Thanks for the video, very helpful, I was wondering if you could help with my question. You said that you can apply for the subclass 100 two years after lodging the 309 visa, in my case we lodged a 300 visa which then we converted to a 309 visa, is our date of lodgement from when we lodged the subclass 300 visa or from when we converted to 309? Thank you so much for taking the time to make this video! I had a question that was not covered: Once the subclass 309 is granted, and the visa holder enters Australia, is there a minimum time period the visa holder must remain in the country for the visa to remain valid? For example, an American is granted the subclass 309, enters Australia, but then receives a job opportunity back in the US, and they return home to the US for 18 months. Are they then eligible to return back to Australia using their 309, or does the 309 expire or become invalid if the individual resides outside of Australia for such an extended period of time? Thank you again!

What happens to the ‘must enter australia by’ condition under covid19? Obviously it is quite difficult to enter australia from overseas nowadays (e.g some airlines may simply not offer a ticket to australia). Also, some may wish to enter australia after the quarantine is lifted. Does the Australian government take note of these circumstances?

You’ll need to contact the post that has issued the visa as they will generally extend your date of arrival to the validity date of the visa

she's got a passport, no visa required, she's a citizen of Australia already (at least that is my understanding). I am going to get my daughter a passport as soon as they reopen the office, in PP Cambodia

The Department are still reviewing applications, but due to COVID-19 it is taking more time. Please check the current processing time at immi.homeaffairs.gov.au/visas/getting-a-visa/visa-processing-times/global-visa-processing-times

Hi Priyanka You can find the current processing time on immi.homeaffairs.gov.au/visas/getting-a-visa/visa-processing-times/global-visa-processing-times Please be aware te actual processing times can vary due to individual circumstances including: whether you have lodged a complete application, including all necessary supporting documents how promptly you respond to any requests for additional information how long it takes to perform required checks on the supporting information provided how long it takes to receive additional information from external agencies, particularly in relation to health, character, and national security requirements

If I applied 309 visa through migration agent and paid full service charge then do I need to pay again to the same migration agent when I lodge 100. Visa ?

We cannot answer your question in relation to an agreement that you have with another Registered Migration Agent. The agency must had provided you with a cost agreement listing the cost involved with the visa application.

Can anyone pls guide me It says to make travel request to Australia on THE DEPARTMENT OF HOMEAFFAIRS page ,we should give out the evidence of relationship with the partner , it directs me to apply online on the exemption panel to provide evidence of relationship details. Am on a 309 spouse visa is it ok if i could furnish details as it was told immediate family member of the partner does not fall under exemption category am confused kindly correct me if i can go-ahead 🙄

Hi i got my Partner Visa 309 6months ago and nowadays I can’t go out of Morocco because of Covid 19 so Morocco close all its borders and i’m very afraid to not get in Australia before my visa date ends so what do you think as a solution that should i take for instance can i ask them to extend the time’s visa and how can i do please if you have any help can you tell me. I am sure lots of people will be happy to provide you with their thoughts about your visa application however each relationship and case is unique. As state on the Department of Home Affairs' website, the processing time for 309 Visa may take : 75% of applications: 13 months 90% of applications: 17 months Having said that, this is only a guideline. If you were requested further information, this time can significantly increase. This is why it is so important to lodge a decision ready application to avoid delays and potential refusals. As we were not involved in your application, we cant advise about your application. Therefore, I would recommend you to contact the Department of Home Affairs directly.

@@jennydiamond4756 I think your information is wrong . The update refers to traveling to Australia if your visa is granted . But my understanding is your husband apply for the visa and is in process . That can take many months even if everything is correct with your application .

hi..my husband lodged 309 and its been 11 months. the processing time is increased to 18 months now. my visiting visa was rejected twice and granted when i applied for spouse visa.my husband lodged on shore visiting visa 2 times since i have to go out of the country for every 3 months. so we contacted the immi they said to lodge onshore visitor visa and it was granted 2 times.i cant go to my native country in this covid situation.its becoming hard for us to bear the expenses of my onshore visa extentions every time. i just want to know if we could withdraw our 309 visa and lodge onshore 820 visa ? will i get the amount back for the 309 visa if we withdraw? will there be any problem for 802 visa since my visiting was rejected offshore twice? pls pls reply

I am afraid there is no government fees refund for ANY visa you withdraw. In order to provide you accurate advice, you may wat to book a consultation to discuss your case with one of our registered migration agents.

You will not get any fee back and it's next to impossible to change visa subclass with same fees you already paid. Better to try bridging visa then get working rights

@@soniasharma6992 it was opened during 11 month and they asked for extra documents and ask us to fill some forms , we submit them , we also upload photos and ticket of Bangkok where me and my husband visited during processing time but due to lockdown everything was closed so again after 18 months they took my interview and after 1 day of interview they ask for medical and police report again because it was expired ,they gave us 28 days

I'll tell you what will happen after we will upload every documents okay don't worry everything will be okay .you just need to be patience it is hard but time will come ... I have the same question as Gav J. I was granted a 309 about 9 mos ago and planned (twice) to arrive in Australia earlier this year in order to meet my 'first entry date'. Due to COVID, I am NOT able to fly to AU from US. Is there any information regarding if you are unable to meet this 'first entry date' requirement.
