A while ago my husband’s visa was dragging and I couldn’t get an answer. A colleague of mine experienced the same problem. She advised me to write to my congressman and he sent a letter to immigration, he sent me a copy of the letter he sent and within weeks my husband was here. Also since you are pastors in your state the governor can help. Use your resources, you will be surprised how quickly the problem will be resolved

This really upset me. My heart goes out to your family. The stress is overwhelming. Father God please intervene. We know that you can do anything. We know that you can make all things possible. While unfortunate, she was not denied “for nothing.” She overstated. USCIS is horrendous, I know this. But there is some level of personal responsibility that you are lacking on this issue.

Man, you guys should have know better than that. But I hope you can sort it. Im a New Zealander married to a Canadian and the hoops we have had to jump through for permanent residence & then citizenship was rediculous & expensive. Never mind visiting before that. Visitor visas, work visas, resident visas, and it goes on and on. Also all done in French & English. Nightmare! And getting a Police clearance from the RCMP when the documents provided werent enough was fun, many an early morning Video call due to time differences... Uggg...

I’m glad you’re reaching out to your representatives! Someone’s got to help. That is very ridiculous. And like you said on the other video, she’s an older person they don’t do their life online like younger people do. And make everything online like that is just crazy. I will keep praying that she is able to get here soon. I can’t imagine not being able to meet my grandchildren.

Yes, its distressing, but they did the wrong thing unfortunately. Anyone going into Visa required countries knows what the limits are. I was counting every hour of day with time zone changes.

Immigration is the worst my sister in law overstayed one day because she gave birth in the United States baby came 2.5 months early and was in the nicu but after talking to a lawyer they basically stated anyone who over stays let it be one day or two years the usa truly gives a permanent ban. Even though they say 5-10 years

It's kinda like when foreign high school student attends school on a student visa and by law can only study at a private school since public schools are tax funded and on the flip side children born abroad to people who jump the US border are allowed to study at public schools (meaning no tuition) go figure.

I totally understand! Those homeland security people are the last say in who enters. When you are doing things by the book, it’s so frustrating. I’d suggest you contact your senator and see what he can do.

I am so sorry to hear this...I'm a Canadian living in US since 1963, and now have to reapply for my green card every 10 years. I wish Soli's Mom could get a green card...maybe that would make it easier fir her to visit. All of you will be in my prayers. Please keep us up-to-date. Prayers for sure for a better outcome.

Unfortunatly once you overstay your visa, even if it's a geniun mistake, it will be VERY difficult to get a new visa. If the interview lasted only 2 min, chances are they had already made a decision before they even met with her.

I’m so sorry that happened to Solo’s mom. I used to be an immigration agent. If it is at all possible, I would recommend seeing if an immigration lawyer can assist with the process. I would suggest avoiding a paralegal service as they will simply do the paperwork. An Immigration lawyer will be able to explain why she was denied a visa and what the next best steps are. Good luck!

She was denied because she overstayed a previous visa and thus broke the rules of her visa. She’ll be lucky if she ever gets accepted for another. Rules are in place for a reason and if they decided to break them they must deal with the consequences.

How frustrating for everyone...this is completely unfair that they won't even let her speak and hear her explanation, how can they deny someone a visa without explaining why? I’m so sorry your family is going through this stress. My husband is from an African country as well and we went through similar issues to get travel visa for his parents to visit. We ended up going through the green card process and was able to it approved in timely manor. Praying for you and your family.

Our children’s Aunty and uncle have never met them or myself. Missed our wedding and three births. Can’t get to Australia for a visit at all. They can’t get a passport or visa.

Dear Solo and Sarah, my sister has gone through the same thing and the more she tried the worst it got. In the end she was forbidden to enter the country for 10 years and even after that period she was denied. So please if you have another route to go ( living visa) please take it and stop trying to get a visitor one so that it doesn't happen the same to your mother. God bless you ❤

Hi I understand what your going through. With a resident visa I think you can stay in USA for 6months and can be in your home country for 6 months. You need to be back in the USA again and don’t pass the period or you can loose the resident visa.

I feel this in my SOUL. My husband half joked we should just have my sister walk over the boarder and cry asylum. Its the fastest and cheapest way to get in. Following immigration rules is so hard right now. I feel so insulted after the 10 years i put in to become a citizen and now everyone who doesn't follow the rules get in and those who do get locked out.

You should have done that, if it is so easy. The refugee act is from 1980, so provided you relocated after that, the law was as it is now. Maybe it is in the news more now? US is also a party to the 1967 Protocol Relating to the Status of Refugees, which expanded on the 1951 Geneva Convention.

While I have a ton of compassion for them and pray she can come soon and my own family waited many years for approval to immigrate, I feel compelled to tell you that coming across the border is not easy or something to joke about. I work with children in foster care who were brought here for asylum. Many have had family members literally killed in the streets and would likely have met the same fate if they hadn’t left. They were locked up in facilities for months waiting for family members who lived here to be identified and have the ability to come get them. Those family members are often unable to care for them long term and they end up in foster care. The trauma they carry is unimaginable to most of us. Helping them find legal assistance is a nightmare lasting many months for us, even as adults who speak the language and are professional social workers. I don’t know how anyone can navigate this totally inadequate system. Many have become pregnant as a result of being victimized on their trip or due to their vulnerability once they get here. They’ve chosen to keep their baby despite the trauma. So now they wait in constant fear that they will be deported, wondering what will they do about their child. Once they are out of foster care, they can’t get financial assistance and can’t work legally because the system is backed up for many years and even despite our years of trying to help them, it wasn’t enough to get the cases settled. I know it’s a complicated issue with many layers and many facets, but I hope you’ll show compassion for the least of these who are suffering so much.

I feel bad that she didn’t have a great experience with immigration. But the overall Attitude that you have been “wronged” is disheartening. Rules are there for a reason. And the fact that they are so difficult is even more of a reason to pay attention and have your ducks in a row.

We had this happen. My husband is Canadian in the USA where we met. He stayed over eight days. We left the country and moved to Canada. Never knew anything till a year later when we went to cross to visit my family. He got a ten year ban from the USA. We got a lawyer and she went to court for him in Chicago. Took about a year of that and lots of money to have it removed and pardoned. Then they said he had a three year ban instead of ten. That was the verdict. Lawyer was worth it but it’s so pricy and so much paperwork back and forth.

This is the reality. Unfortunately if you overstay your VISA (intentionally or not) there is a penalty imposed. Glad you were able to lessen the ban.

I have no advice or connections to help you, but I definitely will pray for your family, and that this immigration debacle is resolved, and Solo’s mom can come and visit from Kenya. As a grandma myself, I can understand the heartbreak of being apart from your grandchildren, and especially wanting to visit them, and not being able to.

So sorry to hear Solo's Mom having issues. Hopefully, it can get straightened out soon. I think Belle really favors her. A friend of mine had a daughter that lived in China for a while. Travel back and forth from there to U.S. was a challenge.

I studied immigration law and worked for immigration firms and have done visa petition and it is indeed frustrating. It is very arbitrary in terms of your interview. Some immigration officials are just down right mean and lack empathy. The way borders separate families is quite hard. The denial and visa overstay could have a significant effect on future visas. However, nothing is impossible with grace. Solo should consider petitioning for mom. She can stay in the USA for her statutory time and file for citizenship. After that, she can come and go as she pleases. You may want to seriously consider that option. 5 years living in the USA continuously and going home to visit family goes quickly. If not, she may always run into issues when applying for a visitor’s visa. Additional applying for permanent residency can take time but at least you can start the process sooner than later.

I worked at an EU Embassy in Kenya for many years and I can assure you that the overstay and the denial have a worse impact than you realize. What people don't know is that Embassies are profit-making ventures. In Africa, their goal is to accept as many visa applications as possible but approve as few as possible, so it is possible that they will continue denying her visa because she gave them good reason to deny the visa and in their view, ignorance is no defence. I wish you the best, hopefully someone will assist you.

I know what you are dealing with. My daughter lives in South America. In March I finally got to meet my first grandchild (3 yo) and my son-in-law in person. Those 3 months that they were here flew by! No one realizes all the calls, forms, embassy visits, money it takes to visit here; just about as complex for her to get married there and having a baby during corona. Oh the stories I could share.

Just have her come through the Mexican border. That's wide open, and she'd get a phone, medical, clothing, free education, etc. But because she's doing it legally, they deny, deny, deny!

Hi Sara and Solo, I am so upset that the Embassy did not issue the visa to your mom. I could see the sadness in Solo's eyes. That is a man who lives his mom!! I was so looking forward to seeing her with you guys, and the grandchildren especially. From what I have deduced you have reached out to your Congressional Representative. I must let you know based on experience, that the CR course of action will be a letter to the respective embassy explaining that you are his or her constituent etc etc. That letter usually goes to the to the Consul General, that is the person who leads the Consulate, which is visitor and non-immigrant visas. and then he or she forwards it to the Chief of the Non-Immigrant visa unit. The denial will be researched and all the pertinent info regarding the denial and under the respective sections of the law will be noted. That letter will be sent back to your CR via diplomatic pouch, and you will be contacted and basically all the different sections of the US immigration law under which she was denied will be cited (214(b) to you and that will be it!!! I must be honest with you that your mom will not get a visitor visa anytime soon. We all know your mom was here as a visitor. However, chances are the Consular Officer who interviewed her believes she was working. Now we all know she was not. Another thing is ,she has TWO sons who live here, which, where the embassy is concerned makes it more probable that she will come and not return. Your CR is the only third person who will be given the basis under which she was denied. You will never be told. Your CR cannot request the embassy to issue a visa. He or she will only be told why she was denied. Again, I think you both should consider filing for her to get a green card. You do not need an attorney, just go online to US Citizenship and Immigration Services and get the ball going with her "green card" There is no wait period or numbers because Solo her son, is a US citizen. As soon as the I-130 petition is filed and approved, she will be notified, and as I told you earlier she will be here, before you know it, and can come and go as often as she likes. She does not have to live here. Hang tight, you are God fearing Christian people with faith. Its going to work fine.

My husband’s family is in Honduras. Getting my husband and children’s paperwork to come with residency was 18 months of headaches. Things changed and I had to figure that out, no one is available to explain how to do the new way of how things are supposed to be done. Visas are always a nightmare. I know there is a lot of talk and frustration about the illegal people in the US, but if getting here legally wouldn’t be such a difficult and mean process, more people would come through legal channels. I’m so sorry for you and your mom. I feel for you so thoroughly!

The illegal immigrant issue we have here in the U.S. is definitely multifaceted. It shouldn't be so easy that people can just come in droves, yet neither should it be so hard that people have to wait years and jump through tons of hoops to get here.

I wish nobody would come here illegally, but I also wish coming here legally wasn't such a difficult thing to do. It is difficult. I have many friends that are from other countries, and a lot of them say the same thing. I will add that all of my friends from other countries have come here legally. It was a painstaking process for them.

I totally feel this with my heart. My mom Just passed away, We buried her yesterday. My 2 siblings were not allowed entree To say their last goodbye to their mother. Similar type of appointment, Barely given a second to speak. I understand we have laws and regulations But in both of our cases humanity And empathy were the missing factors

Sorry for the bureaucracy the U.S. immigration. You need to find a representative to hear your case and issue a letter. 4 years is a long time. During Covid-19, I waited 4 years to travel home to Puerto Rico, and my only aunt died during that time, my mom changed her mind about going with me. You don't need a Visa or passport to travel to Puerto Rico. I go every 2 years normally. Im so grateful and lucky. Best of luck!

Since Solo owns his own business, would it help to "hire" your mom temporarily as an employee? Even if it's just a very part time position of filing and organizing your office, a temporary employment situation could help the process. My daughter lives in Denmark. She has 2 children. Since they've been born, I've been doing the same as Solo's mom. Every other year or so, I fly over & spend several months with them. FaceTime is nice, but its not the same as holding & loving on a baby. My prayers are with you.

I totally understand the visa struggles. 12 years ago I moved to Australia. Had many struggles to get a resident status. Flying in an out couldn’t apply in Australia, had to be in America to file paperwork. And very expensive, flights at the time were about 3,000 round trip. The cost of the visa was 10k so I definitely understand some of the struggles. Praying for your family that they get everything worked out. God bless

Wow. I'm shocked at how expensive immigration is now. I did mine almost 20 years ago and I think it was under $5k all up. That includes all the fees for the paperwork, the medical visits, printing photos for relationship evidence (spouse visa), etc. I have never understood why you have to leave the country if you've applied for the visa overseas! We kinda did the dodgy thing and I came over on an ETA (hubby rang the immigration department ahead of time and they actually suggested this way!) so I was able to do it all within the country. We were up front about it in the paperwork & the interview and it wasn't an issue. Still, even though we had a relatively easy time of it, it was a really stressful period in our lives (especially straight after getting married).

I cannot imagine the frustration!! Particularly the fact that she paid for an appointment and got a two-minute brush off. Technology is wonderful but times like this if you could just sit in front of someone and say, she's a grandmother who will stay with family, she's not going to work, and here's the evidence that she always returns home! I hope you can get this resolved, it's always so nice to see her in the videos (and obviously a million times nicer for her to be able to meet her grandkids and spend time with you all!)

How maddening!!!! Our government is allowing illegals to enter our country, house them, feed them and pay health benefits but one honest mistake keeps your mother from coming for a visit. Totally unacceptable!!!! I equate it to poor customer service at any business. Close minded people do not need to be in positions that hurt others. Praying this issue is resolved (for the better) very soon.
