Dr. Obaseki should know that one of the areas of flaws of the 1999 Constitution is section 188[10] which he premised his argument. The section is a self exploratory to the fact that the Constitution is inconsistent with itself when read with section 1(3). The phrase " any act that in the opinion of the house should amount to a gross misconduct" is undemocratic. So assuming the Kogi State House of Assembly wakes up tomorrow and says it appears to it that the erstwhile governor of the state-YahYah Bello has not done anything wrong towards his present fraud case, the court should rule in favour of YahYah Bello. If this is the kind of Dr. Obaseki has in mind, I think with respect to him, he still needs to go back to the constitutional class on house to interpret the provisions of the Constitution very well. Our democracy is built on just and equity but not on roadside mechanic theory.

Nobody can resurect Philip shaibu as DG, inshort, Oshiomole imposed this notorious greedy political animal on edo state, by the wisdom of wonderful edo state parliament, shaibu was flushed out as bad egg from his unmerited position as DG. When a case is presented before a judge, all parties involved are allowed to present the facts and witnesses and when a judgement is made it is based on presentation from both parties. Perhaps, the Commissioners has no knowledge of how cases are handled in court. The Federal High court concluded that the impeachment of the Deputy Governor was illegal and the relevant section of the constitution that support this decision were quoted in the judgement. The number of the house of assembly members that voted to impeach the deputy governor and whether not he was invited for the hearing and did not show up is totally irrelevant at this point. May the Deputy Governor understood the law and his right better than the members of the house of assembly and hence he did not bother to honor the invitation to him. Filing an appeal and injunction is normal and expected but how it plays out matters. A stay of execution may not survive the law in this case.
