many more lives don't need to be lost.

President Moon had every right to deport the 2 men. They unalived everyone else on their boat and fled to the South. Their rights were not violated and South Korea has done nothing wrong. Desperate people do desperate measures. Killing your own fishermen is wrong but sending them back to be killed is also utterly wrong. If you deemed their behavior dangerous for doing such, the SK government could have given them a chance at life somewhere guided. The Common people should never suffer the conflict between differing Governments. You're historically one nation. It's disappointing to learn about this fisherman if ever the execution was real.
