Earlier today, Only Up! was removed from the Steam Store without explanation. The Steam page has since been brought back. In this video, I'll explore what happened and the game's questionable links to NFTs.

As I was finishing up editing this, the video's Steam page was restored after being down the entire day. But I still wanted to post the video because it's important to hold the devs accountable for what happened either way (and also it's funny).

you should maybe change to "Only Up! was removed from Steam temporarely, and it's Only Downhill from here" or smth like that, but I know it gets less view so.. it's fine really. also wow I didn't know this game was made by lying pieces of s*** that only want money and steal assets lmao guess thats what you get from people who align themselves with NFTs huh

@@iveharzing With this game it's the opposite, instead of a new game coming out and overshadowing it, it's overshadowed by the game that came out years ago that it was directly based on, people aren't going to keep playing Only Up, they're just going to go back and play Getting Over It, because that one's actually good.

The author of the game was Jazzuo, a mysterious Czech designer who was known at the time as the father of B-games. B-games are rough assemblages of found objects. It's a real shame this game got so much more attention than pogostuck and jump king did. Those games have great styles, music (especially jump king), gameplay, and the maps are really unique and they use entirely ORIGINAL assets. Hopefully the upcoming jump king sequel is successful.

There's also Beton Brutal, that is actually really similar to Only Up, but have original asserts, a good scenario and a better design overall

I agree that Jump King should get more attention, but I wouldn't say Pogostuck has an appealing art style...there's a clear reason people aren't drawn to that one

Seems likely to me that they just used a bunch of random assets that they (sometimes incorrectly) assumed were free for commercial use, and some of them happened to be NFT-related. GoblinTown themself obviously know it's beneficial for them to try and associate with the game now that it's popular, but we've seen nothing of the sort from 'Only Up!'.

I mean, to be fair, if I'm not mistaken, Getting over it is also built if not entirely, then primarily out of free assets. It's even mentioned in the game itself, I believe.

If you look closely at the original comment, it mentions that the game is made out of free models, saying that it's unsurprising that such a game would steal them. I pointed out that the original game is also made from free assets, meaning that its creator didn't steal anything. So, what I meant was literally "if the game is made out of free assets, it doesn't automatically mean that it's full of stolen ones". Read what you choose to hate on, don't make a fool of yourself.

@@iwatchstuffs7933 Only Up only had one "stolen" asset and it was used by accident. The artist already settled the issue before he even posted this video. Its good clickbait content tho. As for all the other stuff and big scary "NFTs" .. the Goblintown stuff is just a digital art project with a lot of it's assets stored on the blockchain (ie. NFTs).. but its all CC0, meaning no rights reserved, complete free to use -- so the dev used it. Its smart business for small teams that can't compete with large companies hand drawing everything.

Now that the game is back on steam, they removed a bunch of other assets that were presumably stolen, and replaced them in the most sloppy way possible. Like, they put two bookselves next to each other in such a way that it doesn't look like you need to jump, but if you don't you just stuck in some weird state in between them. This could have been detected in like 5 minutes of testing. What a dumpster fire.

Testing? You think people like this play their own games? Reminder that there were a few games in ye olden days that _could not be completed_ due to egregious glitches that _any_ amount of testing would have shown was an issue. What's worse, this was before the internet, so patching the game wasn't an option. Sadly, this isn't new, and it's par for the course for greedy devs who just want to shove a game out the door and rake in the profits.

I love how this is so clearly a Getting Over It clone but at the same time, it's literally the type of game Bennett Foddy was ragging on and criticizing in his narration. That's some negative self-awareness right there from these devs.

Its good content for streamers.. spending hours to climb up a level only to fall for like a full minute straight. As for the NFT advertisement.. its not. Good clickbait tho, but the dev used free art assets from many sources, including the Goblintown art project.. whose art is CC0 license, meaning anyone can use it for free.. you could go out right now and make a book or movie using it, if you wanted.

@@mum-your Those aren't "NFTs" in the sense that they aren't on the blockchain. They are items in an inventory attached to your steam account, no blockchain tech involved. It actually is MORE of a slam against NFT's that CSGO and TF2 handle inventories without blockchain. Those items are sold at extreme premiums, without blockchains involved.

The game couldn't be more popular, and gamers still don't care about the NFT crap. That should be a loud and clear message, just like the past few years of gamers screaming "we don't want NFT's in our games" but of course, gaming companies are just going to ignore the market like usual, and then wonder why they can't make money.

I don't think its fair to say we don't care, I had literally no clue any of this was going on with the game. I thought it was just another dumb internet trend, not an actively malicious attempt at making a game by stealing assets, and also pushing NFT's.

Its because of how CSGO still does case openings, when payday 2 tried to connect to the steam market to do the same thing it got shot down almost immediately by users. As long as a blue gem AK is worth $450k-600k nfts will never go away.

I was kind of surprised when I made it to a market-type area about 1/3 of the way up and looked at the brands on the shelves, including prominent Frito-Lays products and thought "I doubt this is legal."

Should just report them to Frito-Lay so they can get sued. Devs that don't follow the rules ruin it for everyone else. If we didn't have copyright laws, you would see Dunkin Donut sex games in the adult section. There would be games were you could shoot TV mascots like Geico. NFL would have 150 different football "games". You would have a "Working At Amazon simulation game." 2,000 different Zelda remake games. Etc. Etc. It would be incredibly easy to make content off the backs of established brands.

@@Sednas tbh, I don't want to play it at all anymore. It's not just about supporting these devs, it's also about comfort in enjoying a product created by them, and the messages it has baked into it. I can generally separate an artist from their creation, such as a song from a musician; but in this case I would constantly be seeing the NFT advertising and questioning if each asset was stolen, and I'd hate the experience.

To people in the comments saying that the NFT art is CC0 license, which means the devs used the art for free and without the intention of advertising the NFTS: This could be the case. However, that doesn’t change the fact that, as Fireb0rn showed, the NFT Twitter account made a tweet tying themselves to the game and calling it a collaboration. If the devs truly didn’t know that these were NFT art pieces and didn’t want their game to be connected to NFTs, they would have apologized and perhaps made a patch that removed the art. Instead, they straight up lied, saying that their game had no connection to NFTs, which isn’t true. While the game MAYBE doesn’t promote NFTs, the art is a big connection, so to say that the game has absolutely nothing linking it to NFTs is just being dishonest. So to be honest… I’m a little bit hesitant to give the devs the benefit of the doubt on this front.

I think a likely case is that they just threw a bunch of free assets in and didn't realize that this one could not be used commercially. When confronted, they removed the asset. Calling it stolen does seem like a reach, it feels more like a mistake imo

@@hipunpun I'd still personally call it a mistake. I only go game dev as a hobby but one of the first things I learned was how to look for usable assets. Different websites and different stores offer different kinds of licenses and when a store has mixed licenses its important to read them. In a lot of cases not a lot will happen, but there's always the risk that an artist you'll break a license from WILL have the ability to take action against you. It should be common sense in the game development industry/community that "free" isn't the same as "license free" or "royalty free". Ignoring those ideas is a huge mistake, even if its 100% unintentional. They had to remove even more assets, so for me yes, its kind of a mistake, but I think the mistake starts at them not caring, not the fact that more then just a couple assets were unusable commercially and they didn't want to take the two seconds to make sure.

@@jondro6284 I don't mind, in some ways its annoying but since I've seen things like that in other creative areas I don't think its quite right to blame the artist and not the person who stone it. For example, if we used that same logic on 2D art that really doesn't work. Images on the internet are extremely easy to download or even flat out trace over even if there is a paywall of some kind, or a license contract you need to agree to first. There's an ongoing issue where artists want to post their art somewhere and other people feel obligated to take it and sell it somewhere. (art that fits a certain aesthetic tends to pop up illegally on sticker and clothing stores, and of course NFTs). As an artist I'm not about to say "Well its bad when you sell 2D art against its license, but with 3D art, as long as its free go ham" because technically a lot of art is """free""". (watermarking does help but like i mentioned, tracing or editing a downloaded photo is 100% possible). As a 2D artist I already dislike the idea of saying "Hey, you can and can't do this" and a good chunk of people will flat out ignore it. And nothing says you have to put your art under a certain license if you don't want to. Maybe you'll never touch a non-commercial license as long as you live, but it has an appeal to certain people. But in general I do hate the idea that downloadable = "I can use this however I want". It doesn't work that way and if you get complaints for breaking the rules, that's a consequence you'll have to understand.

Considering how little care was probably put into this game I don't doubt that they just took the assets and didn't even see that they weren't supposed to be used for commercial use. i.e.: they just stitched this thing together from stuff they could find for free online, and then decided to put it for sale.

It's possible that in early development they used a wide range of free personal use assets and as completion neared they weren't aware of which were not allowed for commercial use. This is common in indie projects, fortunately when confronted they remove assets they aren't allowed to use.

I always assumed the only up devs were inexperienced first time devs that just decided to mess around in Unreal Engine and publish it, so when I heard about the Waifu being removed it was extremely expected, but I guessed that they simply saw a model that was free to download and didn't look thoroughly to figure out that they can't just use it commercially without following certain rules. That being said, now that I know they lied about their ties to Goblintown I believe they probably just thought they'd get away with it. I almost can't blame 'em considering that this game's success was literally a one-in-a-million lottery win type of situation.

I'm shocked that this is the first time I've heard ANY significant acknowledgement of the NFT connection, considering that it was one of the first things I learned about the game as I watched Vinesauce Vinny play it a couple weeks ago. Considering Valve's strong anti-crypto stance, I'm genuinely surprised that the game hasn't yet been permanently taken down.

The movement of the character, is just ALS (Advanced Locomotion System V4.) which is a free asset on the Unreal Marketplace. Nothing wrong with using free or bought assets, but I just found it funny, since UE5's default character has a better locomotion system. They probably used ALS, just because it comes with the ability to ledge climb onto any surface.

Oh wow, I have noticed that the game gained traction and I silently ignored it since it didn't really interest me. I was happy that a new project got attention and didn't think much of it. Was all of this bad stuff discovered recently or did people quickly spot the mistakes and I just haven't heard about it? It's a shame really and I hope this will all get resolved. Although I don't think any rational person is going to buy the game after all of this

As a developer, I think this game can be created in two weeks, by two people (one in code, one in level design). When I see the golden nuggets that are produced nowadays by independent studios (even in the Platform category), I find it shameful that it's this kind of production that is put forward so much... Personally I hope this inspired talent out there to go "We can do better and be better" and make a legitimately good jump-puzzle game that functions properly and doesn't shoehorn NFTs. Just a fun, fully-purchased stand-alone product. Maybe even make a fantasy of it and include customization for characters that you want to jump as. Maybe even make it a Maple Story aesthetic and give it some online features, like you're trying to beat each others' high scores? I don't know, but there's a lot better options than what UP glued in.

In a way I'm not surprised this game got popular. The sheer amount of random assets means every screen there is something new, it's an endless stream of unexpected absurdity. That's pretty rare in and of itself. Combine that with streamers struggling and raging, and a lot of people or going to find it engaging to watch. Shame the developers are struggling with honesty.

if i were making a game, i would use stolen assets temporarely in alpha before release in order to get the picture of the game i want to make. THEN i would replace them with my own assets... i hope they do just that.

Should never use stolen assets in game development period. If you just need placeholders there are mountains of free assets you can access without stealing from anybody. Even if you had harmless intentions, it's a dumb liability risk to take. It's easy to confuse your assets. Which ones are free and which ones did you have to license? You'll inevitably go live with stolen goods because you mistakenly thought that tea set model you used was from a free kitchenware pack you found when it was actually an unlicensed model you downloaded from the internet somewhere.

@@marmaje6953 Ofc! There's free asset stores everywhere designed specifically for use in starter/low budget development. It depends on the engine you're developing on, but they all have asset stores with tons of freely available stuff from 2D to 3D models, environment assets, sounds, vfx, AI and animations, everything you could need to start or even finish a project. All the more reason why theft in a game like this one is just unacceptable, all they did was slap a bunch of 3D assets together and create a platformer with them. They didn't even create their own movement and mantling system, they used an already available one (which they also stole). Something that simple should have been incredibly easy to find free assets for since there's no specific theme to the whole game. You can find some fairly high quality 3D models and environement fixtures for $10-$20 if you move beyond the free stuff too. No real reason to pirate with such a large free market available unless a developer has genuinely bad intentions to steal/profit off stolen assets.

Not necessarily stolen, new game devs use free temporary assets as placeholders and later replace them. It's likely they just didn't realize select asserts were not allowed to be used commercially, and replace them when requested.

Although I agree there are many things to dislike about the game, the developers, and the assets, I think its unfair to label it a “getting over it clone” when its at the very most inspired by it. They may be in the same genre and have a similar premise, but cmon they are very very different games. Nah, there are plenty of indie cashgrabs. They just come in waves depending on what games are popular and easy to make (or games that people really want). This one just got popular. It actually may not be as blatant as you stated. Some people assemble asset packs from ripped 3d models and other devs will actually mark the pack as safe to use how are you supposed to know especially as something asset intensive as this.

I mean, some areas in the game had no hitboxes, to the point of noclipping thru a platform unintentionally. Speaking of hitboxes, any objects with them that aren't cubes are just that, hitboxes, not hitspheres or hitboxes that are at least accurate to how the asset is looked, cuz something like a circular prism in the game still has the collision of a rectagular prism

What I find really strange is that RU-vid started recommending the crud out of people's Only Up videos, there's at least one everywhere I go - and while I tend to avoid the "latest trends" because people beat dead horses to a second death and I'm already tired of the 100 recommends I don't care about... Even just the first one bothered me. Something just felt wrong about it and I had no reason to believe it would be what it is. I got the game day 1 and refunded almost immediately. Had no controller support and ran like utter crap. It's a shame, because I liked the way the game looked and the premise, but it was just way too rough.

To be fair, stolen assets can be used by accident by a lot of people, and it happens all the time, even if this particular case probably isn't one of those. All it takes to accidentally steal assets is for someone else to repost a not-for-reuse model as a reusable model on a different platform, and that someone wanting to use it finds that other model. They'd think it was reusable despite it not being so. Not saying that's what happened here, just saying that it's common. Heck, it seems to have happened to one of the biggest companies in the world, Roblox, considering that games situation with the "Oof!" sound effect.

One of the most important things when using assets that you didn't create is to make sure you have rights to use that asset. If you aren't %100 sure of the licensing, then you don't use it. It's that simple. I didn't know isn't really an excuse.

@@izumichan31 And yet it still happens because it's really easy to fake ownership. Someone using an asset that they thought is free to use isn't going to comb through the relevant asset stores just to make sure that the asset isn't copied. It happens so often that the legal courts have a precedent with the "innocent infringer", and, while that defense doesn't negate damages, it does reduce them. Making a broad generalization like, "I didn't know isn't really an excuse" disregards the countless people who've just made random test asset flips to learn game development using what they thought were free to use assets. And games use hundreds of thousands of assets. All it takes is for one uncleared asset to slip through in an otherwise legit bundle of assets or something, so, while it sounds easy to simply check your assets beforehand, it isn't always that simple. So, yeah, of course, I advise double-checking the assets you use and to err on the side of caution, but this kinda stuff is going to happen sometimes, no matter what. I'm not excusing this specific developer, I think the reasons for which they made this game are gross and the reuse of others' assets could easily be due to NFT bros' frequent misunderstanding of fair use, but it's pointless to cast this as if it were as simple as, "Just check every single asset you use beforehand, hurr durr."

I've seen a ton on SketchFab ripped directly from other games. For my own prototype, I'm using a few weapons off there that look legit but I'm probably going to replace them and stick to almost exclusively using unreal marketplace assets
