Guilty until proven innocent. It took 48 years to prove his innocence? Wow. Everyone that had a hand in this sentence should recieve a 48 year at 100% prison sentence.

Except he was never "proven" innocent. All that happened was that some technical glitch was found in the evidence on which he was convicted, which made the evidence less overwhelmingly supportive of his culpability as it was once believed to be. In other words, the likelihood of his being the murder was once deemed at perhaps 90%, if not 99%; in light of the new circumstances, however, the likelihood was revised downward to be perhaps around 50% - not overwhelming enough to pass the threshold of "beyond reasonable doubt" demanded by the judicial standard. The conclusion is that instead of being probably guilty (i.e. guilty beyond doubt), he is only "possibly guilty" (i.e. 50% likely to be guilty). The doubt goes both ways - it's as doubtful for him to be the murder as it is for him to be innocent. He by all judicial reasonings remains a suspect who still could have actually been the real murder (though not necessarily so, hence his judicial exoneration, given the doctrine of "presumed" innocent until proven guilty".) Being "presumed innocent" in a jurisprudential chess-game is NOT the same as being "proven" innocent.

Yes, our legal system has major issues. The officials within it will even break the law to obtain their personally-desired verdicts/judgments. There is no amount of money that can replace 48 years of a life,not only that but there’s no amount of money to remove the trauma of a lifetime in prison. I have no words

Imagine how many other prisoners are rotting in prison and are completely innocent. This is exactly why I have always been anti-death penalty. This man would be dead if he was on death row and NO ONE would hear about his innocence, because who cares about dead people. Let alone dead prisoners convicted of crimes they may or may have committed.
As sad as it is, organizations that help exonerate the wrongly convicted don’t have enough resources because there are so many cases for them to work on. It’s just too late for the unfortunate innocents who were already executed.
I am crying, literally... I want to give this man a hug. I spent 4 months in there, I cant imagine 50 years.. this is so unjust and insane. I hope he has many many good years ahead of him and I hope that they bring a semi load of cash to him.
It’s sad that after all of that he now has to actually sue them just to receive compensation. How is it that they didn’t already offer this man some money for what they did to him. 48 years in prison and they expected him to just get a job as an old man where???
He needs compensation. What about the associate they mentioned that was also convicted? And the victim that was shot in the head still deserves justice as well.
@@bigt8877 compensating him for taking away his working years and ability to build wealth/save for retirement is not a hand out. Its what he is rightfully owed. Time is money and they took quite a lot from him.
No, but he must sue for a ridiculous amount of money so that the state thinks twice about ever doing this again. Also, jail time for whoever had a hand in putting and keeping him in jail would be nice
And now the prosecutor needs some prison time for doing what he or she did to this man. No amount of money can give him his years lost behind bars. Prosecutor's don't care who goes to prison as long as they get a conviction. That's exactly what happened in this case. Sickening!
Jesus I do not know this man but my heart breaks for him. I don’t understand how you can allow this innocent man to be in jail for so long I can’t seem to comprehend it and if I can’t comprehend it I don’t know how he can please help him with his trauma and give him strength😢

There is absolutely no way to repay that man on earth. Hopefully he wins big and can live a happy, comfortable life and then have a sit down with God in heaven in his eternal life.

Not true. Besides, Oklahoma is mostly American Indian so chances are excellent that the accuser and jury were mostly American Indian. Btw, although blacks are only 12 percent of the population, they account for 59 percent of all crimes. If a group doesnt commit crimes, they wouldn't be looked at suspiciously.

175,000 dollars is the maximum limit for Oklahoma, and he still has to fight it out in court to receive it, and he has stage 4 cancer, OUCH!!!! Very sad.
I am always reluctant to read stories like this because I'm afraid that the man who needlessly spent decades in prison will thank Jesus and my head will explode.
Understand god can be a powerful coping mechanism, There can be psychological benefits in the belief in god. People need all the help they can get being locked up for 50 yrs for a crime they didn't commit. I say this as an atheist.

I cannot begin to imagine what the man has gone through. I do not understand how it even got to the point that he spent a lifetime behind bars. Why? How? Who never took another look at the case? It is insane. What is the full story? I don't care if people are long gone, if responsible, their names should be revealed and why it happened.
An investigation needs to be done of all cases old & recent. Not saying everyone in there is innocent but even if there’s a 1% chance that there are a handful that are is truly disgusting
Over half his life - beyond shameful. The cases of all long term inmates need to be investigated. The original prosecutors, if still alive, should be held criminally liable for wrongful imprisonment when they have not followed the rule of law - like turning over key evidence to the defense. The taxpayers will bear the burden of the settlement Mr. Simmons is rightfully due. Where is the accountability for the District Attorney's Office?

What’s crazy is that according to law in Oklahoma the falsely accused are eligible for only $175000. He should be awarded MILLIONS, generational wealth money. He could’ve been a CEO or built a wildly successful business
Beside the damage done in a wrongful decision I saw that in Oklahoma he would get $175000 which in my opinion doesn’t even come close to compensation for what the state of Oklahoma did to him. That comes to $3646 for each of the 48 years he spent in prison! Another horrible thought is what if they had executed him? He was originally sentenced to death!
It puzzles me that the police took the recollection of a traumatized Teenager who was also dealing with being shot in the head at face value. I think Glynn Simmons should sue for millions.
